This meeting is public. The Planning Board may add or remove applications from the Agenda upon its discretion, without further notice. Applications may not be heard in the order they appear on this agenda. This public meeting will be held virtually via the Zoom online platform. Pursuant to Executive Order 202.1 of New York Governor Andrew Cuomo in-person access by the public will not be permitted. Motion carries. ` SUBDIVISIONS CONDITIONAL SKETCH PLAN APPROVAL EXTENSION: Vice-Chairman Rich: Tuthill Conservation Subdivision —This proposal is for an 80/60 Conservation Subdivision of four parcels (total area=112 acres) into 17 residential lots, with 94 acres to be preserved. The properties are located on Main Road in Orient in the R-80 and R-200 Zoning Districts. SCTM#'s 1000-17-4-16, 1000-17-6-14.2, 1000- 18-3-30.3 and 1000-18-6-17.3 Pierce Rafferty: WHEREAS, this proposal is for an 80/60 Conservation Subdivision of four parcels SCTM#s1000-17-4-16, 1000-17-6-14.2, 1000-18-3-30.3 and 1000-18-6-17.3 (total area = 112 acres) into 17 residential lots, with 94 acres to be preserved. This project includes the transfer of yield among the four parcels pursuant to §240-42 F of the Southold Town Code. SCTM#1000-18-6-17.3 (South Brown) equals 26.9 acres proposed to be subdivided where Lot 1 equals 0.92 acres. This parcel is located at 2050 Platt Rd (+/- 1,830' south of S.R. 25), Orient. SCTM#1000-27.-1-9 Southold Town Planning Board Public Meeting -August 9. 2021 - Page 4 Martin Sidor: WHEREAS, this proposal is for a Standard Subdivision of a 4.29-acre parcel into two lots where Lot 1 is 2.07 acres and Lot 2 is 2.22 acres located in the R-80 Zoning District; and WHEREAS, on August 5, 2019, the Planning Board granted Conditional Final Plat Approval on the application; and WHEREAS, on January 31, 2020, the applicant requested a 6-month extension of the Conditional Final Plat Approval granted August 5, 2019 and set to expire February 6, 2020 to provide time to receive approval from the Suffolk County Department of Health Services; and WHEREAS, on February 10, 2020, the Planning Board agreed to retroactively extend the Conditional Final Plat Approval from February 6, 2020, to August 6, 2020; and WHEREAS, on August 10, 2020, the Planning Board agreed to retroactively extend,the Conditional Final Plat Approval from August 6, 2020, to February 6, 2021; and WHEREAS, on February 8, 2021, the Planning Board agreed to retroactively extend the Conditional Final Plat Approval from February 6, 2021, to August 9, 2021; and WHEREAS, the agent requested that the Conditional Final Plat Approval be extended an additional six months to provide time to receive approval from the Suffolk County Department of Health Services; and WHEREAS, on August 9, 2021, the Planning Board agreed to extend the Conditional Final Plat Approval from August 9, 2021, to February 6, 2022; therefore be it RESOLVED, that the Southold Town Planning Board hereby extends the Conditional Final Plat Approval upon the plan entitled, "Gonzales Standard Subdivision Final Plat," prepared by John T. Metzger, Land Surveyor, dated April 29, 2015, and last revised July 3, 2019, from August 9, 2021 to February 6, 2022 with the following conditions: 1. Motion carries CONDITIONAL FINAL PLAT DETERMINATION: Vice-Chairman Rich: Fishers Island Weathervane Resubdivision -This resubdivision proposes to transfer 4,617 sq. ft. from Lot 1 (SCTM#1 000-2-1-8.1) to Lot 2 (SCTM#1000-2-1-8.2), and 2,884 sq. ft. from Lot 2 to Lot 1. Lot 1 will decrease from 69,972 sq. ft. to 68,239 sq. ft., and Lot 2 will increase from 72,818 sq. ft. to 74,551 sq. ft. in the R-120 zoning district. Both lots require a variance from the Zoning Board of Appeals to be less than the minimum lot size of 120,000 sq. ft. SCTM#1000-2-1-8.1 & 8.2 Mary Eisenstein: WHEREAS, on March 24, 2021, the applicant submitted a resubdivision application for review by the Southold Town Planning Board; and WHEREAS, this resubdivision proposes to transfer 4,617 sq. ft. from Lot 1 (SCTM#1 000-2-1-8.1) to Lot 2 (SCTM#1000-2-1-8.2), and 2,884 sq. ft. from Lot 2 to Lot 1. Lot 1 will decrease from 69,972 sq. ft. to 68,239 sq. ft., and Lot 2 will increase from 72,818.sq. ft. to 74,551 sq. ft. in the R-120 zoning district. Both