SUBDIVISIONS d STATE ENVIRONMENTAL QUALITY REVIEW ACT RE-CLASSIFICATION: Chairman Wilcenski: Colusa North Conservation Subdivision —This proposal is for an 80/60 Conservation Subdivision of 66.2 acres into 11 residential lots ranging in size from 0.8 acres to 2 acres with a private road (2.5 acres), and an agricultural lot of 51.26 acres, from which development rights are proposed to be sold to the Town of Southold in the AC and R-80 zoning districts. The property is located at 7750 Bridge Lane, Cutchogue. SCTM#1000-84-2-1.1, 3.3, 3.4 Pierce Rafferty: WHEREAS, this proposal is for an 80/60 Conservation Subdivision of 66.2 acres into 11 residential lots ranging in size from 0.8 acres to 2 acres with a private road (2.5 acres), and an agricultural lot of 51.26 acres, from which development rights are proposed to be sold to the Town of Southold in the AC and R-80 zoning districts; and WHEREAS, on January 11, 2021, the Planning Board classified this action as an Unlisted action pursuant to SEQRA; and WHEREAS, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Section 617.4(b)(8): "any Unlisted action that includes a nonagricultural use occurring wholly or partially within an agricultural district (certified pursuant to Agriculture and Markets Law, article 25-AA, sections 303 and 304) and exceeds 25 percent of any threshold established in.this section" is to be classified as a Type I Action; and WHEREAS, SEQRA 6 NYCRR, Section 617.4 (b)(6)(i) establishes the following threshold "a project or action that involves the physical alteration of 10 acres"; and WHEREAS, the proposed action includes a nonagricultural use (residential) occurring within an agricultural district, and exceeds 25 percent of the 10 acre threshold for physically altering land (2.5-acre road plus 11 new homes); be it therefore RESOLVED, that the Southold Town Planning Board has determined that.this proposed action is a Type I Action under SEQRA as described above. CONDITIONAL FINAL PLAT APPROVAL EXTENSION: Chairman Wilcenski: Baxter, William J., Jr. - This proposal is a Standard Subdivision of a 2.38 acre parcel into 4 lots where Lot 1 = 0.62 acres, Lot 2 = 0.63 acres, Lot 3 = 0.62 acres and Lot 4 = 0.52 acres, in the Hamlet Business Zoning District. The property is located at 260 Griffing Street, on the northeast side of Griffing Street, +/- 402' west of SR 25, in Cutchogue. SCTM#1000-102-5-9.4 James H. Rich III: WHEREAS, this proposed Standard Subdivision is to subdivide a 2.38 acre parcel into 4 lots where Lot 1 equals 0.62 acres, Lot 2 equals 0.63 acres, Lot 3 equals 0.62 acres and Lot 4 equals 0.52 acre; and WHEREAS, on October 5, 2020, the Planning Board granted Final Plat Approval upon the map prepared by Nathan Taft Corwin, III, Land Surveyor, entitled "Final Plat Subdivision for William J. Baxter, Jr. situated at Cutchogue," dated September 17, 1998 and last revised November 22, 2015; and WHEREAS, the applicant has requested an extension of the Conditional Final Plat Approval to allow more time to obtain approval from the Suffolk County Department of Health Services; therefore be it RESOLVED that the Southold Town Planning Board hereby extends the Conditional Final Plat Approval for an additional six months (until October 4, 2021). CONDITIONAL FINAL PLAT DETERMINATION: Chairman Wilcenski: Liebert Standard Subdivision —This proposal is for the standard subdivision of a 2.43-acre parcel into two lots, where Lot 1 equals 54,134 sq. ft. and Lot 2 equals 54,134 sq. ft. in the R-40 Zoning District. This parcel is located at 6510 Horton Lane (+/- 100' southeast of the intersection of Jennings Road and Hortons Lane), Southold. SCTM#1000- 54.