EASEMENT AND DRIVEWAY MAINTENANCE
AGREEMENT

THIS AGREEMENT made this day of -'a between
Erin Dickerson and Robert Dickerson, residing at 320 Billard Road,
Cutchogue, NY 11935, collectively as party of the first and
Ahmad Sardar-Atkhami_residing at 141 East 3rd Street, Apt. 1 IA,New
York, NY 10009 as party of the second part;
WHEREAS, the party of the first part is an owner in fee simple of parcel
of land, located Billard Road & Lupen Drive, Cutchogue NY 11935, and
designated as SCTM: 1000-98-1-25 hereinafter referred to as Parcel 1, and
more fully described in Schedule A attached hereto, and
WHEREAS, the party of the second part, as owner in fee simple of the
parcel of land, located off of a private right of way at Billard Road, Cutchogue
NY 11935, and designated as SCTM: 1000-98-1-6 hereinafter referred to as
Parcel 2, and more fully described in Schedule B, attached hereto, and
WHEREAS, the parties of the first part intend to grant an easement to the
party of the second part for a portion of the parcel of land described in Schedule
A, said easement more fully described in Schedule C, attached hereto.
WHEREAS, the parties mutually agree to certain road maintenance
agreements which benefits both parties;
WITNESSETH:
Easement for Public Water:
NOW IN CONSIDERATION OF ($10.00 ) each and to the other paid and
the receipt of which is hereby acknowledged and other good and valuable
consideration the parties of the first part hereby grant and convey unto the party of
the second part, his heirs, successor and/or assigns which shall come into title to
said Parcel 2, a permanent and perpetual easement that runs with the land, as
described more fully in Schedule C, to allow for access for the placement,
installation, maintenance, repair, inspection and replacement of the water service
lines within the easement area, and the party of the second part, his heirs,
successors and/or assigns and shall restore the area to its condition after
installation, maintenance, repair, inspection and replacement of such water line
over the premises more particularly described in Schedule C. The cost of
installation, maintenance and repair of said water line and sewage disposal system
to restore the area shall be born solely by the party of the second part, his heirs,
successors and/or assign.
The parties of the first part, its successors and assigns, retain unto
themselves all rights to fully enjoy its aforedescribed premises except for the
purposes herein granted to the party of the second part.
The aforementioned Easement contained herein shall be enforceable by
the party of the first part, and the County of Suffolk, State of New York, by
injunctive relief or by any other remedy in equity or at law. The failure of any
agencies or departments of the County of Suffolk, the Suffolk County Health
Department, or the County of Suffolk to enforce the same shall not be deemed to
affect the validity of this easement nor to impose any liability whatsoever upon
the County of Suffolk or any officer or employee thereof.
This grant of easement as to the placement, installation, maintenance,
repair, inspection and replacement of the water service lines within the easement
area shall at all times be deemed a continuing covenant that runs with the land and
shall be binding upon, and inure to the benefit of heirs, successors and/or assigns
of all parties to this agreement. This grant of easement as to the placement,
installation, maintenance, repair, inspection and replacement of the water service
lines within the easement area shall not be terminated or extinguished without the
prior approval of the Suffolk County Department of Health Services.
Easement for other Utilities:
The party of the first part hereby further grants to the party of the second
part, his successors and assigns, a permanent and perpetual easement that runs
with the land, as described more fully in Schedule C, to allow for access for the
placement, installation, maintenance, repair, inspection, and replacement of all
utilities, including but not limited to electric, cable, gas, and such other utilities as
may become available, within the easement area.
The party of the second part agrees that the utilities shall be placed
underground, no electric utility poles will be placed within the right of way, and
the party of the second part, their heirs, successors and/or assigns shall restore the
area to its condition after installation, maintenance, repair, inspection, and
replacement of such utility over the premises, more particularly described in
Schedule C. The cost of installation, maintenance, and repair of his utilities, and
to restore the area within a reasonable time, shall be born solely by the party of
the second part, their heirs, successors and/or assign.
Road Access & Maintenance of Road:
It is Further Mutually Agreed as follows:
1. The party of the second part will pay for removal of trees required to access his
parcel.
2. The party of the second part will improve his driveway within the right of way
with natural stone, with a compacted gravel over compacted base, or as required
by Town of Southold, with no asphalt or clam shells.
3. The parties of the first part and the part of the second part will share the
annual cost of snow removal to the point where the driveways split off to the
respective residences, the plow company to be mutually agreed upon, and that
snow shall not be left to block access to either respective driveway.
4. The party of the second part will not construct any structures, other than a
small sign with a name plate & address number, for identification of the property,
on the right of way.
5. The parties of the first part and the part of the second part mutually agree
that they, their contractors, or guests, will not block the easement and will
not allow parking within the easement.
