On behalf of Key Capture Energy (KCE), H2M architects + engineers (H2M) present this letter along with
the enclosed Application for Building Permit for KCE NY 26. KCE is proposing to construct and operate an
approximately 60-megawatt battery energy storage system (BESS) at the parcel referenced above. In
connection with this application, enclosed please find the following:
1. Application for Building Permit;
2. Conceptualized Site Plan prepared by H2M, dated January 11, 2022 (2 copies); and
3. Single and Separate Title Search.
The enclosed application and appurtenant documentation are submitted for the purposes of obtaining a
Notice of Disapproval for submission to the Zoning Board of Appeals for a Variance Application. At this time
there are two variances we believe will be required for the proposed project:
1. The development as proposed will require a variance from the maximum building height (35 feet)
permitted under §280-63 to allow for the installation of lightning masts associated with and within
the area of the project substation and Point of Interconnection (POI) substation to be constructed
to a height of 55.7 feet; and
2. The development as proposed will require a variance from the minimum single side yard width (20
feet) permitted under §280-63 to allow for the installation of "Hard Bus" interconnection between
the project substation and the POI substation. A two -lot subdivision is proposed to facilitate the
conveyance of the POI substation property to LIPA, and the hard bus connection between the two
substations will be zero feet from the common lot line between the lots created with the subdivision.