-3-14.8 Martin Sidor: WHEREAS, this proposal is for the standard subdivision of a 2.43-acre vacant lot into two lots, where Lot 1 equals 54,134 sq. ft. and Lot 2 equals 54,134 sq. ft. in the R-40 Zoning District; and WHEREAS, on April 12, 2018, the agent submitted a Sketch Plan application; and WHEREAS, on May 7, 2018, the Sketch Plan application was found incomplete and additional materials were required; and WHEREAS, on September 21, 2018, the applicant submitted a request to clear and build on the site prior to Final Approval from the Planning Board, which included a plan showing the cleared area on the site and the building plans; and WHEREAS, on September 27, 2018, the Planning Board sent the applicant a letter requesting that additional dimensions be added to the plan to ensure the subdivision design would not be hindered by the location of the proposed house on Lot 1; WHEREAS, on October 15, 2018, the applicant submitted a revised plan; and WHEREAS, on October 22, 2018, the Planning Board decided to allow the applicant to clear and build on Lot 1 prior to Final Approval by the Planning Board contingent upon the following conditions: 1. The driveway to access Lots 1 &2 must be designed as a common driveway; 2. Apply for approval from the Suffolk County Department of Health Services (SCDHS) Office of Wastewater Management for an Innovative Alternative On- Site Wastewater Treatment System (I/A OWTS) for the proposed house on Lot 1; 3. There will be no further clearing allowed beyond what is shown on the plan that was submitted on October 15, 2018 until the Planning Board has approved the Final Plat and the map has been filed and all necessary permits have been Southold Town Planning Board Public Meeting —April 5, 2021 — Page 5 obtained. The only exception will be the clearing necessary to move the driveway to meet the common driveway requirement; and WHEREAS, on January 7, 2019, the applicant submitted a revised Sketch Plan; and WHEREAS, on January 25, 2019, the applicant submitted proof of application for an Innovative Alternative On-Site Wastewater Treatment System (I/A OWTS) for the proposed house on Lot 1; and WHEREAS, on January 28, 2019, the Planning Board found the Sketch Plan application complete; and WHEREAS, on February 11, 2019, the Planning Board granted a Conditional Sketch Plan Approval upon the application; and WHEREAS, on April 1, 2019, the applicant submitted a Preliminary Plat application and fee where the common driveway was shown as 20'; and WHEREAS, on April 17, 2019, the agent was notified on that a 25' common driveway would be required in accordance to the Town Code §240-45 Common driveways; and WHEREAS, on May 7, 2019, the agent submitted a plan inclusive of a 25' common driveway; and WHEREAS, on May 20, 2019, the Planning Board found the Preliminary Plat application incomplete and required the applicant to submit a report from the project engineer that determined if a DEC SWPPP would be required for the subdivision; and WHEREAS, on June 3, 2019, the applicant's agent submitted a report from Douglas Adams, PE, which indicated that a DEC SWPPP will not be required for this application; and WHEREAS, on June 17, 2019, the Planning Board found the Preliminary'Plat application complete at their work session; and WHEREAS, on July 8, 2019, the Planning Board determined that this proposed action is an Unlisted Action under SEQRA and set the Public Hearing for August 5, 2019; and WHEREAS, on August 5, 2019, the Public Hearing was held and closed; and WHEREAS, on August 6, 2019, the application was referred to the Local Waterfront Revitalization Program, Suffolk County Planning Commission, and all other involved and interested agencies; and WHEREAS, on September 11, 2019, the LWRP coordinator responded that this application was found consistent with the policies of LWRP; and Southold Town Planninq Board Public Meeting —April 5, 2021 — Page 6 WHEREAS, on September 17, 2019, the Suffolk County Planning Commission responded that this matter should be considered for local determination; and WHEREAS, on October 21, 201'9, at their work session, the Planning Board reviewed the Public Hearing comments and the comments returned from the applicable and involved agencies, and all applicable comments were incorporated into the application to the satisfaction of the Planning Board; and WHEREAS, the Planning Board, as Lead Agency, performed a coordinated review of this Unlisted Action pursuant to 6 NYCRR Part 617, Section 617.7 of the State Environmental Quality Review Act (SEQRA); and WHEREAS, at their public meeting on November 7, 2019, the Planning Board .determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; and WHEREAS, at their public meeting on November 7, 2019, the Planning Board, pursuant to SEQRA, made a determination of non-significance for the proposed