Beckman, L.S. and dated October 19, 2020 and a site plan, including detailed floor plans and elevations of the proposed alteration to the accessory, single-family residence, prepared by DiGiovanni & Associates Architects and dated February 3, 2021. Multiple letters of support were received by the Zoning Board of Appeals office prior to the public hearing. Comments to the Zoning Board of Appeals from the Town of Southold Planning Board are pending. The subject parcel is covered by the following Certificates of Occupancy and is currently used as a Self-storage facility under construction: Z-41683 dated December, 11,2020 covering alterations-and additions to a single-family dwelling. Z-40582 dated August 1, 20119 covering `.as built' electrical service and generator transfer switch. Z-40583 dated August 1, 2019 covering the Pre-Existing Certificate of Occupancy for a single-family dwelling, an inground swimming pool, a deck around the swimming pool, an accessory 27-car garage, a raised patio with screen room addition to a single-family dwelling, and electrical upgrades. Z-34621 dated October 22,2010 covering a raised patio and scree room addition to a dwelling. Z- 18195 dated July 18, 1989 covering an inground swimming pool&fence The swimming pool, fencing and raised deck are.removed from the site and their respective Certificates. of Occupancy are no longer valid. The applicant's agent provided prior Zoning Board of Appeals decision numbers: #5779 issued January 4, 2006 and #6259 issued April 27,,2009,both of which granted approvals for the creation of a caretaker's apartment accessory . to a self: storage facility. PROJECT DESCRIPTION The applicant proposes to convert the legally existing single-family 1,923 square foot residence on the subject property containing the self-storage business, into two apartments for employee housing consisting of apartment "A" measuring 963 square feet containing one bedroom and apartment `B" measuring 960 square feet and containing two bedrooms. No expansion of the existing residence is proposed. Each unit will also contain a kitchen, a bathroom, a living room and/or dining room. One unit will be rented by the self-storage business manager and the second unit will be tenanted by a night watchman. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 3, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 3, February 17,2022 #7591, 11900 Oregon Road, LLC SCTM No. 1000-83-3-5.3 VARIANCE RELIEF APPLLICATION Section 280-13(A) 6 of the Town Code permits one accessory apartment in an existing one-family dwelling, subject to the issuance of a rental permit in accordance with § 280-13D and the following requirements: (a) The accessory apartment shall be located in the principal building. The owner of the existing dwelling shall occupy one of the dwelling units as the owner's principal residence. The other dwelling unit shall be leased for year-round occupancy, evidenced by a written lease for a term of one or more years. The existing one-family dwelling shall contain not less than 1,600 square feet of livable floor area. (dd) The accessory apartment shall contain not less than 450 square feet of livable floor area. LejTlie accessory apartment shall not exceed 40% of the livable floor area of the existing dwelling unit and any addition thereto permitted under § 280-13B(13)(i)'hereof. (f)A minimum of three off.-street parking spaces shall be provided. JgINot.more than one accessory apartment shall be permitted on a lot. In reviewing the above standards of approval relative to the subject variance application to establish an accessory apartment in a principle single family dwe.11ing-the Board of Appeals makes the followingfindings: indings: 1. The single-family dwelling is not the principal building on the subject lot which contains a self-storage business as the principal permitted use on the LI Zoned property. 2. The subject single-family dwelling is not owner occupied as_a-principal residence. 3. The single-family dwelling is proposed to contain.two apartments of equal size(963 sq. ft. and 960 sq. The Board concludes that the application does not comply with the requirements of Section 280-13(A)6 (a), (b), (e),and(g)of the Town Code REVERSAL OF THE NOTICE OF DISAPPROVAL Section 280-62 Use Regulations of the Town Code permits C.Accessory uses.The following uses are permitted as accessory uses and, except for residential accessory uses and signs,which are governed by Article XIIX, are subject to site plan review: [Amended.5-9-1.989 by L.L.No. 6-1989] LLAccessory uses on.the same lot with and customarily incidental to any permitted or special exception use and not involving a.separate businessAl In reviewing the above section of the Town Code relative to the request to reverse the Building Department's Notice of Disapproval last amended July 13, 2021 denying proposed alterations to an existing single-family dwellingto-create two accessory apartments,the Board of Appeals makes the followingfrndings: Page 4,February 17,2022 #7591, 11900 Oregon Road,LLC SCTM No. 1000-83-3-5.3 1. Precedent has been established that the business model of a self:storage facility requires around the clock, 24-hour on site security to protect customers' stored possessions and to provide them with access to the facility at all times. The applicant's agent provided prior Zoning Board of Appeals decision numbers: #5779 issued January 4, 2005 and#6259 issued April 21, 2009,both of which granted approvals for the creation of a caretaker's apartment accessory to a self- storage facility. 