Chairman Wilcenski: Good Evening and welcome to the scheduled Public Meeting for
Monday, August 10, 2020 for the Southold Town Planning Board. This meeting is public. The
Planning Board may add or remove applications from the Agenda upon its discretion, without
further notice. Applications may not be heard in the order they appear on this agenda.
This public meeting will be held virtually via the Zoom online platform. Pursuant to Executive
Order 202.1 of New York Governor Andrew Cuomo in-person access by the public will not be
permitted.

SET HEARING:
Chairman Wilcenski: Gentleman's Ridge & Mini Cedars Resubdivision — This
resubdivision proposes to transfer of 0.03 acres (1,307 sq. ft.) from SCTM#1000-17.-1-
11.5 to SCTM#1000-17.-1-2.2 to provide the required well installation distance of 150'
for the proposed I/A OWTS on the currently vacant Lot 2.2. As a result of this proposal,
SCTM#1000-17.-1-11.5 will decrease to 5.32 acres total and SCTM#1000-17.-1-2.2 will
increase to 0.95 acres in the R-40 Zoning District. The properties are located on the
west side of Stephenson's Road +/- 800' north of NYSR 25 in Orient. SCTM#1000-17-1-

2020 at 6:01 p.m. for a Public Hearing upon the corrected map entitled "Mini Cedars

SKETCH PLAN APPROVAL EXTENSION:
Chairman Wilcenski: Tuthill Conservation Subdivision — This proposal is for an
80/60 Conservation Subdivision of four parcels (total area=112 acres) into 17 residential
lots, with 94 acres to be preserved. The properties are located on Main Road in Orient
in the R-80 and R-200 Zoning Districts. SCTM#'s 1000-17-4-16, 1000-17-6-14.2, 1000-
18-3-30.3 and 1000-18-6-17.3
James H. Rich III:
WHEREAS, this proposal is for an 80/60 Conservation Subdivision of four parcels
SCTM#s1000-17-4-16, 1000-17-6-14.2, 1000-18-3-30.3 and 1000-18-6-17.3 (total area
= 112 acres) into 17 residential lots, with 94 acres to be preserved. This project includes
the transfer of yield among the four parcels pursuant to §240-42 F of the Southold Town
Code.
SCTM#1000-17-4-16 (North Dyer) equals 21 acres proposed to be subdivided into 6
lots where the lots range in size from 0.7 - 0.9 acres. This property includes a 0.7 acre
private right-of-way and 15.6 acres of preserved open space inclusive of 6 acres of
unbuildable lands.

SCTM#1000-17-6-14.2 (South Dyer) equals 35.3 acres proposed to be subdivided into
5 lots where the lots range in size from 0.5 - 0.9 acres; property includes a 0.5 acre
right-of-way and 28.5 acres of open space inclusive of 15 acres of unbuildable lands.
SCTM#1000-18-3-30.3 (North Brown) equals 28.7 acres proposed to be subdivided into
5 lots where the lots range in size from 0.7 - 0.8 acres. This property includes a 1.3 acre
private right-of-way and 23.7 acres of open space inclusive of 2 acres of unbuildable
lands.
SCTM#1000-18-6-17.3 (South Brown) equals 26.9 acres proposed to be subdivided
where Lot 1 equals 0.92 acres. This property includes 25.5 acres of open space
inclusive of 0.62 acres of unbuildable lands; and
WHEREAS, on July 3, 2014 the agent submitted a Sketch Plan Application and fee in
the amount of$500.00 with other required materials for submission pursuant to Article V
Sketch Plat Review; and
WHEREAS, on December 2, 2019 the Southold Town Planning Board granted
Conditional Sketch Plan Approval upon the maps entitled:
• Sketch Plan North Dyer dated as last revised April 3, 2013,
• Sketch Plan South Dyer dated April 1, 2011,
• Sketch Plan of North Brown dated October 22, 2013,
• Sketch Plan of South Brown dated as last revised April 2, 2013; and
WHERES, on March 12, 2020 the Town of Southold declared a state of emergency due
to the COVID-19 Pandemic; and
WHEREAS, Conditional Sketch Approval, granted by the Planning Board on December
2, 2019, expired on June 2, 2020 pursuant to Article V. Sketch Plat Review§ 240-14.
Expiration of the Southold Town Code; and
WHEREAS, on July 18, 2020 the applicant submitted an email requesting an extension
from June 3, 2020 to June 2, 2021 of the Conditional Sketch Plan Approval to allow
additional time to file the Final Plat Application; therefore be it
RESOLVED, that the Southold Town Planning Board grants a retroactive extension of
time to file the Final Plat Application from June 3, 2020 to June 2, 2021.

