This parcel is located +/- 275' west of Gillette Drive in East Marion. SCTM# 1000-38:-1-1.8 'Mary Eisenstein: WHEREAS; this Standard Subdivision proposes to subdivide 4.24 acres into three 1.2- acre lots in the R-40 Zoning District; and WHEREAS, on September 14, 2020, the Planning Board granted a Conditional Final Plat Approval upon the application; and WHEREAS, on September 15, 2020, the applicant submitted a Draft Bond Estimate in the amount of$182,859.50; and WHEREAS on October 4, 2020, the Southold Town Planning Board accepted the Bond Estimate in the amount of $182,859.50, and the Town Board accepted the estimate on October 5, 2021; and WHEREAS, on June 7, 2021, the applicant submitted performance bond in the form of a Letter of Credit in the amount of$182,859.50; be it therefore RESOLVED, that the Southold Town Planning Board hereby accepts the performance bond for the standard subdivision of Colton Acres in the amount of$182,859.50, and recommends same to the Town Board. Reference the Liber & Page of the filed covenants and restrictions. and WHEREAS, on March 24, 2021, the applicant submitted the Park & Playground Fee in the amount of$14,000; and WHEREAS, on March 24, 2021, the applicant submitted the Administration Fee in the amount of$12,795, which was $1,823.43 over the required amount of$10,971.57; and Southold Town Planning Board Public Meeting -July 12, 2021 - Page 6 WHEREAS, on September 15, 2020, the applicant submitted the Bond Estimate; and WHEREAS, the Planning Board referred the Bond Estimate to the Town Engineer, who responded on September 29, 2020, with a revised amount of$182,859.50; and WHEREAS, on October 5, 2020, the Planning Board approved the Bond Estimate and recommended same to the Town Board; and WHEREAS, on October 20, 2020, the Town Board approved the Bond Estimate in resolution 2020-687; and WHEREAS, on June 7, 2021, the Planning Board approved a resolution to recommend that Lot# 4, the subject property of this subdivision application, be abandoned from the Subdivision Map for Joseph Cherepowich; and WHEREAS, on June 24, 2021, the applicant submitted a Bond/Performance Guarantee in the form of an Irrevocable Standby Letter of Credit from JP Morgan Chase Bank in the amount of$182,859.50 dated June 18, 2021; and WHEREAS, on July 8, 2021, the applicant submitted the requisite paperwork to abandon the lot from the previous subdivision endorsed by the Town Assessor and Town Highway Superintendent; and WHEREAS, on July 12, 2021, the Planning Board accepted the Bond/Performance Guarantee; and WHEREAS, on July 12, 2021, the applicant submitted the requisite number of paper and mylar Final Plats with the Suffolk County Department of Health Services stamp of approval; and WHEREAS, on July 7, 2021, a resolution was submitted to the Town Board to vote on the acceptance of the Bond/Performance Guarantee at their July 13, 2021 meeting; and WHEREAS, on July 9, 2021, the applicant submitted proof of filing of the Planning Board's covenants, recorded on June 10, 2021 by the Suffolk County Clerk in Liber 13108, Page 86, and the requisite number of Final Plats (paper & mylar) with the stamp of the SCDHS; and WHEREAS, all the conditions of the Planning Board's Conditional Final Plat Approval have been met; therefore be it RESOLVED, that the Southold Town Planning Board hereby grants Final Plat Approval upon the map entitled, "Colton Acres", prepared by Barrett, Bonacci &Van Wheele, PC, dated May 1, 2019, and last revised June 11, 2020, and authorizes the Chairman to endorse the Final Plats. SITE PLA'N AP o PLICATIONS T DETERMINATIONS: Chairman Wilcenski: Southold Indian Museum —This site plan is for the proposed construction of fourteen (14) parking stalls and the addition of an ADA compliant lift with new front entry to an existing museum on 1.12 acres in the R-80 Zoning District. The property is located at 1080 Main Bayview Road, Southold. SCTM#1000-70-7-18 Martin Sidor: WHEREAS, this site plan is for the proposed construction of an ADA-compliant parking stall and the addition of an ADA compliant lift with new front entry to an existing museum on 1.1.2 acres in the R-80 Zoning District; and WHEREAS, on February 24, 2021, Anthony Portillo, authorized agent, submitted a site plan application for the proposed construction of fourteen (14) parking stalls and the addition of an ADA compliant lift with new front entry to an existing museum on 1.12 acres in the R-80 Zoning District; and WHEREAS, on March 22, 2021, the Planning Board found the application incomplete for review; and WHEREAS, on March 23, 2021, Anthony Portillo, authorized agent, submitted revised site plans and additional information for review; and WHEREAS, on April 5, 2021, the Planning Board accepted the application as complete for review; and WHEREAS, the Southold Town Planning Board, pursuant to §280-133 C of the Southold Town Code, has the discretion to waive any or all of the requirements in §280- 133 for those applications involving uses strictly related to agriculture as long as they are not