action and granted a Negative Declaration; and WHERAS, at their public meeting on November 7, 2019, the Planning.Board granted Conditional Preliminary Plat Approval; and WHEREAS, on July 10, 2020, the applicant's agent submitted the Final Plat Application; and WHEREAS, at their work session on August 10, 2020, the Planning Board found the Final Plat application complete and agreed to waive the Final Plat public hearing; and WHEREAS, at their work session on August 10, 2020, the Planning Board also found the proposed subdivision plat presents a proper case for requiring a park for recreational purposes, but that a suitable park cannot be properly located on this site, and that the Planning Board will require $7,000 in lieu thereof, pursuant to 240-53 G Reservation of Parkland of the Southold Town Code; and WHEREAS, at their work sessions on February 22, 2021 and March 8, 2021, the Planning Board reviewed the Final Plat application and found that it is in compliance with the requirements of§240 Subdivision of land, of the Town Code; be it therefore RESOLVED, that the Southold Town Planning Board grants a Conditional Final Plat Approval upon the map entitled, "Liebert Standard Subdivision Final Plat" prepared by John Metzger, Land Surveyor, dated September 2, 1993, last revised May 26, 2020, with the following conditions: 1. Submit a professional engineer's drawing of the driveway on a separate "Common Driveway Plan" to include the exact location, dimensions and grade of the common driveway and specifications for its composition, as well as Southold Town Planning Board Public Meeting —April 5, 2021 — Page 7 drainage for review by the Town Engineer for compliance with Chapter 236 Stormwater Pollution Prevention. a. include the existing driveway in this plan to show how it complies with Chapter 236 and connects to the common driveway in its required location. 2. In lieu of a performance bond for certain required improvements, the following is required: a. Prior to Final Plat Approval i. property monuments to be installed ii. common driveway and associated drainage to be installed according to the approved Common Driveway Plan b. Prior to construction of a dwelling on Lot 2 (to be included in the covenants): i. Plant the evergreen buffer along the driveway to Lot 2 3. Revise the Final Plat as follows: a. Replace the Proposed House with the existing house.on Lot 1. b. Lot Area Notations: • Remove the notation "Flag Area" from within Lots 1 & 2 • Remove the notations Total Lot Area and Lot Area from within each lot. i. These areas are listed elsewhere on the plan c. Show the current extent of clearing on Lot 1 and provide the amount in square feet, excluding the flag area, in a note on the Final Plat. d. Remove the Proposed Driveway. This Proposed Driveway does not meet the requirements of the common driveway, which must be centered within the 25' common driveway access. A separate Common Driveway Plan must be provided as described in item 1 above. • The existing driveway must be shown to connect to the Common Driveway in its required location. e. Remove the notations "Proposed lot line" (unnecessary on Final Plat). Southold Town Planning Board Public Meeting —April 5, 2021 — Page 8 f. Make all proposed and existing lot lines of the subject property the same weight and type of solid line. g. Remove the building setback lines. h. Remove the dotted lines at each flag's beginning within Lots 1 and 2. i. The common driveway area is cluttered with notations and difficult to follow. Removing the notations as noted above will improve the clarity. A smaller font for the metes and bounds will also help. j. Remove the two "Detail' drawings from the Final Plat. Use the separate Common Driveway Plan referenced in item 1 above to provide the necessary details. k. Clarify the Key: i, Distinguish between existing monuments and those proposed (provide a different symbol or provide an explanation of the notation "CMF" in the Key) ii. Replace the "Pipe" at the eastern corner of proposed Lot 2 with a monument. 