CONDITIONAL FINAL PLAT DETERMINATION:
Chairman Wilcenski: Peter Harbes Open Development Area — Lot Creation —This
proposal is for the creation of the lots in an 80/60 Conservation Subdivision of a 22.17-
acre parcel. This parcel is proposed to be subdivided into 4 lots, where Lots 1-3 are
1.26-acre residential lots and Lot 4 is 18.38 acres of preserved farmland in the AC
Zoning District. The property is located on the w/s/o of Aldrich Lane, +/- 1,300' south of
Sound Avenue, in Laurel. SCTM#120-3-1.1.15 & 16
Martin Sidor:
WHEREAS, on August 25, 2009, pursuant to Southold Town Code Chapter 240 Article
VIII Open Development Area, the Town Board granted the applicant the right to seek
future approval of the creation of lots; and
WHEREAS, this proposal is for the creation of the lots for an 80/60 conservation
subdivision pursuant to Southold Town Code §240-26 Establishment; and
WHEREAS, the proposal is to subdivide a 22.17-acre parcel into 4 lots, where Lots 1 - 3
are 1.26-acre residential lots and Lot 4 is an 18.38-acre farm with the development
rights held by Southold Town; and
WHEREAS, the Southold Town Planning Board granted a Negative Declaration under
SEQRA for an Open Development Area on August 10, 2009; and
WHEREAS, pursuant to Town Code §240-26 Establishment, the landowner received
Sketch Plan Approval for a conservation subdivision on August 10, 2009, and sold the
development rights on proposed Lot 4 (18.38 acres) to Southold Town; and
WHEREAS, the Southold Town Board approved an Open Development Area on August
25, 2009, which designated the 3.79-acre development area for the future creation of
three residential lots; and
WHEREAS, Southold Town purchased the development rights from proposed Lot 4
(18.38 acres) for the purpose of farmland preservation; and
WHEREAS, pursuant to §240-30 Creation of lots, the landowner of the filed map
petitioned the Planning Board on April 15, 2013, to create all of the lots designated on
the approved and filed Sketch Plan; and

WHEREAS, on May 17, 2013, the applicant submitted a Final Plat application to the
Planning Board for review; and
WHEREAS, In August, 2013, the Planning Board requested a revision to the subdivision
map; and
WHEREAS, no revised maps were submitted between August, 2013 and January,
2020, and no further action was taken on the inactive application; and
WHEREAS, on January 7, 2020, the agent requested that the application be re-
activated; and
WHEREAS, on February 10, 2020, the Planning Board found the Final Plat application
complete; and
WHEREAS, on February 12, 2020, the application was referred to the Suffolk County
Planning Commission, Town Engineer, Riverhead Town Clerk, Suffolk County
Department of Health Services, and Local Waterfront Revitalization Program; and
WHEREAS, on February 23, 2020, the Suffolk County Planning Commission found this
a matter for local determination; and
WHEREAS, on July 20, 2020, the Planning Board found the application consistent with
the policies of LWRP and accepted the comments from the outside agencies in which
the application was referred; and
WHEREAS, on July 20, 2020, the Planning Board determined that this application met
the requirements of the Town Code for a Final Plat application; and be it therefore
RESOLVED, that the Southold Town Planning Board grants a Conditional Final Plat
Approval upon the map entitled, "80/60 Conservation Subdivision for Peter Harbes",
prepared by Howard M Young, Land Surveyor, dated and last revised February 13,
2013, with the following conditions:
1. Obtain approval from the Suffolk County Department of Health Services
2. Submit 12 paper copies and 4 Mylars of the Final Plat revised as follows:
a. A vegetated buffer comprised of a double row of 6' evergreen plantings at
10' intervals to screen the residential lots from the existing farm operation
must be shown and labelled;
b. 18 street trees shown and labelled along Aldrich Lane;
3. Approval stamp from the Suffolk County Department of Health Services;
4. File the amended covenants and restrictions as drafted by Planning staff with the
Suffolk County Clerk's Office;