necessary to further the objectives set forth in Town Code §280-129 to maintain public health, safety, and welfare. The Planning Board has found that this application is eligible for a waiver of certain elements of the Site Plan requirements because it is an Southold Town Planning Board Public Meeting —July 12, 2021 — Page 8 existing museum building with low usage, the details of which are included in the Staff Report dated April 5, 2021; and WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code §280-1318 (5), has the discretion to vary or waive the parking requirements for Site Plan Applications where doing so would not have a detrimental effect on the public health, safety or general welfare, and will not have the effect of nullifying the intent and provision of the Site Plan Requirements chapter of the Town Code. The Planning Board has found that this application is eligible for a waiver of parking requirements because of its low frequency use and existing grass parking areas with no proposed change; and WHEREAS, on April 5, 2021, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that the proposed action is a Type II Action as it falls within the following description for NYCRR 617.5(c)(7) "construction or expansion of a primary or accessory/appurtenant, non-residential structure or facility involving less than 4,000 square feet of gross floor area and not involving a change in zoning or a use variance and consistent with local land use controls,...; and WHEREAS, the proposed action is exempt from review by the Suffolk County Planning Commission (SCPC); and WHEREAS, on May 3, 2021, a Public Hearing was held and closed; and WHEREAS, following the public hearing and reassessment of the proposal, the applicant significantly reduced the proposed action on site to be consistent with their original intent of a single ADA compliant parking stall with new lift access an existing main entry; and WHEREAS, on May 20, 2021, Anthony Portillo, authorized agent, submitted revised site plans for review; and WHEREAS, on June 7, 2021, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan Approval of the Town of Southold, have been met; therefore be it RESOLVED, that the Southold Town Planning Board hereby waives certain Site Plan Application requirements as noted above; Mary Eisenstein: Second. A use certification by the Southold Town Chief Building Inspector or an indication that such certification is not necessary in this instance. 2. No exterior lights were reviewed or approved in connection with this site plan. Chairman Wilcenski: Indian Neck Farm Amended —This amended agricultural site plan application is for the proposed construction of a curb cut for access to Skunk Lane and the closure of an existing curb cut to Indian Neck Lane, for an existing farm comprising of four parcels totaling +132 acres with over 20,000 sq. ft. of existing buildings in the AC Zoning District. The property is located at 3595 Skunk Lane and 4170 Indian Neck Lane, Peconic. SCTM#1000-97.-9-12 & 10.4 and SCTM#1000-98-1- 2.1 & 27.1 Mary Eisenstein: WHEREAS, this site plan application is to amend the site plan approved by the Planning Board on June 6, 2011 under the name "Indian Neck Farm" by adding a new 12' wide access to Skunk Lane for the farm which is comprised of four parcels totaling +/-132 acres with over 20,000 sq. ft. of existing buildings in the AC Zoning District. The property is located at 3595 Skunk Lane and 4170 Indian Neck Lane; and WHEREAS, on August 5, 2020, Ernest Scalamandre, owner, submitted an amended application for Site Plan review; and WHEREAS, on August 14, 2020, the Planning Board found the application incomplete for review; and WHEREAS, on February 24, 2021, Martin Finnegan, authorized agent, submitted revised.site plans and additional information for review; and WHEREAS, the Southold Town Planning Board, pursuant to §280-133 C of the Southold Town Code, has the discretion to waive any or all of the requirements in §280- 133 for those applications involving uses strictly related to agriculture as long as they are not necessary to further the objectives set forth in Town Code §280-129 to maintain public health, safety, and welfare. The action is for the construction of a 12' wide access road for the farm to Skunk Lane; and WHEREAS, on March 23, 2021, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, the proposed action is exempt from review by the Suffolk County Planning Commission (SCPC); and WHEREAS, on April 5, 2021, the Southold Town Fire Inspector reviewed and determined that there was adequate fire protection and emergency access for the site after requiring revisions to the site plan; and WHEREAS, on April 5, 2021, a Public Hearing was held and closed; and WHEREAS, on April 5, 2021, the Town of Southold LWRP Coordinator reviewed the above-referenced project and has determined the proposed project to be consistent with Southold Town LWRP policies; and WHEREAS, on April 8, 2021, the Southold Town Engineer reviewed the above- referenced application and has determined