4. Submit the Administration Fee of$4,000.00 5. Submit the Park & Playground fee of$7,000.00 6. File the Covenants and Restrictions as drafted and agreed upon by the Planning Board at their February 22, 2021 work session, with any amendments to be considered at a future work session after the revised Final Plat is submitted. Southold Town Planninq Board Public Meeting —April 5 2021 — Page 9 EXTENSION OF TIME TO RENDER A FINAL PLAT DETERMINATION: Chairman Wilcenski: Harold R. Reeve & Sons, Inc._—This proposal is for a Standard Subdivision of a 5.1 acre split-zoned parcel into 4 lots where Lots 1-3 equal 1 acre each in the R-40 Zoning District and Lot 4 equals 1.9 acres located in the LB Zoning District. The property is located at 1605 Wickham Avenue, on the n/s/o County Road 48, approximately 1 90' w/o Wickham Avenue, in Mattituck. SCTM#1000-140-1-6 Mary Eisenstein: WHEREAS, this proposal is for a Standard Subdivision of a 5.1 acre split-zoned parcel into 4 lots where Lots 1-3 equal 1 acre each in the R-40 Zoning District and Lot 4 equals 1.8 acres located in both the R-40 and LB Zoning Districts; and WHEREAS, on August 5, 2019 the Southold Town Planning Board granted Conditional Preliminary Plat Approval upon the map prepared by Howard W. Young, Land Surveyor, entitled "Subdivision Map of Harold R. Reeve and Sons, Inc.", dated January 8, 2015 and last revised May 24, 2019 and approval on the Preliminary Road and Drainage Plans last revised May 24, 2019; and WHEREAS, on February 10, 2020, a Final Plat Public Hearing was held and closed; and WHEREAS, the Southold Planning Board, pursuant to the Southold Town Code, has 62 days to'render a Final Plat Determination after the Final Plat Public Hearing is closed unless a mutual agreement is reached; and WHEREAS, due to the COVID-19 Pandemic and Town of Southold State of Emergency in response to the pandemic, the 62-day timeframe expired on April 12, 2020, and WHEREAS, Southold Planning Board and the applicant have mutually agreed to extend the timeframe to render a Final Plat determination from April 5, 2021 to October 5, 2021; therefore be it RESOLVED, that the timeframe to render a decision on the Final Plat is hereby mutually extended from April 5, 2021 to October 5, 2021. SET HEARING: Chairman Wilcenski: Schreiber Minor Subdivision This proposal is to amend the covenants from this four-lot subdivision approved in 2004. The amendments clarify the ownership and maintenance responsibilities for the private road that will access three lots from Oregon Road. The road has not yet been constructed, nor have the three lots been developed. The property is located on the north side of Oregon Road, west of Alvah's Lane in Mattituck in the R-80 zoning district. SCTM#1000-95-1-4.2 through 4.4, and 1000-82-2-1 & 2. Pierce Rafferty: WHEREAS, this subdivision was approved by the Planning Board February 9, 2004; and WHEREAS, a road declaration describing the proposed road to Lots 1, 2 & 3 and the maintenance responsibilities for said road were filed in Liber 12293, Page 513; and WHEREAS, on January 25, 2021, the landowner's attorney requested that the covenants be amended to clarify and address some incorrect information; and WHEREAS, clause # 5 in the aforementioned covenants requires a majority plus one vote of the Planning Board after a public hearing for any amendments; and WHEREAS, at their work session on March 22, 2021, the Planning Board agreed to set a hearing to consider amendments to the covenants; therefore be it RESOLVED, that the Southold Town Planning Board sets Monday, May 3, 2021 at 6:01 p.m. for a Public Hearing regarding the amendments to the covenants for the Schreiber, Robert Minor Subdivision. The property is located at 1080 Main Bayview Road, Southold. The property is located at 53530 Route 25, Southold. SCTM#1000-61-4-1 James H. Rich III: WHEREAS, This site plan is for the proposed mixed use construction of a 2-story 7,812 gross sq. ft. building fronting NYS Route 25 with 4,983 sq. ft. of retail on the first floor and three (3) affordable housing apartments totaling 2,829 gross sq. ft. on the second floor and 30 parking stalls; and four (4) 1,597 sq. ft. residential rental units (reserved for 55 and older) along Wells Avenue, all on 2.28 acres in the Hamlet Business (HB) Zoning District; and WHEREAS, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed action is an Unlisted Action as it does not meet any of the thresholds of a Type I