Present were: John Stein, Chairperson Carol Brown, Member John Chandler, Member Maggie Merrill, Member Brian Mealy, Town Board Liaison Liz Gillooly, Trustee Liaison Lauren Standish, Secretary Absent: Shannon Wright, Member Caroline Burghardt, Member CALL TO ORDER John Stein called the meeting to order at 4:35PM. Chairperson John Stein welcomed Brian Mealy, Town Board Liaison and Liz Gillooly, Trustee Liaison, to the CAC. As the new liaisons, Brian and Liz shared their willingness and support in assisting the CAC with their goals in improving and expanding their mission as a council, and the importance of the current mission statement and coordination with the other town departments and agencies. One of the priorities of the CAC is to address the limitations of the Town's wetland code. Currently, buffers are discretionary and the CAC cannot support anything that doesn't fit within the code. It was suggested that the code committee meetings be restructured to include input from the CAC. i 2 REPORTS Carol Brown attended the Board of Trustees meeting held on Wed., December 15, 2021. Carol expressed her frustration with applicants submitting revised plans to the Board of Trustees for the public hearing after the CAC inspects the property and submits their recommendations, which are based on the original plans. Carol noted that the two (2) applications for amendments were denied. APPROVAL OF MINUTES Moved by Maggie Merrill, seconded by Carol Brown, to Approve the Minutes of December 8, 2021. RECOMMENDATIONS -WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by John Stein, seconded by Carol Brown, it was RESOLVED to SUPPORT the application of LEFKARA HOLDINGS, LLC c/o NEOFITOS STEFANIDES for the installation of 68 If. rock revetment at toe of existing eroded bluff to replace existing temporary sand bags, install 60 cy. of clean sand fill and Cape American Beach grass on entire bluff to protect property against additional storm erosion. Located: 1070 The Strand, East Marion. SCTM#30-2-77 Inspected by: John Stein, Carol Brown The CAC Supports the application with a CEHA management plan. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by John Stein, it was RESOLVED to SUPPORT the application of JOHN KREPP & MARGARET KREPP to construct a second-story addition over existing dwelling, 12.3'X 17.9' deck, existing bulkhead 57 If., and new drywell in front yard. Located: 1235 Island View Lane, Greenport. SCTM#57-2-42.8 Inspected by: John Stein, Carol Brown The CAC Supports the application with an I/A septic system and the size of the deck is reduced to be in compliance with Ch.275 of the Town Code. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by John Stein, it was RESOLVED to SUPPORT the application of PORT OF EGYPT BOAT STORAGE LLC PROPERTY c/o WILLIAM LIEBLEIN to legalize existing clearing along eastern portion of • 3 the subject property (8,260 sf.) and by establishing a 10' vegetated buffer area landward of the existing top of bank. Located: 63125, 63285 Route 25, Southold. SCTM#56-4-13.3&14 Inspected by: John Stein, Carol Brown The CAC Supports the application with a 15' non-turf buffer planted with native vegetation. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by John Stein, it was RESOLVED to NOT SUPPORT the application of MKS REALTY, LLC to construct a new two-story frame house and garage, together with associated site improvements including a pool, deck, shed, electric service, public water service, sewage disposal system, and stone blend driveway. Located: 1925 North Sea Dr., Southold. SCTM#54-4-20 Inspected by: John Stein, Carol Brown The CAC does Not Support the application. There is a concern with the proposed project being located within a primary dune and FEMA flood zone, and the swimming pool should be located on the landward side of the dwelling. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by John Stein, it was RESOLVED to SUPPORT the application of EDWARD & MEREDITH RERISI to construct a covered porch 50 sf., covered porch 80.5 sf., proposed addition 674 sf., proposed pool, 4' pool enclosure fence, pool equipment with screening, and a proposed rear stoop 51 sf. Located: 1515 Calves Neck Rd., Southold. SCTM#63-7-37 Inspected by: John Stein, Carol Brown The CAC Supports the application with all construction landward, and red maples and oak trees to remain. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by John Stein, it was RESOLVED to SUPPORT the application of COVE CONDOMINIUM OWNERS ASSOC. to clear and regrade a non-wetland vegetated area of approx. 12,750 sf. Replant with native grass and install approx. 630 If. of split-rail fence along seaward edge of clearing area. • 4 Located: Cove Condominiums, 305 Main Bayview Rd., Southold. SCTM#87-5-26 Inspected by: John Stein, Carol Brown The CAC Supports the application, however, requests careful selection of trees to be removed and to leave some of the cedar trees in place. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by John Stein, it was RESOLVED to SUPPORT the application of DAVID & BARBARA HAZARD to construct a 4'X 12' fixed dock extension (48 sf.) with thru-flow decking. Reface existing bulkhead approx. 