This meeting is public.The Planning Board may add or remove applications from the Agenda upon its discretion, without further notice. Applications may not be heard in the order they appear on this agenda. This public meeting will be held virtually via the Zoom online platform. Pursuant to Executive Order 202.1 of New York Governor Andrew Cuomo in-person access by the public will not be permitted. SUBDIVISIONS,- CONDITIONAL SKETCH PLAT APPROVAL EXTENSION: Chairman Wilcenski: Orient Point Conservation Subdivision —This proposal is for a 75/75 clustered Conservation Subdivision of 36.14 acres, currently comprised of six parcels, into 5 residential lots ranging in size from 1.6 to 1.9 acres, and one agricultural parcel with a 0.9 acre development area and with 25.68 acres of farmland from which development rights are proposed to be sold to the Town of Southold, in the R-80 and R- 40 zoning districts. This property is located at 32357 Old Main Street, Orient. FINAL PLAT DETERMINATIONS: Chairman Wilcenski: Baxter, William J., Jr.,- This proposal is a Standard Subdivision of a 2.38 acre parcel into 4 lots where Lot 1 = 0.62 acres, Lot 2 = 0.63 acres, Lot 3 = 0.62 acres and Lot 4 = 0.52 acres, in the Hamlet Business Zoning District. The property is located at 260 Griffing Street, on the northeast side of Griffing Street, +/- 402' west of SR 25, in Cutchogue. SCTM#1000-102-5-9.4 James H. Rich III: WHEREAS, this proposed Standard Subdivision is to subdivide a 2.38 acre parcel into 4 lots where Lot 1 equals 0.62 acres, Lot 2 equals 0.63 acres, Lot 3 equals 0.62 acres and Lot 4 equals 0.52 acre; and WHEREAS, on October 5, 2020, the Planning Board granted Conditional Final Plat Approval upon the map entitled, "Final Plat Subdivision for William J. Baxter, Jr. situated at Cutchogue," dated September 17, 1998 and last revised June 16, 2020, with ten conditions; and WHEREAS, on November 9, 2020, the Cutchogue Fire District responded to a request for comments— a fire hydrant will be added by the Fire District once the public water main is extended down Griffing Street; and WHEREAS, on June 10, 2021, a Final Sidewalk Plan (2 pages) was submitted; and WHEREAS, on June 23, 2021, the Town Engineer reviewed the Final Sidewalk Plan and found it acceptable, and also reviewed the Final Plat and found that the subdivision meets Chapter 236 for prevention of stormwater pollution; and WHEREAS, on September 16, 2021, a revised Final Plat with the Suffolk County Department of Health Services stamp and all revisions as required by the Planning Board was submitted; and WHEREAS, at their work session on October 18, 2021, the Planning Board reviewed the revised covenants, and added the street trees to the covenants instead of requiring a bond for them. The bond requirement was removed due to the sidewalk being largely completed by the neighboring condominium developers. The Board will add a condition to this approval that the remaining section of sidewalk on Schoolhouse Road, as shown on the Final Sidewalk Plan, is to be completed prior to building permits being issued; and Southold Town Planning Board Public Meeting —January 10, 2022 — Page 4 WHEREAS, on November 30, 2021, the Park & Playground Fee of$21,000 and the Administration Fee of$8,000 was submitted; and WHEREAS, on December 16, 2021, twelve paper copies and four Mylars of the Final Plat were submitted with the stamp of approval from the Suffolk County Department of Health Services; and WHEREAS, on December 23, 2021, a copy of the recorded covenants and restrictions was submitted; and WHEREAS the Planning Board has found that the all conditions of the Conditional Final Plat Approval have been met except for one that will be added as a condition of this Final Plat Approval; therefore be it RESOLVED, that the Southold Town Planning Board grants Final Plat Approval upon the map entitled, "Final Plat Subdivision for William J. Baxter, Jr. situated at Cutchogue," dated September 17, 1998 and last revised November 5, 2021, and also approves the Final Sidewalk Plan pages 1 and 2, dated February 18, 2021 and last revised November 4, 2021, with one condition: Condition: 1. The sidewalk as shown on the approved Final Sidewalk Plan must be fully constructed, inspected and approved in writing by the Planning Board and Town Engineer prior to any building permits being issued for this subdivision, except if the sidewalk cannot be installed due to the season, in which case Mr. Baxter will post a performance bond to the Town for the cost of the remaining section of sidewalk. The amount to be determined by Mr. Baxter, and reviewed and approved by the Town Engineer, and approved by resolution of the Planning Board and Town Board. Martin Sidor: Second. Southold Town Planning Board Public Meeting —January 10, 2022 — Page 5 Chairman Wilcenski: Peter Harbes Open Development Area— Lot Creation —This proposed conservation subdivision is to subdivide a 22.1659-acre parcel into 4 lots, one of which the Town of Southold purchased the Development Rights over 18 acres for farmland preservation. The property is located at 5645 Aldrich Lane, Laurel. SCTM#1000-120-3-11.11 Martin Sidor: WHEREAS, on August 25, 2009, pursuant to Southold Town Code Chapter 240 Article VIII Open Development Area, the Town Board granted the applicant the right to seek future approval of the creation of lots; and WHEREAS, this proposal is for the creation of the lots in an approved Open Development Area for an 80/60 conservation subdivision pursuant to Southold Town Code §240-26 Establishment; and WHEREAS, the Lot Creation will subdivide a 22.17-acre parcel into 4 lots, where Lots 1, 2 & 3 are 1.26-acre residential lots and Lot 4 is an 18.38-acre farm with the development rights held by Southold Town; and WHEREAS, the Planning Board granted Conditional Final Plat Approval for the Lot Creation on August 10, 2020; and WHEREAS, on October 22, 2021 the Park & Playground fee in the amount of$7,000 and the Administration Fee in the amount of$6,000 were submitted; and WHEREAS, on December 16, 2021, four mylars