' I FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 5,2021 at which time written and oral,evidence were pesented. Base upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,grid other evidence,the Zoning Board finds the following facts to,be true and relevant and makes the following findings: i 1. Town Law&267-b(3)M(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a waterfront neighborhood consisting of single-family homes on large lots. Theeighborhood is accessed via a private right of way and is not visible from a public street. The lot is a large lot and the proposed section of 6-foot-high fence is set back 408.75 feet from the front property line. 2. Town Law 4267_b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than area variance. The six (6)foot high fence will provide privacy from the adjacent neighbor's house for the swm�ing pool along a,section of the side property line, and is necessary, due to large trees in that area that crate too much shade to perm t.,the planting of evergreen screening. Any fend over 4 feet in height•will require t ,&ben6fit of an area variance. 3. Town Law 4267-6(A)(bK .