Chairman Wilcenski: Gonzalez Standard Subdivision —This proposal is for the
standard subdivision of a 4.29-acre parcel into two lots, where Lot 1 is 2.07 acres and
Lot 2 is 2.22 acres in the R-80 Zoning District. This parcel is located at 2050 Platt Rd
(+/- 1,830' south of S.R. 25), Orient. SCTM#1000-27.-1-9

WHEREAS, this proposal is for a Standard Subdivision of a 4.29-acre parcel into two
lots where Lot 1 is 2.07 acres and Lot 2 is 2.22 acres located in the R-80 Zoning
District; and
WHEREAS, on August 5, 2019, the Planning Board granted Conditional Final Plat
Approval on the application; and
WHEREAS, on January 31, 2020, the applicant requested a 6-month extension of the
Conditional Final Plat Approval granted August 5, 2019 and set to expire February 6,
2020 in order to receive approval from the Suffolk County Department of Health
Services; and
WHEREAS, on February 10, 2020, at their work session, the Planning Board agreed to
retroactively extend the Conditional Final Plat Approval from February 6, 2020, to
August 6, 2020, in order for the applicant to receive approval from the Suffolk County
Department of Health Services; and

Conditional Final Plat Approval upon the plan entitled, "Gonzales Standard Subdivision
Final Plat," prepared by John T. Metzger, Land Surveyor, dated April 29, 2015, and last
revised July 3, 2019, from August 6, 2020 to February 6, 2021 with the following
two conditions:
1. Submission of 12 paper copies and 4 Mylars of the Final Plat including the Health
Departments stamp of approval;
2. File the covenants and restrictions with the office of the Suffolk County Clerk.

STATE ENVIRONMENTAL QUALITY REVIEW ACT DETERMINATION:
Chairman Wilcenski: Strong's Storaqe Buildings —This Site Plan is for the proposed
construction of two (2) buildings for boat storage, one at 52,500 sq. ft. and the other at
49,000 sq. ft., located on 32.6 acres in the MII and R-80 Zoning Districts where there
are 69,245 sq. ft. of existing boatyard buildings. The property is located at 3430 Mill
Road, Mattituck. SCTM#1000-106-6-13.4

WHEREAS, this site plan is for the proposed construction of two (2) buildings for boat
storage, one at 52,500 sq. ft. and the other at 49,000 sq. ft., located on 32.6 acres in the
MII and R-80 Zoning Districts where there are 69,245 sq. ft. of existing boatyard
buildings; and

WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed
action is a Type I action pursuant to 617.4(b)(10): Any Unlisted action, that exceeds 25
percent of any threshold in this section, occurring wholly or partially within or
substantially contiguous to any publicly owned or operated parkland, recreation area or
designated open space, including any site on the Register of National Natural
Landmarks pursuant to 36 CFR Part 62, 1994 [see 617.17]. The physical alteration of
3.74 acres exceeds 25% of the 10-acre threshold listed in 617.4(b)(6); and
WHEREAS, on February 10, 2020, the Southold Town Planning Board has determined
that this proposed action is an Type I Action under SEQRA as described above; and
WHEREAS, the Planning Board performed a coordinated review of this Type I Action
pursuant to 6 NYCRR Part 617, Section 617.7 of the State Environmental Quality
Review Act (SEQRA); and
WHEREAS, no objection to the Southold Town Planning Board taking Lead Agency for
the action was received; therefore be it
RESOLVED, the Southold Town Planning Board hereby declares itself Lead Agency for
the SEQRA review of this action.

SET HEARING:
Chairman Wilcenski: North Fork Self Storage III —This site plan is for the proposed
construction of two (2) 2-story self-storage buildings at 53,800 sq. ft. and 37,750 sq. ft.
which includes a 300 sq. ft. office; and 18 parking stalls on 3.7 acres in the Light
Industrial Zoning District. The property is located at 65 Commerce Drive, Cutchogue.