and twelve copies of the Final Plat including the approval stamp of the Suffolk County Department of Health Services and all required revisions were submitted; and WHEREAS, on January 6, 2022 a copy of the recorded covenants was submitted; and WHEREAS the Planning Board has found that the all conditions of the Conditional Final Plat Approval have been met; therefore be it RESOLVED, that the Southold Town Planning Board grants a Final Plat Approval upon the map entitled, "80/60 Conservation Subdivision Peter Harbes", prepared by Howard M Young, Land Surveyor, dated February 13, 2013 and last revised November 11, 202'1. SET PUBLIC HEARING/ STATE ENVIRONMENTAL QUALITY REVIEW ACT TYPE CLASSIFICATION: Chairman Wilcenski: Messina Conservation Subdivision —This 80/60 conservation subdivision proposes to subdivide 50 acres into eight (8) residential lots of approximately 35,000 sq. ft. each, and one 43.6-acre parcel to be preserved as open space by the Town. The property is located at 705, 751 & 2425 Laurel Avenue, Southold. SCTM#1000-56-1-1, 55-6-35 & 36 Pierce Rafferty: WHEREAS, this 80/60 conservation subdivision proposes to subdivide 50 acres into eight (8) residential lots of approximately 35,000 sq. ft. each, and one 43.6-acre parcel to be preserved as open space by the Town; and WHEREAS, at their work session on January 10, 2022, the Planning Board found this application complete; and WHEREAS, the Southold Town Planning Board has determined the proposed action to be Unlisted as it does not fall within the Type I or Type II actions pursuant to the State Environmental Quality Review Act (SEQRA) 617.5; be it therefore RESOLVED, that the Southold Town Planning Board has determined that this proposed action is an Unlisted Action under SEQRA as described above; James H. BOND RELEASE: Chairman Wilcenski: Schreiber Minor Subdivision —The property is located on the north side of Oregon Road, west of Alvah's Lane in Mattituck in the R-80 zoning district. SCTM#1000-95-1-4.2 through 4.4, and 1000-82-2-1 & 2. James H. Rich III: WHEREAS, this subdivision was approved by the Planning Board February 9, 2004; and WHEREAS, on February 3, 2004, the Southold Town Board accepted as a performance bond for the construction of the required improvements a Certificate of Deposit (Account Number 8331052493) from the Bank of America in the amount of$70,000; and WHEREAS, on January 10, 2022, at their Work Session, the Planning Board reviewed the recommendations from the Office of the Town Engineer and Planning staff, and found that all road and drainage improvements were completed as required, and agreed to recommend to the Town Board the release of the performance bond; be it therefore RESOLVED, that the Southold Town Planning Board hereby recommends that the Southold Town Board release in full the performance bond for the Minor Subdivision of Schreiber, Robert, held in the form of a Certificate of Deposit from the Bank of America (Account Number 910 001 5878 3783) in the amount of$84,840.80 and any accrued interest. SITE PLAN.APPLICATIONS SET HEARING/ STATE ENVIRONMENTAL QUALITY REVIEW ACT TYPE CLASSIFICATION: Chairman Wilcenski: Fishers Island Artist Workshop —This Site Plan application is for proposed interior renovations and site work to convert an existing 2-story 12,345 sq. ft. storage building to an artist workshop on 2.1 acres in the General Business Zone. The property is located on Fox Lane, Fishers Island. SCTM#1000-12-1-2 Martin Sidor: WHEREAS, this Site Plan application is for proposed interior renovations and site work to convert an existing 2-story 12,345 sq. ft. storage building to an artist workshop on 2.1 acres in the General Business Zone, Fishers Island; and WHEREAS, the Southold Town Planning Board has determined the proposed action to be Type II as it falls within the following description pursuant to State Environmental Quality Review Act (SEQRA) 617.5(c)(2) ". . . replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire codes"; be it therefore RESOLVED, that the Southold Town Planning Board has determined that this proposed action is a Type II Action under SEQRA as described above; Pierce Rafferty: Second. PUBLIC HEARING Chairman Wilcenski: 6:02 PM — NOFO Center Amended —This site plan is for proposed interior alterations to an existing 4,866 sq. ft. multi-use building, no footprint expansion, with thirty-six parking stalls on 0.7 acres in the General Business Zoning District. The property is located at 75 Marlene Lane, Mattituck. SCTM#1000-143-3-1 Chairman Wilcenski: At this time I would like to bring in the applicants agent, if you could please address the board and give a brief overview of your project. Anthony, can you hear us? Anthony Portillo: Good Evening Board, this is Anthony Portillo. So we are proposing to utilize the existing building, we're not requesting for any change to the footprint or the parking lot—the existing parking stalls will remain. We are requesting that units 1 and 2 are going to become nail salon units, unit 3 would be split between business office space and retail and then units 4 and 5 would be for retail use. Chairman Wilcenski: Okay and all of the parking calculations have been done and what's there is within the code? Anthony Portillo: Yes, that's correct. We've provided the parking calculations, one thing that came from those calculations was that the existing parking spaces, where they did not conform originally , but by making some of the spaces into retail really helped to reduce the parking requirement. The nail salon will be taxiing employees into the nail'salon so they will not be utilizing any of the parking -that is their plan. But overall, we were able to reduce the amount of parking that was required due to the retail space. The original units 4 and 5 prior to this change of use request were utilized for a Southold Town Planning Board Public Meeting —January 10, 2022 — Page 10 hair salon, which is more square footage than units 1 and 2 are for the nail salon, which does have the same parking load, so I just wanted to mention that.