lots require a variance from the Zoning Board of Appeals to be less than the minimum lot size of 120,000 sq. ft.; and WHEREAS, at their work session on May 17, 2021, the Southold Town Planning Board found the resubdivision application complete; and WHEREAS, pursuant to §240-56 Waivers of certain provisions, the Southold Town Planning Board shall have the authority to modify or waive, subject to appropriate conditions, any provision of these subdivision regulations, if in its judgment they are not requisite in the interest of the public health, safety and general welfare, except where such authority would be contrary to other ordinances or state law; and WHEREAS, the Southold Town Planning Board has determined that the following provisions of the Southold Town Code §240 Subdivision of Land are not requisite in the interest of the public health, safety and general welfare because this resubdivision does not create any additional residential building lots, and the amount of land being transferred from one lot to the other is small, and therefore are eligible for a waiver: a. Sketch Plat Review; b. Existing Resources Site Analysis Plan (ERSAP); c. Yield Plan; d. Primary & Secondary Conservation Area Plan; e. Preliminary Plat Review; and Southold Town Planning Board Public Meeting —August 9 2021 — Page 6 WHEREAS, on May 25, 2021, the Suffolk County Planning Commission responded that this proposal is a matter for local determination; and WHEREAS, pursuant to the resubdivision policy set by the Planning Board on February 2011, this application is eligible for a decision from the Planning Board prior to receiving approval by the Suffolk County Department of Health Services (SCDHS) as it meets the following criterion set forth in that policy: • Where both lots are already developed; and • Where no new development potential will be created in the parcel to which the land is transferred; and WHEREAS, this application is EXEMPT from review by the Local Waterfront Revitalization Program as no new development potential will come as a result of this resubdivision; and WHEREAS, on June 7, 2021, the public hearing was held; and WHEREAS, on June 17, 2021, the Southold Town Zoning Board of Appeals granted the area variances required; and WHEREAS, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed action is a Type II Action under SEQRA according to 617.5(c)(16) "granting of individual setback and lot line variances and adjustments"; and WHEREAS, on July"26, 2021, at their Work Session, the Planning Board determined that the proposed action meets all the necessary requirements of Town Code §240-57 for a resubdivision application; and WHEREAS, pursuant to Town Code §240-41 concrete monuments to mark the property boundaries are required; therefore be it RESOLVED, that the Southold Town Planning Board has determined that this proposed action, which was incorrectly classified as Unlisted.on June 7, 2021, is a Type If action under SEQRA as described above; Pierce Rafferty: Second. Submit revised Schedules A, B & C for each deed with the revised legal description and illustration of the configuration of the areas to be conveyed 2. The property is located at 850 Maier Place, Southold. SCTM#1000-55-6-37.1 Pierce Rafferty: WHEREAS, this agricultural site plan is for the proposed construction of a 1-story 2,520 sq. ft. building for agricultural storage and no basement, two (2) 96' x 30' greenhouses, a gravel access road located on ±16 acres of farmland in the R-80 Zoning District, Southold; and Southold Town Planninq Board Public Meetinq —August 9 2021 — Page 9 WHEREAS, on March 15, 2021, Charles Southard, authorized agent, submitted incomplete materials for Site Plan Application review and was required to submit to the building department for a Notice of Disapproval; and WHEREAS, on May 27, 2021, Charles Southard, authorized agent, submitted revised site plans and materials for Site Plan Application review; and WHEREAS, on June 7, 2021, the Planning Bound accepted the application as complete for review; and WHEREAS, on June 7, 2021, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that the proposed action is a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5(c)(3) agricultural farm management practices, including