WHEREAS, this revised Site Plan is for the proposed construction of two (2) 2-story
self-storage buildings at 53,800 sq. ft. and 37,750 sq. ft. which includes a 300 sq. ft.
office; and 18 parking stalls on 3.7 acres in the Light Industrial Zoning District; and
WHEREAS, the Southold Town Planning Board received a revised site plan application
for the parcel referenced above and due to the substantial change in design, the action
will be classified under SEQRA, redistributed for referrals and a public hearing will be
held; and
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed
action is an Unlisted Action as it does not meet any of the thresholds of a Type I Action,
nor does it meet any of the criteria on the Type 11 list of actions; be it therefore

PUBLIC HEARINGS
Chairman Wilcenski: 6:01 p.m. - Zupa & Paradise Point HOA Resubdivision —This
resubdivision proposes to transfer 5,240 sq. ft. from SCTM#1000-81.-1-16.7, the
residential parcel, to SCTM#1000-81.-3-29, the road parcel, in order to provide one
contiguous common access to the docks owned by the Paradise Point Association. As a
result of this re-subdivision, SCTM#1000-81.-1-16.7 will decrease from 75,533 sq. ft. to
70,293 sq. ft., and SCTM#1000-81.-3-29 will increase from 20,512 sq. ft. to 25,752 sq.
ft. The Zoning Board of Appeal approved of the undersized lot area in variance File:
7186. The properties are located on Basin Road, +/- 500 ft. west of Paradise Point
Road, in the R-80 Zoning District, Southold. SCTM#1000-81-1-16.7 & 1000-81-3-29

Heather Lanza: I would say for anyone listening, if you'd like to speak, you would raise
your hand. The way you would do that is there should be someplace for you to click to

Bruce Anderson: Okay, nice to see you all. I really don't have anything to add because
the description was so complete. It's really, for us, almost an administerial type action, it
does resolve a long-term zoning dispute wherein technically, the Zupa parcel contained
both what the Zoning Board initially called a marina and a single family house on the
same property so that—there's a long history of litigation and the purpose of this
application is to resolve that. It's part of a stipulation of settlement as I understand and ,
if approved, then the Zupa lot would be entirely residential and the boat basin, which is
owned by the Paradise Point Association, would be entirely connected to Basin Road.
So that's really the point of this application. I'm here to obviously answer any questions
you may have.
Heather Lanza: Shall I share the map so everyone can see?
Chairman Wilcenski: Sure, you could put that up, Heather and Mr. Zupa, you're one of
the persons in the audience, you can unmute yourself and speak if you'd like. If not, like
anyone else you can put your hand up with the toggle on the bottom of the screen.

Victor Zupa: Yes, Thank you so much for having this important hearing. No, I think this
— I talked to Heather earlier— I think it's clear that this parcel is only transferred to add to
Basin Road and it's not going to be otherwise developed. I talked to her about that
because, the Association, in their application to the Health Department, had mentioned
something like that. So I'm satisfied with everything that you have in here. Oh! The only
other thing is that— again, another long-standing dispute —the basin is actually owned
by the Town of Southold, is acclaimed by the Paradise Point Association but I don't
think we need to get into that now.
Chairman Wilcenski: Okay, I'm a little unclear, what was that comment again?
Victor Zupa: The basin, the body of water adjacent is..
Chairman Wilcenski: Okay, oh, okay. The water itself, we don't need to get into that
now.
Victor Zupa: Yeah, the water itself, we don't need to do it. Okay. Thank you for having
this meeting on this very hot day and in the middle of a pandemic. Thank you.
Mary Zupa: Thank you, this is Mary Zupa. I encouraged my husband to mention about
the boat basin only because Bruce had said that the boat basin, which is owned by the

Paradise Point Association but it's the water that's owned by the Town of Southold.

agricultural site plan is for a proposed 1,600 sq. ft. interior second floor conversion of
an existing storage area to a 10 person capacity Farm Labor camp within an existing 2-
story 10,000 sq. ft. building for agricultural storage and office, no basement, located
within a 5.0 acre reserve area (SCTM#1000-120.-3-11.13) with existing accessory farm
buildings attached to ±34.5 acres of farmland (SCTM#1000-120.-3-11.14) with
Development Rights held by Southold Town in the AC Zoning District. The property is
located at 5645 Aldrich Lane. SCTM#1000-120-3-11.13

Michael Kimack: Well, I think it's pretty straightforward, I want to keep this quick
because I know you're going to be busy tonight. It's just to have up to - 10 of his
laborers basically stay on-site as a labor force, on the second floor existing building. A
portion of the second floor would be converted to that space. We have to submit to the
health department for the septic system but it's pretty straightforward and that it. Do you
have any questions for me that I can answer?