that the proposed building and site meet the minimum requirements of Chapter 236 for Storm Water Management; and WHEREAS, on April 22, 2021, the Cutchogue Fire District determined there was adequate fire protection for the site with verification of certain parameters (free and clear access, load bearing surface); and WHEREAS, on May 17, 2021, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan Approval of the Town of Southold, have been met; therefore be it RESOLVED, that the Southold Town Planning Board hereby waives certain Site Plan Application requirements as noted above; James H. Rich III: WHEREAS, this site plan is for the proposed conversion of an existing 770 sq. ft. accessory apartment to a principle office structure, no footprint expansion or basement, with four (4) parking stalls on 0.23 acres in the Hamlet Business Zoning District, Mattituck; and WHEREAS, on August 4, 2020, the Southold Town Board issued Moratorium Waiver Reso#2020-470 for the subject parcel and site plan application; and WHEREAS, on September 30, 2020, Stephen Kiely, authorized agent, submitted materials for the Site Plan Application review; and WHEREAS, on October 19, 2020, the Planning Board found the application incomplete for review; and WHEREAS, on January 5, 2021, Stephen Kiely, authorized agent, submitted revised site plans and additional materials for Site Plan Application review; and WHEREAS, on January 11, 2021, the Planning Bound accepted the application as complete for review and waived certain application requirements pursuant to 280-133 for this existing site/building as also detailed at the October 19, 2020 work session; and WHEREAS, on January 11, 2021, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that the proposed action is a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5(c)(2) ". . . replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire codes; and WHEREAS, on February 8, 2021, a Public Hearing was held and closed; and WHEREAS, on February 12, 2021, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, on February 18, 2021, the Southold Town Engineer reviewed the proposed application and determined that the certain revisions were required in order for the application to meet the minimum requirements of Chapter 236 for Storm Water Management and these changes were made to the plan; and WHEREAS, on February 24, 2021, the Southold Town Code Enforcement officer verified that there were no open violations on the subject parcel; and . WHEREAS, on February 24, 2021, the Southold Town Fire Inspector reviewed and determined that there was adequate fire protection and emergency access for the site; and Southold Town Planning Board Public Meeting —July 12, 2021 — Page 14 WHEREAS, the proposed action is not subject to the review of the Suffolk County Planning Commission (SCPC) because it proposes less than 5,OOOsf of new or renovated floor area; and WHEREAS, on February 24, 2021, the Southold Town Planning Board received a request.from the applicant to conduct work on site, electrical service installation to existing building, prior to site plan approval; and WHEREAS, on March 8, 2021, the Planning Board permitted the electrical service connection as requested to be completed on site prior to site plan approval; and WHEREAS, on March 11, 2021, the Town of Southold Local Waterfront Revitalization Program Coordinator reviewed the proposed project and determined it to be consistent with the Southold Town LWRP policies with certain recommendations to be considered; and WHEREAS, on April 5, 2021, the Southold Town Planning Board reviewed the proposed site plan application and required certain revisions to the plan and additional information; and WHEREAS, on May 27, 2021, Stephen Kiely, authorized agent, submitted revised site plans for review; and WHEREAS, at their June 7, 2021 work session, the Southold Town Planning Board reviewed revised site plans and required revisions to the site plan; and WHEREAS, on July 7, 2021, the Southold Town Chief Building Inspector reviewed and certified the proposed Business Office as.a permitted use in the Hamlet Business (HB) Zoning District; and WHEREAS, the applicant coordinated with staff between June 7, 2021 and July 9, 2021 to provide final site plans for the subject site; and WHEREAS, on July 12, 2021, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan Approval of the Town of Southold have been met; therefore be it RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; Martin Sidor: Second. Conditions 1. This site plan is for a private office only, not open to the public and not to be used as a residence. 2. Any change in use from a private office must be reviewed and approved by the Planning Board, and an upgrade to the sanitary system from the existing cesspools to an approved I/A OWTS system must be considered. 3. To mitigate the visual mass of the adjacent building's wall (to the northeast), plant two 5-6' tall evergreens five feet from each end of the adjacent building's wall and seven feet apart from each other. a.