construction, maintenance and repair of farm buildings and structures, and land use changes consistent with generally accepted principles of farming; and WHEREAS, on June 7, 2021, pursuant to Southold Town Code §280-131(H), the Southold Town Planning Board waived the requirement for a public hearing regarding this application involving uses strictly related to agriculture (but excepting retail winery operations); and WHEREAS, pursuant to Southold Town Code §280-133(C) and as detailed in work session staff reports on June 7, 2021 and July 26, 2021, the Planning Board waived certain application requirements of§ 280-133 for this application involving uses strictly related to agriculture (but excepting retail winery operations); and WHEREAS, on July 1, 2021, a Notice of Disapproval was issued for the subject application; WHEREAS, on July 1, 2021, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, on July 7, 2021, the Southold Town Code Enforcement officer verified that there were no open violations on the subject parcel; and WHEREAS, on July 8, 2021, the Southold Town Engineer reviewed the proposed application and determined that the certain revisions were required in order for the application to meet the minimum requirements of Chapter 236 for Storm Water Management; and WHEREAS, on July 8, 2021, the Southold Town Fire Inspector stated there were no objections to the proposed site plan; and Southold Town Planning Board Public Meeting —August 9 2021 — Page 10 WHEREAS, on July 9, 2021, the Town of Southold Local Waterfront Revitalization Program Coordinator reviewed the proposed project and determined it to be consistent with the Southold Town LWRP policies; and WHEREAS, on July 19, 2021, the Southold Fire District determined that there was adequate fire protection and access for the proposed action; and WHEREAS, on July 22, 2021, Charles Southard, authorized agent, submitted specification details for the proposed earth floor greenhouses; and WHEREAS, on July 26, 2021, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan Approval of the Town of Southold have been met; and WHEREAS, on July 27; 2021, the Agricultural Advisory Committee provided comments supporting the proposed project for approval; and WHEREAS, on July 27, 2021, the Southold Town Chief Building Inspector reviewed and certified the proposed Agricultural Storage and Greenhouses as permitted uses in the R-80 Zoning District; therefore be it WHEREAS, on August 5, 2021, Charles Southard, authorized agent, submitted revised site plans showing updated exterior lighting and storm water management details; therefore be it RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; Martin Sidor: Second. P1 model exterior lighting specifications sheet Conditions 1. Access to the farm and future retail area from Boisseau Avenue shall be from the access road as shown on the approved site plan. Temporary access over the existing driveway to the south is permitted until the new access driveway is constructed. Any additional formal access points to Boisseau Avenue must be approved by the Planning Board prior to installation; 2. Contact the Office of the Town Engineer at(631)765-1560 prior to installation of any drainage structures to set up an inspection schedule; 3. Martin Sidor: And be it further RESOLVED, that the Southold Town Planning Board approves the Site Plan with conditions, listed below, to the site plan entitled "Murtha Ag Barn" prepared by Nathan Taft Corwin III, L.S., dated March 25, 2020 and last revised April 30, 2021 and authorizes the Chairman to endorse the Site Plan. Conditions 1. All Suffolk County Farmland Committee requirements shall be met as issued October 12, 2017 for Committee Resolution Number FC-33-2017; 2. This site plan was reviewed and approved with no exterior lights. Any future exterior lighting must be approved by the Planning Board by letter prior to installation. 3. Fences a. Fencing as shown on the site plan may be relocated as needed; and, additional fencing may be installed without the need-to amend the Planning Board site plan approval. Prior to installing fencing closer than 100' to the wetlands, a permit or letter of non jurisdiction from the NYS DEC and Southold Town Trustees shall be obtained. d. A buffer* shall be provided between the fences and the wetland boundaries. *Consult the NYS DEC or the local Natural Resources Conservation Service Center for advice on buffer size and composition. 