Box 1452 Mattituck, NY 11952 Re: SEAR & Conditional Sketch Plat Approval Messina Conservation Subdivision 705, 751 & 2425 Laurel Avenue, Southold SCTM#1000-56-1-1, 55-6-35 & 36 Dear Mr. Finnegan: The Southold Town Planning Board adopted the following resolutions at a meeting.held on Monday, March 14, 2022: WHEREAS, this 80/60 conservation subdivision proposes to subdivide 50 acres into eight (8) residential lots of approximately 35,000 sq: ft. each, and one 43.6-acre parcel to be preserved as open space by the Town; and WHEREAS, on December 14, 2021, the applicant submitted a Sketch Plan application and fee; and WHEREAS, at their work session on January 10, 2022, the Planning Board found the application complete; and Messina Conservation Subdivision Page 12 March 15, 2022 WHEREAS, at their public meeting on January 10, 2022, the Planning Board set the public hearing for Monday, February 7, 2022 and classified the action as Unlisted pursuant to the State Environmental Quality Review Act (SEQRA) 617.5; and WHEREAS, on February 7, 2022, the public hearing was held and closed; and WHEREAS, in an email dated January 18, 2022, the Southold Town Fire Marshal responded that he had no comments on the proposed subdivision application; and WHEREAS, in a memo dated January 20, 2022, the Town Engineer responded with a list of comments; and WHEREAS, in a letter dated January 26, 2022, the Southold Fire District responded with a request that a 12" water main be installed along Laurel Avenue; and WHEREAS; on February 2, 2022, the Suffolk County Planning Commission responded that this matter should be considered for local determination and has no objection to Southold Town Planning Board taking Lead Agency; and WHEREAS, in a memo dated February 9, 2022, the Town Land Preservation Committee supported the conservation subdivision as proposed and recommended that they begin the appraisal process with Town Board after sketch plan approval; and WHEREAS, on March 4, 2022, the Southold Town Local Waterfront Revitalization Program (LWRP) Coordinator reviewed this application, and has recommended the proposed project be found consistent with the policies of the Southold Town LWRP with recommendations to be implemented; and WHEREAS, the Planning Board, as Lead Agency, performed a coordinated review of this Unlisted Action pursuant to 6 NYCRR Part 617, Section 617.7 of the State Environmental Quality Review Act (SEQRA); and WHEREAS, on March 14, 2022, at their work session, the Planning Board reviewed the Public Hearing comments and the comments returned from the applicable and involved agencies, and all comments were incorporated into the application to the satisfaction of the Planning Board; and WHEREAS, on March 14, 2022, at their work session, the Planning Board reviewed the Park & Playground finding; and Messina Conservation Subdivision Page 13 March 15, 2022 WHEREAS, as a result of this subdivision, the Planning Board found that there is the potential for new residents to create an increased demand for recreational facilities in the Town. These factors present a proper case for requiring a park suitably located for recreational purposes; and WHEREAS, due to the habitat value of the wooded wetlands, the parcel is unsuitable for the inclusion of a public park, playground or other recreation use; and WHEREAS, Southold Town Code §240-53 G establishes a fee of$7,000 per new lot created to be paid in lieu of providing a park within the subdivision; and WHEREAS, on March 14, 2022, at their work session, the Planning Board found that this Sketch Plat application is ready for a determination pursuant to Town Code §240 Subdivision of land; therefore be it RESOLVED, that the Southold Town Planning Board, as described above, hereby finds that the proposed subdivision plat presents a proper case for requiring a park for recreational purposes, but that a suitable park cannot be properly located on such subdivision plat, and that the Planning Board will require a Park and Playground fee of $17,500 in lieu thereof; and be it further RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold LWRP; and be it further RESOLVED, that the Southold Town Planning Board, pursuant to SEQRA, hereby makes.a determination of non-significance for the proposed action and grants a Negative Declaration; and be it further RESOLVED, that the Southold Town Planning Board grants a Conditional Sketch Plat Approval upon the map entitled, "Preliminary Sketch Plan for Dan Messina", prepared by Nathan Taft Corwin III, Land Surveyor, dated September 20, 2021 and last revised November 18, 2021, with the following conditions: 1. Landscaping & irrigation restrictions as outlined in the LWRP report. b. Prior to building permits being issued: i. Plant 37 street trees (a mix of oak species (Quercus palustris), other oak species and other native trees) ii. The Southold Town Planning Board, as lead agency, has determined that the proposed action described below will not have.a significant.effect on the environment and a Draft Environmental Impact Statement.will. not be prepared.. Name of Action: Messina Conservation Subdivision SCTM#: 1000-55-6-35 & 36, 56-1-1 Location: On the west side of Laurel Avenue, 140' southeast of YennecottDr. 