Amnon and Kathleen Bar-tur PROPERTY LOCATION: 170 Bay Lane, Orient,NY SCTM No. 1000-24-2-26.4 SEQRA DETERMINATION: The.Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without. further.steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated October 13,2021 stating that this application is considered a matter for local.determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 248, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated_January 19, 2022. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department;as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 10,449.29"square foot waterfront parcel located in an R-40 Zoning District. The parcel.is irregularly shaped and measures 85 feet along Orient Harbor. The" parcel runs 91.58:feet on the North side and 131.20 feet on the East side. 'The-Southeast corner of the parcel touches Village Lane(AKA Main Street). The_parcel then runs 128.95 feet on the South side before turning 35.17 feet on the Southeast side, and then turning for 42.12 feet on the South side. The parcel is accessed via private right of way known as Bay Lane which is located.on the_Western side of the parcel. The parcel:is improved with a two= story frame dwelling,with.a covered porch, an.accessory frame garage, and a.conerete/stone seawall. All is shown. on a survey by.Kenneth M. Woychuck,L.L.S. dated August 1,2017. BASIS OF APPLICATION: Request for Variance from Sections 280-124; and the.Building Inspector's:August 10, 2021 Notice.of,Disapproval based on an application-for a permit to demolish an existing accessory garage;.and elevate,relocate and construct'additions and alterations to an.existing single-family dwelling; at 1) located less than the code minimum required rear yard setback of 35 feet; located at 170 Bay Lane, (Adj. to Orient Harbor) Orient, NY SCTM# 1000-24-2-26.4. Page 2, February 17,2022 #7593, Bur-Tur SCTM No. 1000-24-2-26.4 RELIEF REQUESTED: The applicant requests a variance to make alterations and additions which include relocation and elevation of the single-family dwelling resulting in a rear yard setback of 3.8 feet where a minimum rear yard setback of 35 feet is required by Town Code. According to the applicant's representative, in order to make the dwelling FEMA and New York State compliant,the dwelling will be raised approximately three feet. ADDITIONAL INFORMATION: An existing accessory garage located .6 feet from the rear property line will be demolished. The applicant has the benefit of a Certificate of Appropriateness, dated November 19, 2020, issued by the Town's Historic Preservation Commission. The applicant's representative indicated that an Innovation Advanced Septic System is proposed. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 3, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law.§267-b(3)(b)(I). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of older single-family dwellings located on a private, gravel, single-lane road that runs along Orient Harbor. Most.of the lots are irregularly shaped and many homes have historic landmark designation and pre-existing non-conforming setbacks. the applicant has obtained a Certificate.of Appropriateness from the-Historic Preservation Commission forthe proposed construction and renovation which includes:elevating and relocating the existing.two story dwelling slightly to the:south-.which ' will remove a non-conforming 3.7-foot side yard setback., and adding a one-story master bedroom addition located so as to preserve the water view of the neighbor to the East of the applicant's rear yard. The proposed construction will conform to the town of Southold's maximum lot coverage requirements. 2. Town Law X267-b(3)M(2). The benefit sought by the.applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The lot is oddly shaped and is improved with a home that is pre-existing non-conforming. Any design scheme which includes preserving and/or.adding to the shape of the existing home will require the benefit of an area variance. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 90%relief from the code. However,the proposed setback is more conforming than the setback of the existing accessory garage which is being demolished,and the application is LWRP Consistent. 4. Town-=Law 4267-b(3-)(b)(4 No-evidence-has been submitted to suggest that a variance in-this-r-esidential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply.with Chapter 236 of the Town's Storm Water Management Code. The old septic system willbe' abandoned and anew IA wastewater treatment sanitary system is proposed which will improve the . environment. 5. Town Law §267=b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a FEMA compliant dwelling with additions while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Prior to receiving a building permit,the owner(s)of the subject property cited herein must sign a statement acknowledging: a. That the applicant(s)have read this determination and understand the limits of the variance relief granted herein; b. First, the overall site conditions relative to the surrounding community will not change substantially as a result of the project, particularly from the perspective of West Bay Avenue (aka Bay Lane), which is a private road situated between Village Lane and the undeveloped Orient/East Marion Park District lands to the northwest, along which there are only 8 other developed properties, just 6 of which are zoned R-40. The existing 2-story dwelling structure will be shifted roughly 6 feet to the south, closer to the center of the property, thus creating a conforming setback from the northerly side lot line; and a 1-story addition will be extended off the back of the dwelling, where it will be located in substantially the same location as the existing accessory garage to be removed. Second, while the removal of the accessory garage and relocation/expansion of the dwelling will result in the dwelling having a less conforming rear yard setback, all of the property's other preexisting zoning nonconformities will be eliminated, including the dwelling's 3.7-foot side yard setback and the accessory garage's 0.7-foot setback. Third, because most if not all of the properties along West Bay Avenue were, like the applicants', developed prior to adoption of the Town zoning code in 1957, many are similarly characterized by various zoning nonconformities, either preexisting or authorized via zoning relief. For example, setback or lot coverage relief has allowed for residential renovations to 3 of the other 6 waterfront single-family dwellings, including those located at 300 West Bay Avenue (Case No. 4774), 600 West Bay Avenue (Case No. 5373), and 680 West Bay Avenue (Case No. 2738). As proposed, the southerly edge of the addition will be located only 4 feet farther south than that of the existing garage. If the relocated dwelling—even without an addition—were relocated farther to the south(where it would be more centered on the property), a greater rear yard setback could be achieved, but then the project would cause a potential detriment to the neighbor because of the impact it would have on their water views. The adjacent property owner to the west should benefit from the project, as the existing dwelling will be relocated from a 3.7-foot setback from their property line to a code- compliant 10-foot setback; and the adjacent property owner to the south should be unaffected by the project. 2. The existing dwelling, whose original construction pre-dates the adoption of Town zoning code in 1957, is an aging structure with long overdue needs for structural repairs,upgrade of mechanical systems, and replacement of deteriorating siding, roofing, windows, and insulation. It also needs to be elevated by approximately three feet to make it compliant with the minimum base flood elevations required by FEMA and New York State. Nevertheless, the applicants made a substantial investment in the property for the purpose of making it their primary, year-round residence. To make that possible, however, the first floor footprint of the dwelling requires expansion to provide a ground level master bedroom for the owners, one of whom will soon be celebrating an 80th birthday and needs to avoid stairs. But due to the limited depth of the property, it is not possible for the applicants to expand the dwelling footprint as desired without the benefit of variance relief. Because unlike all of the other waterfront parcels along West Bay Avenue, which have minimum lot depths ranging from 132 to 231 feet, the subject parcel has a depth of only 92 feet,making it the shallowest parcel by 40 feet. And because the private roadway traverses the most seaward portion of the parcel, an in-fact distance of only 73 feet remains between the roadway and the rear lot line. Thus, it is not feasible to position a reasonably sized dwelling structure on the parcel that would both maintain a reasonable distance from the traveled roadway and meet the required rear yard setback. 3. The required 31.2 feet of rear yard setback relief is mathematically substantial, constituting 89 percent of relief from the required 35-foot rear yard setback. However, because the existing garage structure is currently located only 0.6 feet from the rear lot line, the proposed 3.8-foot setback to the 1-story addition constitutes a 533 percent increase in the distance from the nearest structure to the rear lot line.