4. Drainage requirements for this small barn and gravel area have been waived. All stormwater runoff must be prevented from entering wetlands and contained within the property. 5. Judy's mother and father, they 6 built in the 50 's and now Otto and Judy are 7 there as well. They just had four 8 generation of family members. My neighbor 9 to the right is the Burn's Family. They 10 are on the third generation of owners. And 11 my other neighbor to the right of them, 12 Ellen, she has been on the creek since 13 1964. So we have very strong roots on 14 Wells Avenue in Southold. All I can say 15 is, I beg of you, please do not let this 16 happen. I walk by the forest every day and 17 I see so many deer and animal -- animals 18 and birds that live there. And if we 19 destroy it, where are they going to go? 20 The deer will come into the neighborhoods 21 to cause more accidents. And the -- 22 someone has to stick up for the wildlife 23 and the animals. That corner, there is 24 already so much traffic. It's almost 25 impossible to turn onto Wells. I don't August 9, 2021 Public Hearing 5 1 know if you were aware of that. They want 2 to put shops, well, there is a lot of other 3 vacant shops in the Town of Southold. In 4 fact, I don't think there has been 5 (Inaudible) . And I really don't think it's 6 necessary to have more shops and apartments 7 to displace these many animals and upset so 8 many of the neighbors. Southold is a 9 historic town. We're proud of that. It is 10 founded in 1640. Why do we want a new 11 building? I mean, it's going to change the 12 whole fiber of our Town to put in a new 13 building and shops there. I understand 14 that the developer developed Feather Hill. 15 I don't think there is one person who I 16 came across that thinks Feather Hill isn.'t 17 an eyesore. On top of that, there is other 18 buildings on Horton that is available. 19 Let's put apartments in there for people. 20 There is quite a few other buildings that 21 he can put shops. During the parades, so 22 many kids and families sit on that berm and 23 enjoy the parade. Enjoy the parades and 24 the different social events. Why do we 25 want to lose that? It's just heartbreaking August 9, 2021 Public Hearing .6 1 to think that such a beautiful forest in 2 the middle of our beautiful town is going 3 to be taken down and removed for these 4 apartments and shops. I beg of you, please 5 for all of the neighbors on Wells and a lot 6 of the .Southold community, nobody wants 7 this. I have talked every -- since we knew 8 about this meeting,, I talked to so many 9 people in this town. And all of them agree 10 that nobody in Southold wants this 11 development. And I realize that the 12 gentleman paid a lot of money for the 13 property, well, my suggestion is. maybe that r 14 the Town of Southold should buy it from 15 him. I know that you guys are looking to 16 redo the Annex Building. Why don't we take 17 that money and purchase a property? And 18 put a couple of benches'there and make it a 19 nice park. And let our animals and our 20 deer and our birds have a place to be able 21 to get away from everyone and to be able to 22 live. Also I think that all of the climate 23 change that is going on, this is the last 24 time we need to be pulling down more trees 25 for God's sake. Please. I think she put 14 it as eloquently as possible. I would just 15 add that I drive up and down Wells all the 16 time turning onto Main Street. It' s a 17 very, very, very tricky intersection. You 18 know, you got the entrance and exit from 19 New York and you also have the two exits 20 and entrances coming up Feather Hill. And 21 if stores and apartments are going to be 22 built where the woods are and extra 23 driveways are added to -- you know, the 24 tenants to drive their cars behind any 25 buildings, it's just going to, you know, August 9, 2021 Public Hearing 8 1 make things much more trickier than they -J 2 already are. You got the Jitney which lets 3 out right on the corner there. Right 4 across from Feather Hill. It's already 5 tricky that intersection and I can't 6 imagine, you know, putting, you know, more 7 stores and many residential apartments 8 there. And again, the deer, they are 9 there. The deer come into the neighborhood 10 a little bit. If their habitat were 11 destroyed, I think it would be very sad. 12 And as the woman mentioned. If they are 13 out and about there could be more 14 accidents. Anyway, my wife and I discussed 15 this and we are very much against building 16 on that corner. Again, 15 this is a Public Hearing for corner of 16 Wells Avenue on Main Road. If anyone 17 wishes to address the Planning Board on 18 this issue? 