Re: State Environmental Quality Review Determination for Bond Resolutions for:
Stormwater Mitigation- $500k
Land Use Project- $200k
Sidewalk Restoration- $250k
Gull Pong Bulkhead- $160k
The proposed actions to consider bond resolutions for Stormwater Mitigation- $500k,
Land Use Project- $200k, Sidewalk Restoration- $250k, and Gull Pong Bulkhead- $160k
have been reviewed to New York State Department of Environmental Conservation regulation
6NYCCRR Part 617 State Environmental Quality Review and it is my determination that pursuant to
Part 617.5(c)(27), the actions are budgetary processes and therefore are Type II actions not subject to
review.
17.5(c)(27) “conducting concurrent environmental, engineering, economic, feasibility and other studies and
preliminary planning and budgetary processes necessary to the formulation of a proposal for action, provided
those activities do not commit the agency to commence, engage in or approve such action;”
The removal or replacement of the Gull Pond bulkhead with no seaward projection is a Type II action pursuant
to 617.5(c)(2) and 617.5(c)(1).
617.5(c)(2) “replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site,
including upgrading buildings to meet building, energy, or fire codes, unless such action meets or exceeds any
of the thresholds in section 617.4 of this Part;”
617.5(c)(1) “maintenance or repair involving no substantial changes in an existing structure or facility;”
