Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below Policy Standards and therefore is INCONSISTENT with the LWRP. The photos submitted show nests of the Barn Swallow in the bluff. The removal or causing adverse impacts to the nesting area is not supported by Policy 6: protect and restore the quality and function of the Town of Southold ecosystem. It is recommended that alternative erosion control methods in that section that would not remove the habitat are sourced if the nests are determined to be active. The installation of the rock revetment is recommended as CONSISTENT provided that the applicant designs the feature to minimize erosion on the adjacent properties. No naturally occurring boulders located on the beach should be used in the construction. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