19 MS. SPACE: I do. My name is Gigi 20 Space. I have been a resident of Southold 21 for nearly 40 years. Previously had lived 22 on Main Bayview Road. And recently moved 23 to Private Road No. 2, which is completely 24 adjacent to this property. Further 25 introduction of myself is that, I was for August 9, -2021 Public Hearing I1 1 nearly 25 years, manager and director of 2 the Quogue Wildlife Refuge in Quogue. And 3 therefore my background is in conservation, 4 habitat, environment and wildlife. And 5 living now for approximately 9 months on 6 the property adjacent to the corner, I have 7 been able to witness not only the movement 8 of wildlife, but exactly how they move. 9 And I just like to review that for you. I 10 have an overhead view, it' s to good enough 11 to really show people here and you. I can 12 give it to you afterwards. But basically 13 what I see with a learned eye is that the 14 Hard Corner property is really a beginning 15 of a watershed. Many of you not know that, 1.6 understandably. I certainly didn't do, 17 because it's behind the Village. It's 18 behind the businesses. When you go down 19 Private Road #2, along that edge, the Wells 20 Avenue, you can see that the property 21 begins to dip maybe about 2/3 of the way 22 south. It does the same thing along my 23 driveway. And that gully that has formed 24 there, it's really quite an extensive 25 watershed. So the watershed would begin on August . 9., 2021 Public Hearing 12 1 Hard Corner property and then it would move r� lu 2 along under my driveway. It's a fairly 3 steep downhill to a freshwater pond. That 4 possibly a few of you know about off of 5 Mechanics Street. So literally to the west 6 of Mechanics Street. So that continues to 7 Mechanics Street and goes into several 8 little wetlands on Mechanics and then 9 continues its way under Young's Avenue to 10 the park there, which a lot of people know 11 as Duck Pond. It's Town Creek Park and the 12 marina there. So the watershed is probably 13 the most thing that I can offer you all to `f 14 take a look at. And that most of the 15 population here would not know about. Also 16 that watershed, has therefore become what 17 some of the other people noted, and that 18 is, it's a great wildlife corridor. So in 19 addition to deer and foxes and raccoons and 20 opossum, all of which I have seen, there is 21 also turtles. And I had heard this from 22 the previous owners, but I witnessed this 23 myself this spring. So there is a whole 24 lot going on. The only addition I can 25 think of at this moment, as far as habitat, August 9, 2021 Public Hearing 13 1 some of you may know Garden Court, which is 2 a very small street that is off of Wells 3 Avenue. It takes a turn and in between 4 Garden Court and my property is a very 5 narrow linear piece that I think maybe 6 Garden Court owns or administers. So that 7 habitat, though it' s narrow, as far as I 8 know, it's there for perpetuity. It's too 9 small to be developed and it's part of 10 other people's administration. Anyhow, 11 that is a further example of how the 12 wildlife corridor is in existence and 13 working well. The water flow is very 14 important. So my final thing to say is a 15 couple of mistakes have been made. I 16 previously lived on Main Bayview. The 17 notice for this hearing went to Main 18 Bayview, bit obviously the Planning Board 19 knew that I had property in. Private Road 20 #2. But I did not get that notice because 21 the new people in my new house didn't pass 22 it on to me. So I only found out about 23 this new hearing at the previous holding on 24 it by the signs. So in that respect, for 25 me alone, I would really