Mary Eisenstein: Yes, hi Mike, Mary Eisenstein here. Was it thought about to have a
new system put in, considering that you're having people coming in living there and
increasing, perhaps, water and sanitary use. Did you consider putting in a new sewage
system?
Michael Kimack: Hi Mary, the sewage system? There is going to be a new system put
in, Mary. The reason is that the existing system there serves the first floor, there is
bathrooms and such on the first floor that they use. The health department requires the
commercial space to be so much gallonage per square footage so the system that is in
place is required for that. We would be proposing to put a new system in for the second
floor. I'm assuming that he same people —for the most part—during the day would most
likely still use the downstairs and the upstairs facilities would be used at nighttime for
showers and whatever during that particular period of time.
Mary Eisenstein: Okay, so Mike, just let me clarify "new system" —the IAOWTS
systems, has that been a consideration to be put in?
Michael Kimack: We didn't consider that— it has an existing standard system now,
Mary, basically, so we were going to put another standard system side-by-side, for the
most part. We didn't think that this particular situation would necessitate going to an
OWTS system. Because you're utilizing the new system when theyre upstairs sleeping,
but—for the most part—you're utilizing the existing system that was approved as a
standard system while they're doing the work during the day. So I can't break down to
you how much is going to be in the existing system and how much would be in the
proposed new system. But we had expected it to be a standard system; we would not
expect it to have to put in an OWTS with this situation.
Mary Eisenstein: Okay, well I think that you know that- you know —that with new
applications, we're looking at people putting in the advanced systems and I'm just
wondering with the increase of people there, the benefit of putting in an IA system.
Michael Kimack: It's not an increase of people; it's the same people that are there
during the day what would be there at nighttime. In a sense — it's an increase of gallage
in terms of usage at nighttime, taking showers, etc. like that. But the same people that
are working during the day that are now utilizing the existing system would simply
utilizing the space at nighttime to sleep and utilizing the new system.
Chairman Wilcenski: To be clear, Mike, the building that they're working in — what
they're using it for now - is it an area where they punch in in the morning and get their
directions for the day. Is that what the building is used for now?
Michael Kimack: Yeah, there is an office area down below over there, etc. like that
and they come in and they utilize that space for the most part, it's a big storage building
for the most part and the upstairs would only be I think roughly 85 by about 20 or
something like that— the area upstairs that would be utilized, there would be sleeping

for 10 on half of it and they're would be a bathroom and a lunch room, etc. like that and
I'm looking at it now, there's also a women's bath too so.
Mary Eisenstein: That point, when you were on a couple of weeks ago and I asked you
about...
Michael Kimack: Whether it was all men or something like that, I'm looking at Mark
Schwartz' drawing and he does show— and I didn't get a breakdown — he does show.
Oh, I'm sorry —there's a women's bath- I apologize for that because there is a women's
bath and a men's bath on the first floor. This would be all for men upstairs — in essence
for this one — I apologize for that. But the first floor has the field manager, the lunch
room, the mechanical room, men's bath, women's bath, the service area, the general
manager and the manager so that's all on the first floor and then above would be this
proposed new space.
Chairman Wilcenski: Okay Mike, I have a quick question: what about water? Do you
have well water? Do you have access to public water?
Michael Kimack: He has well water, I think its's a couple hundred gallons a minute, if I
remember correctly, it was listed over there, the one that he has now.
Chairman Wilcenski: Okay but there are no plans to use public water here.
Michael Kimack: No, not at all. He has more than sufficient water on site. Cause I
asked him- I think I filled out the application- if I remember correctly- it was at least 150-
200 gallons a minute for his well that he's using now and that service is servicing the
whole area and it will service the upstairs too. There is no public water.
Chairman Wilcenski: Okay. While Mike is still up, do any other Planning Board
members have any other questions for Mike?
James H. Rich III: Yeah, I have a question. Do you foresee this as being a year-round
facility or is it somewhat seasonal?
Michael Kimack: It's seasonal, Jim. Basically, I did ask him that question, it was filled
out on the application. It would be, basically run on about April or something like that to
about September/October.
James H. Rich III: So about roughly half of the year.
Michael Kimack: Yeah, maybe 7 moths — about that, basically. In essence, pretty much
his growing season and then he'd shut it down.
James H. Rich III: So the septic load is about 7/12tns — or a little bit more than half of
wat it would be if it was an annual.

Chairman Wilcenski: Aright, does anybody else have any questions for Mike?
