SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to A 14-25, and the Suffolk County Department of Planning issued its reply dated September 21, 2021stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: .The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 13,054.7 square foot parcel located in the R-40 Zoning District. The northerly property line measures 99.54 feet and the easterly property line measures 131.15 feet, and is adjacent to Richmond Road (25 ft. wide Private.Right of Way).. The southerly property line . measures 99.54.feet and the westerly property line'meastires 131.15 feet: The parcel-is currently improved with a two-story frame dwelling with_a covered concrete patio bn the easterly side of the dwelling and an attached wood deck on the southerly side of the property as shown on the survey map prepared by Island Wide Land Surveyors, dated July 31, 2014. BASIS.OF APPLICATION: Request for Variance from Article III, Sections 280-15; and the Building-Inspector's August 23, 2021 Notice of Disapproval based-on an application for apermit to construct an accessory garage; at 1) located in other than the code permitted rear yard;located at:350 Richmond Road East,Southold,NY. SCTM#1000- 135-3-9. RELIEF REQUESTED: The applicant requests a variance to construct an accessory garage to be located in the side yard having with conforming 5 foot setbacks from both the rear yard and side yard property lines, where the code requires accessory garages to be located in a rear yard. The applicant has submitted a Site Plan prepared by Anthony Portillo, Architect and dated July 26, 2021 which shows plans for a detached two car garage to be located partially in the rear yard and the majority to be in the side yard which does not meet the code standards Page 2, February 17, 2022 Allan Karen, 47582 SCTM No. 1000-135-3-9 ADDITIONAL INFORMATION: The applicant's representative informed the Board that only electric will be installed in the garage and a pulldown stairway will be installed for storage in the upper level. There is no plumbing proposed. An adjacent property owner on the east side spoke of his concerns that the accessory garage be screened from his view by preserving the existing trees and with planting additional vegetative screening FINDINGS OF FACT/REASONS FOR BOARD ACTION: The'Zoning Board of Appeals held a public hearing on this application on February 3, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This is an optimal location for the garage, since the property is well screened by existing trees and vegetation and the proposed garage will be located in the corner of the property farthest from the street where it will have little to no visible impact. Most residences in the area have accessory garages. The proposed accessory garage will be 24.3 ft. by 22.3 ft. with one large door to accommodate two cars. Part of the garage will be in the side yard, but the majority will be in the rear yard. Richmond Road East is a private dead end unpaved road with little traffic. 2. Town Law X267-b(3)(b)(2). .The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to.pursue, other than an area variance. The applicant's dwelling has an 11 ft. 8-inch setback from the rear property line so there is virtually no conforming rear yard in which to locate the proposed garage. Since the applicant is restrained by not enough space in the rear yard for the proposed garage, the applicant has requested a variance to place the garage mostly in the side yard with some of the garage in the rear yard. The applicant is proposing conforming setbacks from both the side and rear property lines for the garage. Variance relief is required as the applicant cannot meet the code standard. 3. Town Law&267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100%relief from the code. However, since the rear yard is not able to accommodate the proposed garage, the applicant must apply for a variance to locate the accessory structure mostly in the side yard. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions .in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 1267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage while preserving .and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE_BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Acampora, seconded by Member Weisman(Chairperson), and duly carried,to GRANT the variance as applied for, and shown on the Site Plan and Architectural Plans (Sheets SD-2 to SD-4) prepared by Anthony Portillo,Architect and dated July 26, 2021. Page 3, February 17,2022 Allan Karen, #7582 SCTM No. 1000-135-3-9 SUBJECT TO THE FOLLOWING CONDITIONS: 1. There shall be no plumbing installed in the structure. 2. The applicant shall maintain screening along the easterly property line for privacy. 3. Pulldown stairs shall be allowed for storage on the second level and the entire structure shall remain non-habitable. This approval shall.not be deemed effective until the required conditions have been net.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. . Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit; and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation.from the variance(s) granted herein as shown on the architectural drawings, site plan.and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to-comply therewith will render this approval null and void. Pursuant to Chapter 280-146(B).of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not.been procured, and/or a subdivision map has not been ,filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms.