2. The existing house is no longer a principal structure but is now an accessory to the more intensive, commercial use of the code permitted self-storage facility operating on the subject property in the LI Zone. 3. Site plan approval for the self-storage facility was granted by the Planning Board with the condition that the two apartments in the former single-family dwelling be maintained and used only for the tenancy of employees(watchmen//manager) of the self-storage business on the subject property. The Board concludes that the proposed two apartments in the former single-family residence to be used as rental housing for employees of the business operations, is customary and incidental to a self-storage facility and complies with Section 280-62(C) 1 of the Town Code. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Planamento, seconded by Member Acampora, and duly carried,to DENY the variance as applied for and REVERSE the Notice of Disapproval denying the alteration and division of the single-family residence into two separate apartments for employees of the approved storage facility business, as shown on the site plan,including detailed floor plans and elevations of the proposed alteration to the accessory,single- family residence, prepared by DiGiovanni &Associates Architects and dated February 3, 2021. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant is to apply for and receive a Rental Permit from the Town of Southold Building Department, after the Certificate of Occupancy is issued, prior to a tenant moving into either apartment.. It is the property owner's responsibility to ensure that the Rental Permit is renewed regularly. 2. No further expansion of the existing residential portion of the site is,permitted. Unit "A" is to remain 963 square feet with one bedroom, and unit "B" is to remain 960 square feet with two bedrooms. 3. The tenant in either apartment is to be a full-time employee of the self-storage facility providing on site security. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Wilcenski, Planning Board Chairman 0o,Members of the Planning Board Date: January 25, 2022 Re: Request for Comments for 11900 Oregon Road SCTM# 1000-83-3-5.3 #7591 The Planning Board has reviewed your request for comments regarding the above-referenced application and supports the request to allow two accessory apartments in the Light Industrial Zoning District as accessory uses to the principal self-storage facility use on-site. The proposal recognizes the need for workforce housing and security and is in accordance with the Southold Town Comprehensive Plan, specifically the Land Use and Zoning Chapter Goal 7 (below) and the Economic Development Chapter Goal 1. Objective 1.8 B. Goal 7: Economic Prosperity Facilitate the growth of existing businesses, and encourage new businesses for stable and sustainable employment. This includes agriculture, aquaculture, health care, renewable energy, tourism, light industrial, retail/service- based and the maritime-related industry. Balance economic prosperity with maintaining a high quality of life, the environment, and the unique character of the communities. The Planning Board is of the opinion that the two accessory apartments will not be damaging to the surrounding community character and environment.This is based upon the fact that there is already an existing single-family residence on the property, and that there would be no expansion of the existing residential structure, no addition of bedrooms and no exterior changes as stated in the Reason for Appeal received October 2, 2021 by your Board. In addition, a new sanitary system was installed in 2021. i If the Zoning Board approves these two apartments, it is recommended that conditions are added that require a Town rental permit,proof provided annually that at least one resident of each apartment is employed by the storage facility, and that the apartments are leased for a minimum of a year at a time. These requirements are not without precedent—other accessory apartments have similar conditions. The objective of the recommended conditions is to ensure these apartments continue to serve the purpose of workforce housing. Thank you for this opportunity to provide comments. The Applicant applied to the Building Dept. for an accessory apartment in an existing single-family dwelling, which application was denied. Alternative, Applicant seeks a variance to permit the apartment, in accordance with prior ZBA decisions on this issue. The Building Dept. initially cited Section 280-62A as the basis for its denial of the apartment as a non-permitted use. The July 13, 2021 Amended Notice of Disapproval ("Amended Notice") cited Section 280-62C, denying the apartment as a permitted accessory use. The Applicant seeks a reversal of this decision based on an incorrect interpretation by the Building Dept. of Section 180-62C, as a watchman's apartment is a customary incidental and necessary accessory use in a self-storage project in an LI Zone and should therefore be permitted under Code Section 280-62C. Applicant is not seeking to create two apartments, but rather to add an accessory apartment in an existing single- family dwelling. The labeling on the plan as two caretaker apartments refers to the two caretakers who will live there, a manager in one and a second watchman in the other. Therefore, Applicant seeks a reversal on the meaning of Section 280-62C, which governs.