Action, nor does it meet any of the criteria on the Type II list of actions; be it therefore RESOLVED, that the Southold Town Planning Board has determined that this proposed action is an Unlisted Action under SEQRA as described above; Martin Sidor: Second. STATE ENVIRONMENTAL QUALITY REVIEW ACT - ADOPT AMENDED FINAL SCOPE: Vice- Chairman Rich: Strong's Storage Buildings'—This Site Plan is for the proposed construction of two (2) buildings for boat storage, one at 52,500 sq. ft. and the other at 49,000 sq. ft., located on 32.6 acres in the MII and R-80 Zoning Districts where there are 69,245 sq. ft. of existing boatyard buildings. The property is located at 3430 Mill Road, Mattituck. SCTM#1000-106-6-13.4 Martin Sidor: WHEREAS, this site plan is for the proposed construction of two (2) buildings for boat storage, one at 52,500 sq. ft. and the other at 49,000 sq. ft., located on 32.6 acres in the MII and R-80 Zoning Districts where there are 69,245 sq.-ft. of existing boatyard buildings; and WHEREAS, on February 10, 2020 the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617, determined that the proposed action is a Type I action pursuant to 617.4(b)(10): Any Unlisted action, that exceeds 25 percent of any threshold in this section, occurring wholly or partially within or substantially contiguous to any publicly owned or operated parkland, recreation area or designated open space, including any site on the Register of National Natural Landmarks pursuant to 36 CFR Part 62, 1994 [see 617.17]. The physical alteration of 3.74 acres exceeds 25% of the 10 acre threshold listed in 617.4(b)(6); and WHEREAS, on August 10. 2020 the Southold Town Planning Board declared itself as Lead Agency and issued a Positive Declaration for the action; and WHEREAS, on September 11, 2020 the applicant submitted a Draft Scope prepared by P.W. Grosser Consulting Inc.; and WHEREAS, pursuant to the Regulations of the State of New York Title 6 Department of Environmental Conservation Chapter VI General Regulations Part 617 State Environmental Quality Review the Planning Board held a public hearing on the Draft Scope on November 2, 2020; and WHEREAS, on November 16, 2020 the public comments received to date were discussed at a Planning Board work session; the public comment period was held open until December 7, 2020 and additional written comments were received; and Southold Town Planning Board Public Meeting —April 5, 2021 — Page 14 WHEREAS, The Planning Board, as Lead Agency, included in this Final Scope all rationale, reasoning, comments and elements necessary to thoroughly analyze all identified potential adverse environmental impacts of the proposed project; and WHEREAS, certain clarifications and corrections were agreed to by the Planning Board at the applicant's request; therefore be it RESOLVED, that the Southold Town Planning Board adopts the Amended Final Scope for Strong's Yacht Center Proposed Boat Storage Buildings dated April 5, 2021. Thanks Donald. So yes, my 25 presentation is brief. As you know, we had April 5, 2021 Public Hearings 4 1 actually requested a waiver of this hearing 2 in light of the fact that this is quite 3 simply a curb-cut for a driveway to connect 4 an existing farm road in an existing farm 5 operation. There is really not a whole lot 6 to it. This is, as you know, Indian Neck 7 Farm has been around for a long time. It' s 8 been designated as an organic farm. And in 9 conjunction with its ongoing operations, 10 this access is necessary. So we have seen 11 some of the comments, and do not agree that 12 there would be any impact on traffic on 13 Skunk Lane. The issues on Skunk Lane are 14 totally unrelated to this farm operation. 15 It is quite simply going to be a limited 16 occasional access by this driveway to the 17 farm to connect -- as I said to the 18 existing farm road that is on this parcel 19 #12. So that is really it. There is not a 20 whole lot to talk about here. It's a farm 21 road. It's a driveway to a farm. I don't 22 know what we really need to site plan. 23 CHAIRMAN WILCENSKI: Thank you, 24 Martin, for your comments. Do I have my -- is my video on the (� 13 screen? 