like an extension August 9, 2021 Public Hearing 14 1 of this hearing in order for me to collect 2 facts and interesting things that ya 11 3 should know about. And I can't do that 4 because I only found out about this very 5 recently. The other thing is, and I don't 6 mean if it makes a hell of beans, but 7 Private Road #2 is not a driveway on your 8 site map for Hard Corner. It's not a 9 driveway. It's a street. And I may or may 10 not remember the other thing. So that is a 11 significant thing right there. So it's 12 important for the developer to get his 13 facts straight and for the town, and the 14 for the many of other people who have 15 spoken, stand strong with this property in 16 the middle of town and not unlike the south 17 side which is what we don't really want 18 here. Thank you very much. 19 MEMBER RICH: Thank you. At this 20 one of our members has to be excluded, but 21 we will continue with the hearing. Thank 22 you, Mark. 23 Please state your name. 24 RICHARD: Richard (inaudible), 935 25 Wells, which is immediately adjacent to the August 9, 2021 Public Hearing 15 1 property. Around the corner (inaudible) . 2 I think a lot has been said. By way of 3 background, my educational background, 4 (inaudible) mechanical engineer. My 5 training (inaudible) . We have lived there 6 for 13 years. This property has been for 7 sale off and on for as long as I lived 8 here. Clearly there was an access to the 9 front along Main Road, that looks like 10 something could be built here. (Inaudible) 11 you walk through there, the amount of 12 terrain -- I think it slopes up. From west 13 to east. (Inaudible) the amount of 14 drainage. You look at it and see how 15 narrow it is. (Inaudible) it's almost 16 impossible to think about, what you could 17 build and build driveways and safely access 18 (inaudible) . I would just note that the 19 comments that have been made on the 20 watershed, is right. I don't know where 21 the water is going to go. It's hard to 22 track with all the documents. There is 180 23 page PDF. But it looks like a June 3rd 24 annotation from the Town Engineer that the 25 drainage plan is not clear at all. And I August 9, 2021 Public Hearing 16 1 would say that it's not clear. I would say 2 that given how clear some of the other 3 detail is, there is a reason. At the very 4 least, the drainage is such an important 5 part in the development plan. As you move 6 towards the houses there, that is something 7 that should be afforded for public view. 8 Once the plans are available to the . 9 Planning Board. I think that they should 10 be available for public review for public 11 commentary. It's unclear to me from all 12 the documents. There is a lot here that 13 talks about the application being 14 predicated on being over 55 housing. It's 15 not clear what sort of guideline -- what 16 specifically that means. The intention to 17 rent to people over 55, I don't believe is 18 a town concept and has any -- has any teeth 19 beyond it's rant. I could be wrong and so, 20 please correct me if I am -- 21 MEMBER RICH: Just so you know, 22 this is a Public Hearing and we don't 23 answer questions -- and you can give any 24 questions or comments that you have. As we 25 will prepare the SEQRA report, your August 9, 2021 Public Hearing 17 1 questions will be answered in that. So if - 2 you have a question about 55, it will be a 3 line in the SEQRA, will talk about how that 4 is addressed. So we will not sit here and 5 answer questions -- 6 RICHARD: That is fine. So the 7 point that I would like to make for the 8 Board's consideration, will the teeth be 9 there to insure that if -- I realize that 10 my personal preference is that this plan 11 not be approved the way that it's -- we 12 need to review the issues with the terrain 13 and the drainage. In the event that it is 14 approved, littered throughout this 15 application on why there should -- release 16 from the restriction on number of buildings 17 and so on and so forth, it's all predicated 18 that we need housing for over 55. 