SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated November 1, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 48,823 square foot parcel located in the R-40 Zoning District. The northerly property line measures 265.62 feet, the easterly property line measures 264.16 feet, the southerly property line measures 242.10 feet and is adjacent to State Route 25, and the westerly property line measures 146.53 feet and is adjacent to Old Main Road. The parcel is currently improved with a partial two-story frame dwelling with an attached one car garage. There is an existing one-story cottage located north of the dwelling and an existing frame shed located in the northeast corner of the rear yard as shown on the survey map prepared by Nathan Taft Corwin III,LS and dated July 1,2021. BASIS OF APPLICATION: Request for a Variance from Article IV, Sections 280-18; and the Building Inspector's September 21,2021,Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single-family dwelling 1) located less than the code required minimum side yard setback of 15 feet; located at 34685 NYS Route 25, Orient,NY. SCTM#1000-19-2-6.1. RELIEF REQUESTED: The applicant requests a variance to eenstruet additions and alterations demolish the garage portion of the existing dwelling and construct habitable space in the same footprint, including a new foundation, new walls and a new second story above for additional habitable space to an existing single-family dwelling. The proposed construction is not permitted pursuant to Bulk Schedule, which requires a minimum side yard setback of 15 feet. The demolition/reconstruction will have a minimum side yard setback of 3.2 feet. The proposed changes replace an existing garage with new habitable space that includes a laundry room,storage room,a proposed family room and a proposed bathroom off the family room. A media room and family room Page 2,March 17,2022,AMENDED August 18,2022 #7600, Shannon Holdings SCTM No. 1000-19-2-6.1 is proposed above, making the dwelling a full two-story dwelling shown on, site plan prepared by Mark Schwartz,Architect, and dated October 20,2021 ADDITIONAL INFORMATION: The northerly properly line is heavily vegetated creating an ample buffer facing the neighboring property. AMENDED ADDITIONAL INFORMATION: Originally granted March 17, 2022. In a letter dated July 25, 2025, Lisa Poyer, representative, on behalf of her client, requested a de minimus approval to recognize the demolition and reconstruction of the existing garage in the same footprint rather than referencing the conversion of the existing garage to habitable space. At the public hearing on March 3,2022 the agent for the applicant verbally presented the proposed scope of work as a "reconstruction" and "conversion" of the existing garage but never used the word demolition." In reviewing this request the Board discovered that the architectural plans approved in the original decision include a notation in very small print that refers to a "demolition and replacement of the garage in the same footprint." The Board determined that amending the original decision to correct the misunderstanding between how the application was presented in testimony at the hearing and the plans that were approved with the notation referencing a demo of the existing garage. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 3, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed demolition and new construction additions will not expand the existing footprint except for the reconstruction of the garage roof setback from 6.1 feet to 6.8 feet to allow for more ceiling height; the existing 3.2 feet side yard setback along the same westerly property line will be maintained. The proposed construction will also add a conforming second story located at the easterly elevation of the dwelling. Many of the homes in this community have been altered to update and accommodate owners who wish .to live full time in the community. The proposed additions will be aesthetically pleasing enhancing the residence. The subject property cannot be seen from the Main Road and is screened from other nearby properties by fencing and heavy mature vegetation. Therefore,the proposed construction will have no visible impact. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing residence maintains a pre-existing non- conforming 3.2-foot side yard setback which is proposed to be maintained as the footprint for new habitable space. Variance relief is required because the applicant cannot meet the Town Code. 3. Town Law&267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 78.6%relief from the code. However, the applicant is staying within the current footprint and will not expand over the already existing 3.2 foot side yard setback. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Page 3,March 17,2022,AMENDED August 18,2022 #7600, Shannon Holdings SCTM No. 1000-19-2-6.1 5. Town Law X267-b(Mb)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations to a single-family dwelling including the demolition of an existing garage and construction of a new two-story habitable addition in the same footprint garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Weisman (Chairperson), seconded by Member Acampora, and duly carried,to GRANT the variance as applied for a demolition of an existing garage and construction in the same non- conforming footprint with a new two-story habitable addition and r eenstM• and shown on the Site Plan and Architectural Drawings (Sheets S-lb, A-1 thru A-8) prepared by Mark Schwartz, Architect and dated October 20, 2021. (AMENDED AUGUST 18,2022 to include demolition language in the prior approval) SUBJECT TO THE FOLLOWING CONDITIONS: 1. Proposed porches shall remain unenclosed. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Building Department is requesting additional clarification from the ZBA with regards to the approved scope of work. The original ZBA application was submitted in October of 2021 and a public hearing held on March 3,2022 with a decision granted which was dated March 21,2022. The plans which were submitted to the board for approval were prepared by Mark Schwartz&Associates last dated October 10,2021. Town Law X267-b(3)(b)(I). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties.
