Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. The recommendation is made with the following considerations: 1. There is no ability to relocate the structure outside of the FEMA flood zone AE EI 7 due to lot size and configuration. 2. The proposal will upgrade the dwelling to FEMA construction standards. The first-floor elevation is proposed at 9'. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. I3ASI OF APPLICA°l ION': Request for Variance from Sections 280-124; and the.Building Inspector's August 10, 2021 Notice of.Disapproval based on an application for a permit to demolish an existing accessory garage; and elevate, relocate and construct additions and alterations to an existing single-family dwelling;at 1) located less than the code minimum required rear yard setback of 35 feet; located at 170 Bay Lane, (Adj. to Orient,Harbor) Orient, NY SCTM# 1000-24-2-26.4. Page 2,February 17,2022 #7593, Bur-Tur i SCTM No. 1000-24-2-26.4 REIEI ITE( U1:STEl ': The applicant requests a variance to make alterations and additions which include relocation and elevation of the single-family dwelling resulting in a rear yard setback of 3.8 feet where a minimum rear yard setback of 35 feet is required by Town Code. According to the applicant's representative, in order to make the dwelling FEMA and New York State compliant, the dwelling will be raised approximately three feet. ADI)ITIC3NAL 1NFOR1vIATION An existing accessory garage located .6 feet from the rear property line will be i demolished. The applicant has the benefit of a Certificate of Appropriateness, dated November 19,2020, issued by the Town's Historic Preservation Commission. The applicant's representative indicated that an Innovation Advanced Septic System is proposed. FINDINQS'QF FACT_REASONS FOR'BOARDACTION. 1 , The Zoning Board of Appeals held a public hearing on this application,on February 3,2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and`other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town T,ttw; 26?Nh(31(hj(Ll' Grant of the variance will not produce an undesirable change in the character of the neighborhood or a"detriment to nearby properties. The neighborhood consists of older single-family dwellings located on a private, gravel, single-lane road that runs along Orient Harbor. Most:of the lots are irregularly shaped arid many homes have historic landriiark designation and pre-existing non-conforming setbacks. the applicant-hag obtained a Certificate"of Appropriateness from'the2Historic Preservation Commission.for the proposed constrUetion and renovation'which ineludes'elevating and relocating the-existing..two;story. dwelling slightly to the south which .11 will removed non-conforming 3.7-foot side yard setback.,,and adding a"he-story master bedroom additiomlocated so as to preserve the water view of the neighbor to the East of the appli.cant's-rear yard' The proposed construction will conform to the town'of Southold's maximum lot coverage requirements. . 2 Town f:aw X267-E 3)h)(2). .. he benefit sought by the.applicant cannot be.achieved by some method, feasible for the applicant>to pursue, other than an area variance. The lot is oddly shaped and is improved.with a home that is pre-existing non-conforming. Any design scheme which includes preserving and/or,adding to the shape of the existing home'will require the benefit of an area variance. 3. TOM L t*_267 b{3lt"b)Q The variance granted herein is mathematicallysubstantial, representing 90%relief from the code. However, thezproposed setback is more conforming than the setback of the existing accessory, garage which is being demolished, and the application is LWRP Consistent. 4. T-o*n-.Law'22-67-h(3)(b)(4);;No evidence has"been submitted to-suggest that a"variance,in-this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The Applicant must comply with Chapter 236 of the Town's Storm Water Management Code. The old septic system will be abandoned and anew IA wastewater treatment sanitary system'is proposed which.will improve the environment. 5. ToWn-JLaw §267-b(3)LJ(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect arid it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.T6wn Layv§267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a FEMA compliant dwelling with additions while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. y \ Page 3, February 17,2022 k #7593, Bur-Tur SCTM No. 1000-24-2-26.4 1 RESOLUTION OF THE BOARD_ In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered.by Member Dantes, seconded by Member Planamento, and duly carried, t to i GRANT the variance as applied for, and shown on the Site Plan prepared by Matthew Benjamin Sherman, LPE,' last revised August 31, 2621, and Architectural Plans by David Kriegel, Architect, dated September 7, 2021, and labeled site plan,A 100,A101;A300; A301. Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): See attached addendum. STATEMENT OF EFFECT FOR AMNON&KATHLEEN BAR-TUR 170 BAY LANE ORIENT,NY SCTM#1000-24-2-26.4 The proposed project seeks to renovate and add a master bedroom addition to an existing dwelling, whose construction pre-dates the adoption of Town zoning code in 1957 and is in need of structural repairs, upgrade of mechanical systems, and replacement of deteriorating siding, roofing, windows, and insulation. And as a result of its design and additionally incorporated environmental mitigation measures described below, the project will further the goals of Chapter 275 (and LWRP Policies 4. 5, and 6) by increasing the dwelling's protection from potential flood and erosion damage; and by protecting and improving water quality and the quality and function of the surrounding Orient Harbor tidal wetland ecosystem. a. All proposed construction will remain located outside the Coastal Erosion Hazard Area; b. Lot coverage will remain below the code-compliant 20 percent. c. The relocated dwelling will be elevated to a FEMA-compliant base flood elevation, thus substantially increasing the dwelling's protection from potential flood and erosion damage and providing a benefit to adjacent properties through reduction of potential damage that could be caused to nearby structures as a result of damage that might otherwise be caused to the subject dwelling during a significant storm event; d. The existing wetland setback to the bulkhead adjacent to Orient Harbor will be maintained and in fact increased by one foot as a result of the relocation of the existing dwelling structure, and the proposed addition will be located on the landward side of the relocated dwelling; e. To ensure that the project does not increase the potential for stormwater runoff and would instead result in a potential reduction in runoff reaching Orient Harbor through improved site drainage, a stormwater drainage system is designed to capture and recharge roof runoff from the finished dwelling structure; f. As a means of providing a potentially substantial increase in the protection and improvement of water quality, the existing conventional septic system will be removed and replaced with a low-nitrogen, UA sanitary system designed to significantly reduce nitrogen loading into the groundwater and thus ultimately the surface waters of Orient Harbor; and g. A project limiting fence would be installed to contain site disturbance and potential surface runoff during construction. 617.20 Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information. The applicant or project sponsor is responsible for the completion of Part 1.Responses become part of the application for approval or funding, are subject to public review, and may be subject to further verification. Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR AMNON&KATHLEEN BAR-TUR 170 BAY LANE ORIENT,NY SCTM#1000-24-2-26.4 POLICY 4.5& 6 The proposed project seeks to renovate and add a master bedroom addition to an existing dwelling, whose construction pre-dates the adoption of Town zoning code in 1957 and is in need of structural repairs, upgrade of mechanical systems, and replacement of deteriorating siding, roofing, windows, and insulation. And as a result of its design and additionally incorporated environmental mitigation measures described below, the project will further the goals of LWRP Policies 4, 5, and 6 by increasing the dwelling's protection from potential flood and erosion damage; and by protecting and improving water quality and the quality and function of the surrounding Orient Harbor tidal wetland ecosystem. h. All proposed construction will remain located outside the Coastal Erosion Hazard Area; i. Lot coverage will remain below the code-compliant 20 percent. j. The relocated dwelling will be elevated to a FEMA-compliant base flood elevation, thus substantially increasing the dwelling's protection from potential flood and erosion damage and providing a benefit to adjacent properties through reduction of potential damage that could be caused to nearby structures as a result of damage that might otherwise be caused to the subject dwelling during a significant storm event; k. The existing wetland setback to the bulkhead adjacent to Orient Harbor will be maintained and in fact increased by one foot as a result of the relocation of the existing dwelling structure, and the proposed addition will be located on the landward side of the relocated dwelling; 1. To ensure that the project does not increase the potential for stormwater runoff and would instead result in a potential reduction in runoff reaching Orient Harbor through improved site drainage, a stormwater drainage system is designed to capture and recharge roof runoff from the finished dwelling structure; in. As a means of providing a potentially substantial increase in the protection and improvement of water quality, the existing conventional septic system will be removed and replaced with a low-nitrogen, UA sanitary system designed to significantly reduce nitrogen loading into the groundwater and thus ultimately the surface waters of Orient Harbor; and n. A project limiting fence would be installed to contain site disturbance and potential surface runoff during construction. ' 1 -SEE ATTACHED ADDENDUM- Attach additional sheets if necessary Policy 7.
