LAND PRESERVATION COMMITTEE MEETING
Minutes & Discussion Notes from Meeting held
Tuesday, February 22, 2022 at 7:00 p.m.
This Regular Meeting was held via the Zoom online platform.
The public had access to view and listen to the meeting as it was happening via Zoom. If no access to a
computer or smartphone, there was an option to listen in via telephone.
Comments from the public may not be solicited nor received without an appointment. It is expected
that the Committee will enter into Executive Session* at some point after opening the Regular Meeting
for the purpose of discussing applications regarding proposed acquisitions of real property where
publicity would substantially affect the value thereof. The public is not allowed to attend, view, or
listen to Executive Session.

Committee Minutes and Administration
Acceptance of LPC meeting minutes from February 8, 2022
MOTION made by Sam McCullough, seconded by Eric Keil, to accept the 2/28/2022 LPC
meeting minutes.

Next Regular LPC Meeting Date
The next regular meeting is scheduled for Tuesday, March 8, 2022 and will be held via the
Zoom online platform.
Inquiries for Uses or Structures on Preserved Property

Request for improvements on property subject to Town PDR
LPC discussed the application materials that had been presented to the Committee. The Committee
decided to take action on some of the requests. The Committee proceeded with discussing the
application and taking several motions as follows:
1.
east and west sides of farm and to revegetate Western Hedge Row with eastern cedars,
bayberry, little and big blue stem grasses

MOTION made by Eric Keil, seconded by Anne Murray, that clearing of overgrowth on the
property is consistent with the terms of the recorded easement, and that this type of work may
be conducted at this time.

Committee members noted that a clay lined pond is not a water source that will be available for
agricultural irrigation purposes during hot, dry periods when irrigation is necessary, and that the
creation of such a pond is not an agricultural use.
MOTION made by Eric Keil, seconded by Doris McGreevy, that establishing a clay lined pond
for purposes of irrigation and recreation is not consistent with agricultural production and is not
consistent with the terms of the recorded easement; therefore this type of improvement shall not
occur within the area subject to the recorded easement.
Motion carried: 6/0

MOTION made by Sam McCullough, seconded by Eric Keil, that any road improvements
requiring soil removal or replacement of soil with road improvement material is not consistent
with the terms of the recorded easement; and therefore this type of improvement shall not occur
within the area subject to the recorded easement.

4. The Committee noted that the application presented January 5th and the additional information
presented Jan. 25th lacked clarity as to the overall plan for the property, and contained some
conflicting information. The Committee noted that one overall site plan, including a revised
application form detailing all requests for improvements, is necessary for review to proceed.
Questions were raised regarding which improvements are existing, which are proposed to
remain, and which are being relocated and the Committee noted that the overall plan should
clearly delineate which improvements are existing, which are proposed to remain, and which are
being relocated.
MOTION made by Sam McCullough, seconded by Doris McGreevy, that a complete overall
plan together with a revised application form detailing all requests and improvements is
necessary before the Committee will give further consideration to the application. In addition,
all information must be presented at least a week prior to the Committee meeting date.

The Committee noted that all comments and review pertain to the 20 acre area subject to the
recorded easement only and that requests for improvements outside of this area are not subject to
Committee review.

The Committee discussed conducting a site visit and scheduled a site visit for February 28.

The Chair noted that tthe
Agricultural-Conservation (A-C) District does not differentiate between a Farmhouse and a Permitted
One-family detached dwelling, and does not include Farmhouse as a separate Permitted use. The
Easement restricts the use of the premises exclusively for agricultural production and in doing so does
the Easement. It was noted that the 1998 acquisition excluded 11.3422 from the area subject to the
Deed of Development Rights and that it is recommended that the landowner revise the plans to propose
Discussion continued after a LPC member noted that farm labor housing may be allowed. Questions
raised including whether clarification needed at a Code level regarding farm work housing/ farm labor
housing definitions and requirements before a determination regarding easement consistence can be
made, and whether housing is considered part of the Agricultural Production definition.
Landowner representatives Charles Cuddy Esq. and Leroy Barnes, Jr joined the discussion, and noted
that the proposed housing was for a farm worker who oversaw the farm and that housing is considered
a bona fide accessory agricultural use.
The Committee decided to ask the Town Attorney for additional review. The Committee also said that
Charles Cuddy should discuss the topic with the Town Attorney.

SESSION
Proposed Acquisitions of Real Property Where Publicity Would Substantially Affect the Value

The LPC members entered into EXECUTIVE SESSION at 7:57p.m.
Attendees dismissed and meeting locked.
Land Preservation Coordinator Melissa Spiro gave updates on inquiries, new applications,
appraisals and current applications.