2 think 19 it would be critical if the Board were to 20 grant the application as-is or less 21 building with a drainage plan, that it's 22 important that has permanent teeth and not 23 later on, people say, we're trying to build 24 housing for seniors. The importance is, if 25 there is going to be any consideration from August 9, 2021 Public Hearing 18 1 the Planning Board, that this is for 55 and 2 over, let's be very clear on what that 3 means and make sure that is deed restricted 4 as opposed to (inaudible) village 5 commercial and do whatever you want. 6 Traffic, it would be hard -- we see people 7 from our window as it sits today. The idea 8 of having those extra driveways, I got a 10 9 year old, when he's riding his bike in 10 those directions, I am sitting there going, 11 I hope it's going to be okay. There is no 12 sidewalk. There is a lot of pedestrian 13 traffic down Wells as well. And you know, 14 I would argue (inaudible) that much more. 15 So I will leave it there. (Inaudible) 16 deficient in the application, is the 17 drainage and the implication of putting all 18 those structures there. I think it's 19 jammed towards the south-end of the 20 property. We are very concerned, 11 this is an excessive development that has 12 not been well thought out as it might had 13 been. Again, we would just second the 14 comments that the people have made and ask 15 that the Board take further submissions and 16 make sure that any approvals be granted 17 with the best interest in the community in 18 mind. Thank you. 19 MEMBER RICH: Thank you, Eli. 20 Next? 21 MR. CHANDLER: Hello. My name is 22 John Chandler. I am a resident on Wells 23 Avenue, 3800. I have lived here for about 24 10 years now. So we're not old timers, but 25 we have been here long enough to appreciate August 9, 2021 Public Hearing 20 1 the town and the way it currently is. And 2 I walked in a little late, so if I am being 3 redundant in some of the things the other 4 people said, I am sorry. But one thing 5 that is kind of concerning to me since we 6 have moved here, is all the available 7 retail space on the Main Road that doesn't 8 seem to get occupied or is occupied 9 briefly. And then, you know, allowed to be 10 empty again. Feather Hill has gotten some 11 of them. So the question is, do we really 12 need more commercial space if it's not 13 going to be filled? And how will we ensure 14 that it happens in such a way that is 15 value. The second point is, you know, the 16 Town really -- it's a charming little town 17 but does not have a center. You know, you 18 just drive through here and the closest 19 thing to a town center is the traffic light 20 at the grocery store. The Town Hall is 21 almost missed by people. And so it' s kind 22 of a shame that it's not more of a Town 23 center and just having another version like 24 Feather Hill to this, is not going to add 25 to that. Make it more like a strip mall. August 9, 2021 Public Hearing 21 r� 1 That to me is a sad way to have the Town l 2 eventually look like, like a lot of the 3 other town's up island. Just no 4 distinction. No center. So those would be 5 the two concerns that I have. And I am not 6 sure how this all occurred. I was not 7 really on top of it. I have certain 8 empathy for the person who has invested the 9 money here. I would just encourage the 10 Planning Board to think how hard how the 11 impact this will have on this traffic. The 12 last thing we want to do is put in a second 13 traffic light just because there is more 14 traffic than they can happen. On a typical 15 weekend now if I am coming back from the 16 grocery store, I try to make a turn onto 17 Wells Avenue, I sometimes have to wait for 18 a half a dozen cars because people are just 19 running through. And so we would like to 20 not have that exacerbated and not have a 21 need for a second traffic light and a third 22 traffic light. You know, to sort of keep 23 the the Town the way that it is. I only 24 hope that we would put some influence on 25 the way that this gets developed. August 9, 2021 Public Hearing 22 1 (Malfunction in Audio. ) 2 UNKNOWN MALE SPEAKER: It's the 3 same road. It's directly adjacent to the 4 property in question on the east. My wife 5 and I have been conning to Southold for a 6 long time. We have four children. Finally 7 we purchased a house last year. So we are 8 new. It seems like (inaudible) been here 9 one year. So we use that as a vacation 10 house now, but eventually we will move here 11 full-time. Hopefully some time soon. And 12 there has been a lot of great points made 13 about the criticism of the proposal. 