During the public hearing the applicant's agent stated that there is no other feasible location for the proposed ,accessory garage given the curve in East End Road and the original house placement. Additionally,as a res'u'lt of the natural topography and existing driveway,coupled with.the sites elevation(46 feet, above sea level with a rise of a minimum of 15 feet from the roadway to it,plateau where the proposed garage and existing house is located)the applicant is encumbered with a tight lot despite its size, The agent also stated that while a laundry area is proposed hi the garage and an uncovered outdoor shower is designed for the outside ofthe.,garage,no additional.plumbing,.bathroom or conditionin ;(heat or ling)`is planned. Towp,Law 62, 6Z-,b(3)(b)(1)t Grant of the variance will not produce.an-undesirable change'in the character of the neighborhood or a detriment to nearby,properties. East End Road is a main thoroughfare running cast to west.on Fishers Island,the majority of which is located in,the private,FlDCO community, ,lust north of the Fishers Island Club. FlDCO lots are larger and homes are well designvd�maintained,and landscaped. Accessory buildings of all sorts we common to the neighborhood, TI e subject property is essentially a corner lot(as the road frontage curves following the topography and is elevated above the surrounding roadway, with significant sloping to the south and east) and the proposed locAtion of the accessory Wage is within the portion of the parcel.that is flat and significantly somened,ftorn view by neighboring properties,and will be located about 200 feet from theroadway. As such,it will not result in an undesirable.change or detriment of any kind to the character of the-surrounding neighborhood. Furthermore, FIDCO's Architectural Review Committee reviewed and approved of the design and placement of the proposed accessory garage. 2. Town Liaw 67- 2 . The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The curvature of East End Road creates the burden of two front yards,,although not defined as such. Placing the age in the rear yard,as defined by the Town Code, is not feasible due to the topography of the parcel and the limited access from the existing driveway. Placement of the garage in the rear yard would require substantial excavation and denuding of the naturally sloped and wooded terrain of the lot. 3. Town Law§267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the relief sought is not practically substantial in light of the configuration of the lot,the location of the driveway and the grade of the lot. The driveway is elevated 15 feet from East End Road and the flat, side yard area is the only feasible location for the proposed garage Page 3,January 20,2022 #7575 WS2 Investments SCTM No. 10004-6-1 structure, The garage,as proposed,is approximately 200 feet from the roadway and substantially screened from view. 4. Town Low 6267-b(3)(b)(4),No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. S. ]:glyn Law 6267-b(3)(b)(5). The difficulty has been self-created.