705; 751, & 2425 Laurel Ave, Southold SEQR Status: Type I ( ) Unlisted (X) Conditioned Negative Declaration:- Yes ( ) No (X) Description of Action: This 80/60 conservation subdivision proposes to subdivide 50 acres into eight (8) residential lots of approximately 35,000 sq. ft. each, and one 43.6-acre parcel to be preserved as open space by the Town, in the R-80 zoning district. Reasons Supporting This Determination: s A Full Environmental Assessment Form has been submitted and reviewed and it was determined that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Negative Declaration Page 12 March 141, 2022 The determination was based upon the following: By proposing a conservation subdivision instead of a standard subdivision, the number of new homes is being reduced by 55%. In addition over 80% of the buildable lands will be preserved as open space, where only 60% would be required in a standard subdivision. Clearing limits on the lots to preserve additional habitat, as well as irrigation limits to conserve water will further reduce any impacts. Impact on Land This application proposes the creation of eight lots for residential homes. Currently this property consists of three parcels, so the net increase in potential for new homes in only five more. There are no significant geologic-features on site. While the proposed action is expected to involve physical alteration of the land surface of the site from the construction of eight residential structure, the adverse impacts!on land are expected to be low because over 86% of the property will be preserved as open space. Impact on Surface Water & Groundwater Potential Impacts to Water Quality include: 1. Nutrient loading, including N loads to groundwater that could potentially degrade ground and surface waters. 2. Application of fertilizer and pesticides on turf and landscaped areas using potable water from the sole source aquifer. The subject site is located within Suffolk County Department of Health Services (SCDHS) Groundwater Management Zone IV, which according to Article 6 of the Suffolk County Sanitary Code, has an allowable flow of 600 gallons per day (GPD) per acre in areas served by public water. This proposal will result in an estimated increase in water usage of 2,920 GPD to ,'service all eight residential lots (in-house usage as well as proposed landscaping irrigation). Construction of a Suffolk County Article 19 Alternative On-site Sanitary Wastewater Treatment System is required on each of the lots to reduce nitrogen in wastewater effluent. A covenant and restriction limiting irrigation to 15% of the total lot area will be required, in addition to the Best Management Practices to further policies 5.4 and 5.5, as detailed in the Local Waterfront Revitalization Program. Impervious surface area on site will increase over existing conditions. The control of stormwater will be achieved on-site pursuant to Chapter 236 Stormwater Management of the Southold Town Code requirements. Negative Declaration Page 13 March 14, 2022 Based upon the findings above, significant impacts to surface and groundwater quality from stormwater runoff are expected to.be low. Impact on Agricultural Resources Although there are agricultural soils present, this parcel has been fallow for many:years, allowing trees and other early successional shrubs to dominate. As such, there will be no impact on agricultural resources. Impact on Aesthetic Resources The parcel is located on a street with houses lining it on the east side. The proposed development will mirror the development across the street. Street trees will be planted on the lots and aesthetics are expected to be similar to those elsewhere in the neighborhood. ; Laurel Avenue is not on the Town's list of scenic resources and is not visible from the nearby Scenic Byway of State Route 25. Based upon the findings above, no significant impacts to aesthetic resources are expected. Impact on Open Space and Recreation- The proposed conservation subdivision will preserve over 87% of the land as open space. The Town will own the open space and thus provide a public resource of open space in perpetuity. The site does not currently offer public recreational opportunities. Impact on Critical Environmental Areas The site is not located within the Critical Environmental Area known as Peconic Bay and Environs. It is located nearby, but not technically within it. Impact on Transportation The reduction in the number of homes proposed from 18 to 8 has mitigated any potential impacts on transportation. Impact on Historic and Archeological Resources There is a 2008 archeological investigation report from Tracker Archeological Services that performed a Phase 1 B resulting in the excavation of 294 shovel tests between 1 to 15 meter intervals. No historic artifacts or features were encountered and no further work was recommended. This report can be found on the Town's Laserfiche system under Planning/Applications/Standard Subdivisions/Inactive Closed/Bayberry, be on Page 646. I Negative Declaration Page 14 March 14, 2022 Impact on Energy The impact on energy use is expected to be low. Impact on Noise, Odor, and Light Residential development on site will result in short term impacts from noise during construction. The impact on noise, odor, and light is expected to be low. Impact on Human Health See above discussion on groundwater quality and potential contamination issues, and the measures that will be enforced to mitigate these issues. Consistency with Community Plans & Character The surrounding community,is developed in a similar manner to this subdivision, with homes along Laurel Avenue. This subdivision mirrors the development across the street. The goals of the Southold Town Comprehensive Plan are met by the conservation subdivision outcome where over 86% of the property is preserved and the density is reduced significantly. Dear Ms. Moore: The following resolutions were adopted at a meeting of the Southold Town Planning Board on March 14, 2022: WHEREAS, this resubdivision proposes to transfer the 4.34 acre drainage area that serves The Fields at Mattituck subdivision road from Lot 27 of the filed map (Map#11370) to the subdivision road (tax parcel 106.-8-81). Lot 27 will be reduced from 31.38 acres to 27.04 acres. The drainage area is intended to be dedicated to the Town as part of the road dedication for this subdivision once completed. In addition, the applicant has proposed to relocate the building area for Lot 27 to.the west along Bergen Avenue, as'shown,on the revised plan submitted on 12/7/2021.