1 14 MS. MICHAELIS: No, it's not. 15 MS. FAR: Okay.. I did submit 16 comments. With all do respect, I don't 17 agree with Mr. Finnegan in his analysis of 18 the situation. This -- where the -- No. 1, 19 the proposal from my understanding is to 20 make a cut on Skunk Lane and get rid of a 21 cut on Indian Neck Road. So we're not 22 talking about adding an access that would 23 supplement the existing access. It sounds 24 to me like this would be the only access to 25 the farm for the farm workers. And that's April 5, 2021 Public Hearings 6 1 a whole lot different than just adding 2 access. Okay. Secondly, in my letter I 3 raised several concerns relating to 4 traffic. In addition to traffic, an impact 5 on the peace and quiet of the neighborhood, 6 property values of the immediate neighbors 7 on either side and across the street from 8 this proposed roadway. And also impact on 9 the wildlife, because this corridor right 10 here is now -- in light of the installation 11 of the deer fencing around the perimeter of 12 Indian Neck Farm, it forces all of the 13 wildlife to come through the corridor of 14 the yards that are in between the farm and 15 the eastern side of Skunk Lane. And in 16 addition to that, it' s going to create an 17 interruption of the traffic flow because 18 cars are going to be pulling in and out of 19 that access. It's on a curve. It's 20 already limited visibility. Already is 21 difficult for people who are hiking through 22 -- walking and jogging and the berm on the 23 road is very skinny. Cars are going too 24 fast. For whatever reason, the speed limit 25 hasn't been enforced. And it's going to April 5, 2021 Public Hearings 7 1 create a visual and noise issue for the - 2 adjacent property owners on either side of 3 what is presently a wooden thicket. Plus 4 for me personally, I am the property who is 5 immediately north of the proposed access 6 road. It's going to impact me the road in 7 front,, the driveway on the side of my 8 property and then behind me because it will 9 create the traffic -- it's about a mile 10 away to get to all the farm buildings. And 11 so I am going to be hearing the vehicles -- 12 higher way -- in line of site and audio, to 13 what had previously been a very -- it f 14 interrupts the character of the 15 neighborhood as a quiet community. So I 16 you know, am raising these concerns and I 17 am asking you to consider them. And 18 lastly, I would -- I have some questions 19 about why this particular option on 20 installing the road here whether that is 21 the only option that is available. In 22 looking at the maps that I was sent in the 23 mail, specifically this one is numbered 24 098, it appears to me that there's -- 25 Indian Neck Farm has property that is �� 1 April 5, 2021 Public Hearings 8 1 adjacent to Leslie's Road. And it looks 2 like a nice -- a pretty big parcel that 3 abuts Leslie Road. Kind of like right into 4 the middle of the farm. And .now I would 5 like to ask the owner to consider that as a 6 possible alternative which would avoid, I 7 think, a number of the issues that I am 8 raising and that I know are of concern to 9 some of my neighbors as well. That Leslie 10 Road is a straight away road. You know, 11 the traffic flow in this particular area is 12 that people coming from west, will come 13 down Eugene' s Lane. And coming from the 14 east, come down Indian Neck. And then they 15 kind of -- if they are presently going all 16 the way down to Indian Neck to get into the 17 farm, that traffic flow if it was made to 18 come to Skunk Lane, all the traffic is 19 going to come now down below, Leslie to in 20 front of the houses in between Leslie and 21 the curb-cut. (Audio went silent) . 22 Convenient access to the farm buildings 23 because the farm buildings are all the way 24 down on the Indian Neck Side of the 25 property. They are not on the Skunk 'Lane April 5, 2021 Public Hearings 9 1 side of the property. I think it would be 2 convenient -- more convenient actually for 3 the workers. And I would -- I would like 4 to propose that as an alternative to the 5 cut coming out on Skunk Lane. 6 CHAIRMAN WILCENSKI: Thank you for 7 your comments. But I do agree with the previous 23 resident on Skunk Lane with a lot of her 24 points. My wife and I walk Skunk Lane to 25 the Bay daily. And it is quite fast to April 5, 2021 Public Hearings 12 1 begin with. That particular area where the 2 curb-cut is proposed, is -- it is a little 3 high and slightly around a curb. And I 4 would be concerned walking there if farm 5 vehicles or commercial vehicles are pulling 6 in and out of some type of a driveway. 