Overview of Unique Circumstances In 1983 David Cooper left this property to his children, split into the lots shown on the map submitted with this application. The will was prepared in the 1970's. At the time the will was prepared, properties were allowed to be split this way, via a will and deeds. By the time the will had to be used, the Town Code was such that splitting lots by deed was no longer permitted. A subdivision application was required to create recognized lots after 1983. At the time it was also the policy of the Planning Southold Planning Department Staff Report Board to require fifty percent of the land be preserved as open space (either farmland or woodland). This did not fit the intent of the will, and the farm remained as one parcel since then. The beneficiaries of the will are seeking to subdivide the property along the lines shown in the will to create three smaller parcels of roughly similar size. All three lots will be greater than 7 acres and would be subject to clustering and open space requirements if subdivided in the future. This would require a waiver of the clustering and open space requirement for this split. The main issue with this concept is preventing this from setting an unwanted precedent that undermines the clustering and open space requirements for future subdivisions. We have listed the unique circumstances present in this case that would prevent this from creating a precedent for all but the most similar situation. These circumstances are as follows: 1. The land was willed to heirs in a will executed prior to 1980; and 2. the subdivision lots as proposed are the same as the lots described in the will; and 3. the land has been kept in active agriculture since the time the will was created (including land kept fallow as part of crop rotation); and 4. at least one heir is actively farming the land at the time of the subdivision application. We have listed the unique circumstances present in this case that would prevent this from creating a precedent for all but the most similar situation. These circumstances are as follows: 1. The land was willed to heirs in a will executed prior to 1980; and 2. the subdivision lots as proposed are the same as the lots described in the will; and 3. the land has been kept in active agriculture since the time the will was created (including land kept fallow as part of crop rotation); and 4. at least one heir is actively farming the land at the time of the subdivision application.
