PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 11,590 parcel.located in an R-40 Zoning District..The parcel measures 94.01 feet fronting Village Lane along the northerly property line; 141.89 feet along willow street, 85.60 feet on the East side and 125.89 feet ori the South side. The parcel is improved with a one-story dwelling, an accessory garage, and an accessory shed. All is shown on a survey by Barrett Bonacci, and Van Wheele,L.L.S. dated November 11,2019. BASIS OF APPLICATION: Request for Variance from Sections 280-124; and the building inspector's August 19, 2021 Notice of Disapproval based. on an.application for a permit to construct additions and alterations to.a single- family dwelling; at 1) located less than the code required minimum secondary front yard setback of 20 feet; located at 2355 Village Lane, Orient,NY SCTM# 1000-26-1-13. RELIEF REQUESTED:'The applicant requests a variance to add an addition to the rear of the house that results in a non-conforming 18.3 feet secondary front yard setback where the Town Code requires a minimum secondary front yard setback of 20 feet. ADDITIONAL INFORMATION: According to the applicant,Village Lane is the primary front yard section of the property. -Willow-street-is-the secondary front yard section-of the-property. The applicant's representative testified that an Innovative Advanced (UA OWTS) Septic Plan is proposed to be installed. An I/A OWTS Plan was submitted, prepared by Michael Marinis,LPE, last revised April 21,2021,which depicts the proposed system located on the southwest portion of the property. ✓ Page 2,March 17,2022 #7588,Scofield SCTM No. 1000-26-1-13 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning.Board of Appeals held a public hearing on this application on March 3; 2022 at which time written and oral evidence were presented. Based,upon all testimony, documentation,personal inspection of;the property.and . surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will notproduce.an undesrable.change in the character of the neighborhood.or a detriment to nearby properties. The neighborhood is a designated historic district'with non- conforming parcels and dwellings that all pre-date zoning and therefore . do not conform to current zoning code. The existing house on the parcel and garage do not conform to the required modern zoning setbacks. 'The proposed non-conforming addition is about 3 square feet in size and is more conforming than the existing house. The proposed variance relief will not change the character of the neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing home is pre-existing non-conforming and most of the existing home has non-conforming setbacks from Village Lane and Willow Street. The proposed variance relief is more conforming than the existing setback of the subject dwelling. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing 8.5% . . relief from the code.However,the size of the.addition in the non-conforming setback area is only about 3 square feet and has received the required Certificate of Appropriateness..from the Southold Town Historic Preservation. Commission. 4. Town Law.4267-b(3)(b)(4). No evidence has_been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has not been self-created. The applicant's family has owned the property since before the establishment of zoning codes in 1957. 6.Town Law 4267-b. Grant of the requested relief is the minimum action necessary and to enable the applicant to enjoy the benefit of an area variance while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Although that application sought relief for a proposed accessory structure in the front yard, the Board accurately describes the character of the surrounding neighborhood, which is characterized predominantly by preexisting undersized parcels like the applicant's, which is only 11,590 sf in size, many also having primary dwelling structures located well less than the required front yard setback. For example, in 2007, the Board granted relief for the construction of an addition with a 16-foot front yard setback from Village Lane, three properties to the south of the applicant's, where the preexisting dwelling was located well within the required front yard setback(Case No. 6078). Similar to the adjacent southerly property referenced above, the applicant's property is constrained by more than one front yard; and similar to the property three to the south, the applicant's preexisting dwelling, whose original construction dates back to at least 1862, is located 16 feet from Village Lane and only 7 feet from Willow Street. As a result of the newly established secondary front yard setback of 20 feet, the larger of the two proposed additions, situated on the south side of the house, is designed in a conforming location relative to both the primary (Village Lane) and secondary (Willow Street) front lot lines, whereas the 18 sf addition to the east side of the house requires roughly 20 inches of relief from the newly required 20' setback from Willow Street. However this 2' wide addition will be set back toward the rear of the house relative to Willow Street, more than twice the 7' distance of the nearest corner of the existing dwelling from Willow Street. The benefits sought by the overall proposed renovation include extending the life of the historic dwelling structure by raising it to a FEMA-compliant base flood elevation and providing a new crawl space foundation; improving the dwelling's energy efficiency; and improving the function and efficiency of the living space for the owners—whose family has owned the property for more than 65 years—by enlarging and relocating the existing bedroom, creating a second bedroom, and providing updated bath and kitchen spaces. But because the original construction pre-dates Town zoning code by almost a century, the dwelling is positioned with substantially nonconforming setbacks from both front lot lines, making it very difficult to expand the footprint of the 1-story dwelling without the benefit of some setback relief, even with the recently enacted, less restrictive setbacks from secondary front lot lines. And because the additional 18 sf of habitable space created by the 2' x 9.3' addition to the east side of the house, i.e., the project element requiring setback relief, provides the additional area necessary to expand and convert existing kitchen space into a second bedroom just large enough(72 sf) to qualify as a legal bedroom, this small addition it cannot be eliminated, relocated, or reduced any further in size. Thus, the second bedroom space cannot be created without the 1.7 feet of setback relief needed to construct the 2' x 9.3' addition. 3. Representing 8.5 percent relief from the required 20' secondary front yard setback, the 1.7 feet of setback relief requested for the 2-foot wide, 18 sf addition is insubstantial, mathematically and otherwise. 4. The proposed minimally sized addition will not adversely impact the physical environment of the subject or neighboring properties. Because the subject property is located across Village Lane and more than 100 feet from wetlands and surface waters associated with Orient Harbor, the project is located .outside the wetlands jurisdiction of both the Southold Town Board of Trustees and the New York State Department of Environmental Conservation. And raising the existing dwelling to a FEMA-compliant base flood elevation not only extends the potential life of the structure for the applicant, it provides a benefit to adjacent properties by substantially reducing the potential risk of flood damage to the structure during a significant storm event.