7 Residents tend to pull out of their 8 driveways cautiously. You know, I am not 9 so sure if how farm vehicles do, would pull 10 out or not. But other than that, that was 11 all that I had, sir. 12 CHAIRMAN WILCENSKI: Okay. And I April 5, 2021 Public Hearings 13 1 just want to thank the two other people who 2 spoke. They really brought up most of the 3 things that -- all of the things that my 4 family is concerned with. And changing are 5 life experience in our backyard in total 6 honesty. And that's a personal thing, I 7 know. Along the lines of that, if this 8 were to go through which, I hope that you 9 consider it doesn't, we would ask that a 10 condition is placed actually more 11 vegetation and an actual visual barrier 12 needs to be put in place. These two -- I 13 call them apron things going down to Skunk 14 Lane around us have already been cleared. 15 quite a bit. And it has already changed 16 the community. And we can now see Barbara 17 Far's house, where we used to not be able 18 to see her house. So I would request a 19 condition, if this goes through, replanting 20 more visual plants. So the natural barrier 21 is increased again. And yeah, I agree with 22 the question that Mr. Medaglia had about 23 why is this necessary? What is wrong with 24 the working to the farm? I guess we are 25 not privy to that. And you know, I 13 really feel that we should not be getting 14 in speculative issues that are not relevant 15 here. we are amending the application to 16 limit the access to this one side of the 17 property. Quite honestly, we could put a 18 house here and put a driveway and I believe 19 there would be more traffic trips in and 20 out of a residential driveway than there 21 would be out of, this proposed access. It ' s 22 a farm that would be limited times of the 23 year when this access is used. And it's 24 necessary for the farm operation. And that 25 is the point that I want to make right now. The existing house. 21 It's being split from the farm. There is 22 no change or proposed subdivision of the 23 farm. It's only this particular lot. The 24 right-of-way, the driveway, which is 25 existing and has been since the day the April 5, 2021 Public Hearings 30 1 house was built, is running through what is 2 Lot #1, the Richard J. Cron subdivision. 3 That is a subdivision that has been 4 approved by the Planning Board. It 5 consists of several lots. Lebkuecher 6 family owns Lot #1. And the driveway, it's 7 only a driveway for this house. It's not 8 giving access to any other property. It's 9 an easement for the house that is on for 10 what we're proposing as Lot -- the only lot 11 which is the 3.6 acre parcel. So as far as 12 the questions, it's not serving any other r 13 lots. It's just over the Cron subdivision, 14 which is an approved subdivision by the 15 Planning Board. (Audio went silent. ) Which 16 is one of maybe -- I would say 8 lots. On 17 this map it shows 6, but I think there is a 18 couple of more. That is not changing Lot 19 #1. It will remain as it was in the 20 subdivision. And then finally -- yeah, I 21 think I pointed out, this is a right-of-way 22 for only this house. Not for any other 23 properties that Lebkuecher owns. The farm 24 lot. There is no easement or access going 25 from the farm to this house. It's a April 5, 2021 Public Hearings 31 1 separate lot. Lot 1 remains 9 Lot 1. It is just like Lot 2, Lot 3, Lot 10 4. The only new lot is what we call Lot 1 11 of this subdivision is where the house is. 12 I see a little red circle going around. 13 That is the new parcel. That is the only 14 lot subdivision that we are proposing here. 15 That is the 3.6 acres consist of a parcel 16 that is 339.62 feet by 406 feet, more or 17 less. Almost a square but not quite. And 18 that is subdivision of that piece from the 19 larger 32 acres, the farm parcel to the 20 right, which you can see some of the 21 agricultural buildings that are in the 22 screen that you are looking at. 23 CHAIRMAN WILCENSKI: Right.