-accessory uses. Section 280-62C (1) allows: "Accessory uses on the same lot with and customarily incidental to any permitted or special exception use and not involving a separate business." Contrary to the Amended Notice, the Applicant's proposed use falls squarely within this section. The existing single family dwelling is a permitted use on the property, as it holds a Certificate of Pre-Existing Use as a single family dwelling. It is not a separate business as a) it is a residence, not a business, and b) it is occupied by the self-storage owner's manager-watchman, who must be on site as part of the business operation. The proposed accessory apartment will house the owner's second watchman, who must also be on site as part of the business operation. The manager will reside in the original dwelling less the area taken for the apartment, as shown on the plan. The house contains 3 bedrooms. No additional bedrooms will be added. A very small kitchen will be added to the apartment. The house contains two front and two rear entrances, and one of each will be assigned to each unit. There will be no expansion of the house or the footprint, and no exterior changes. The swimming pool was removed. Based on the two unanimous ZBA decisions in Appeal No. 57179 (2005) and Appeal No. 6259 (2009) approving a variance for watchman's quarters for a self storage project in an LI zone, the demonstrated need and prevalence of watchman's quarters in this specific type of business use in an LI zone, and the testimony to be produced at the hearing, Applicant submits that the Board should determine that the proposed use fits squarely within the customary accessory use language of 280-62C cited above. ` 2 RECEIVED c OCT 0 4 2021 ZONING BOARD OF APPEALS The objection cannot be that a residential use is requested. Residential uses have been permitted by both the two ZBA decisions cited above, and other permitted residential uses in an LI Zone, which include affordable residential housing and a conference center with rooms. The specific reasons for the granting of the requested relief are: 1. An undesirable change will not be produced in the CHARACTER of the neighbor or a detriment to nearby properties if granted, because: Approval of the request will create no visible change from the exterior of the residence. It will continue to look like Mrs. Zuhoski's ranch house that has been there for decades, completely in keeping with the residential aspects of Oregon Road. The pre-existing single-family dwelling will be renovated internally to add an accessory apartment. The west side of the dwelling will be for the manager, and the easterly unit, the remainder of the house, will house the second watchman employee. There is ample room for parking, and this project will actually result in less traffic than if the second employee had to drive in and out every day. The neighborhood will be safer because there will be a strong 24hr/7 day presence on the facility, which is available to storage customers at all times. The use of the building remains residential. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: In the storage business, it is required to have someone on site at all times, and available to immediately access the rear storage buildings should the need arise. Given the size of this project, a single watchman cannot realistically be available 24/7 every day of the year. The second small apartment would accommodate the second watchman. There is no realistic long-term availability of a dwelling for such an employee in the vicinity of the property; rentals are scarce in the entire Town, and the prices are not attainable for the average worker. The two units are necessary for the proper operation of the self-storage business: the watchman also serves as the manager and runs the office during the daytime shift;and he shares the remaining hours with the second watchman. When the manager/watchman is off, the second watchman would be able to be on site and monitor the gate and the security coverage, handle visitors and issues in the unit, and then be able to sleep and otherwise use his time off of shift hours. This includes weekend days as well as weekdays. In the current storage business climate, the sale of a security presence is of paramount importance to customer,the lack of which would hamper customers and create a severe competitive disadvantage to the business. It is customary and necessary to have watchmen coverage in alternating shifts. Based upon all testimony, documentation, personal inspection of the property,and other evidence,the Zoning Board finds the following facts to be true and relevant: VARIANCE RELIEF REQUESTED: The applicant wishes to add a 902 sq. ft. Apartment dwelling unit, next to the 725 sq. ft. office area, all within one of the proposed new buildings (building referred to as Phase 1) to be built for public storage use in this Light Industrial Zone District. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,,the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in.the character of the neighborhood or a detriment to nearby properties. The new apartment (dwelling) unit will consist of 902+- square feet and is proposed for the purpose of residency by the manager-employee of the public warehouse facility at this site. The variances granted herein are substantial, for the proposed accessory apartment's residential use in an LI Zone and for a building proposed-with more than 60 linear feet-along Depot Lane. 4.