14 Although for some reason in my mind, I see 15 it as two proposals. I see it as the 16 retail space on Main Road and I see it as 17 the four buildings in the back. I see it 18 as two projects because they don't seem to 19 fit. They don't seem to fit with one 20 another. One has nothing to do with the 21 other. It seems that the developer wanted 22 to build a retail space on Main Road, which 23 has a lot of problems at least -- in my 24 mind, intellectually it makes sense. 25 They're proposing to build these four units August 9, 2021 Public Hearing 23 1 behind the retail space simply because they 2 own the property. The environmental 3 discussion, it's apparent, it's those four 4 buildings that is going to cause the most 5 havoc. They don't below in the Town. They 6 don't belong on Wells Avenue. They don't 7 belong in the very development that they're 8 being built in. And I respect the fact that 9 there is this extra property that this 10 developer is looking to satisfy a need of 11 the Town by creating this housing but 12 reality is, it just doesn't go there. If 13 you look at the Architectural Committee 14 Report in the file, a lot of the 15 suggestions are how to make it look better. 16 The reality is, it can't be made to look 17 better. It just doesn't belong there. Let 18 me just tell you this story. It's going to 19 sound stupid, but I am going to tell it 20 anyway. I woke up and like I do every 21 morning, I went for a walk. I walked the 22 length of the property on -- at the 23 beginning of my walk. It was about 7:30 24 this morning. I walked the length. I see 25 the six deer that are always there on the August 9, 2021 Public Hearing 24 1 property. I know this because they frolic 2 in my front yard a lot but they live there, 3 and migrate as Gigi said. They are there. 4 I took -- I took left turn on Main Road. 5 Took a left turn onto Wells Avenue. And as 6 I was walking down Wells Avenue, I saw a 7 bunny rabbit. Probably (inaudible) always 8 adorable to me, but he was lying on the 9 side of the road. Had just been hit by a 10 car. Lying there. Heartbreaking. I 11 looked at the bunny rabbit. He's alive. 12 He's looking at me. He has these imploring 13 eyes. It was heartbreaking. And \1 14 (inaudible) it would be a crime for these 15 buildings to be built here. I came back 16 later, the bunny rabbit was gone. I am 17 thinking it was stunned by the impact of 18 the car and ran into the woods, so I hope. 19 Anyway, I just wanted to make these points. 20 I appreciate the job -- the difficult job 21 that you guys have to do and I know you 22 will do the right thing for the community. 23 Thank you. 24 MEMBER RICH: Thank you, sir. And it's filled with 13 nature and I enjoy it. And as someone who 14 has just recently purchased, the 2% land 15 tax fee, that is a big chunk of money. We 16 paid it. I ask, if that property came up 17 for sale, how the opportunity was missed? 18 And if it wasn't missed, how come it wasn't 19 selected because it seems like an idea 20 place to invest it. I just wanted to speak 21 because I don't live on Wells. I think I 22 just have as big as interest. I think 23 everybody in the Southold Town does, 24 because we're going to lose some beautiful 25 land. My partner's name 6 is Maryanne Justin. And just like to echo 7 everybody else. We are here 20 years. My 8 (inaudible) since the 50's. We live on 9 Oakland Avenue. We live in a very, very 10 old house. We love this place because it' s 11 the country. I don't like sidewalks. I 12 like being in the country. I don't like 13 extra stop lights. I like being out in the 14 country. I believe that if you continue 15 with this kind of development, we're just 16 going to become east Riverhead. We want to 17 be very, very careful if we want to keep 18 this as the country. And like somebody 19 said, it's a shame. Property rights, this 20 guy has a right to development his property 21 but as was said, maybe the Peconic Land 22 Trust or the Town can step up and purchase 23 this property. Maybe we can find someone 24 with deep pockets that is coming from the 25 south side. That's all I got. Thanks.