100 If. and average 3' in height (300 sf.) with 2"X 10" T&G HDPE dimensional lumber with 8" dia. pilings set 6' on center for additional support. Located: 1465 Harbor Lane, Cutchogue. SCTM#103-2-1.1 Inspected by: Carol Brown, John Stein The CAC Supports the application and noted that the subject property is an ideal location for a living shoreline project. Vote of Council: Ayes: All Motion Carried Moved by Maggie.Merrill, seconded by John Stein, it was RESOLVED to NOT SUPPORT the application of JOHN MILTAKIS, TRUSTEE for the as- built untreated trex decking along bulkhead, walkways to the house of various dimensions, patio, planter/bench, and stone steps. Maintain walkway in 10' buffer with Y2" spacing between boards to allow adequate drainage. As-built deck, proposed first-floor rear addition, proposed second-floor garage addition, proposed garage expansion, proposed front covered stoop, and proposed first-floor front entry addition. Located: 1460 Strohson Rd., Cutchogue. SCTM#103-10-29.1 Inspected by: Maggie Merrill The CAC does Not Support the application for the as-built structures and recommends a drainage plan. Vote of Council: Ayes: All Motion Carried Moved by Maggie Merrill, seconded by John Stein, it was RESOLVED to NOT SUPPORT the application of STEVEN & DANIELLE PORTO to move existing/permitted 12.5'X 9.5' deck located landward of top of bluff approx. 25' north, attached to top landing/deck, with stairs to second landing, stairs to landing with bench, 5 stairs to landing to stairs to midway deck with bench, to stairs to landing with bench, to stairs to landing at top of retaining wall with stairs to 450 sf. deck between retaining wall and bulkhead with cantilevered platform between top of bulkhead. Retractable metal stairs to beach to include a mechanical hoist plus electric at midway deck and bulkhead deck, plus water to bulkhead deck. All stairs and landings/decks to include handrails plus fall protection barrier at mid-height between stairs and railings. Located: 4875 Nassau Point Rd., Cutchogue. SCTM#111-9-10 Inspected by: Maggie Merrill, John Stein The CAC does Not Support the application. The sizes of the upper and lower decks are not in compliance with Ch. 275 of the Town Code. Vote of Council: Ayes: All Motion Carried Moved by Maggie Merrill, seconded by John Stein, it was RESOLVED to NOT SUPPORT the application of ROGER SIEJKA to construct a two- story single-family dwelling with a basement. First floor is 24.5' wide 50' deep. Front porch is 11' wide, 6'2" deep. Rear veranda is 24'5" deep. Overall max. height is 32'3". Located: 955 Blossom Bend, Mattituck. SCTM#115-6-22 Inspected by: Maggie Merrill The CAC does Not Support the application because the proposed setbacks are not in compliance with Ch. 275 of the Town Code. The proposed dwelling should be setback at least 100' from the wetland boundary, the requirement of an I/A system, and an impervious driveway. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Carol Brown, it was RESOLVED to NOT SUPPORT the application of STEPHEN DUBON & JACQUELINE DUBON to construct two first-floor additions and a second-story addition to an existing one-story frame house; construct a second-story balcony; abandon existing sewage disposal system and construct new I/A septic system; and expand existing wood deck. Located: 5605 Stillwater Ave., Cutchogue. SCTM#137-4-3.2 Inspected by: John Stein, Carol Brown The CAC does Not Support the application, as submitted. There is not enough information to make a determination, and there are insufficient setbacks. Vote of Council: Ayes: All Motion Carried 6 Moved by Maggie Merrill, seconded by John Stein, it was RESOLVED to SUPPORT the application of LYLE GIRANDOLA & KATHLEEN GIRANDOLA to demolish and remove an existing 1'/2 story frame house, removing a portion of an existing driveway, and abandoning an existing sanitary system. Construct a new two-story dwelling, front porch, rear balcony, electric service, public water service, sewage disposal system (IAOWTS), driveway, and stormwater control structures for roof run-off and driveway run-off, and renovation of existing frame garage. Located: 3040 Peconic Bay Blvd., Laurel. SCTM#128-6-10 Inspected by: Maggie Merrill The CAC does Not Support the application because the proposed setbacks are not in compliance with Ch. 275 of the Town Code and there is room to move the structures further landward. Vote of Council: Ayes: All Motion Carried JENNIFER LEUBA & VICTOR HOU for the installation of steps down bluff consisting of 4'X 8' upper platform, 4'X 13' steps, 4'X 4' platform, 4'X 13' steps, 4'X 4' platform, 4'X 12' steps, 6'X 8' platform with benches, 4'X 12' steps, 4'X 4' platform, 4'X 13' steps, 4'X 4' platform, 4'X 13' steps, 4'X 4' platform, 4'X 13' steps, 4'X 4' platform and 4'X 13' steps to beach. Located: 950 Red Fox Rd., Mattituck. SCTM#106-1-23.1 The CAC did not make an inspection, however, the plans were reviewed and it was noted to recommend retractable aluminum stairs at the base. Vote of Council: Ayes: All Motion Carried WALTER HELLIER to remove an existing open porch on the water side of the house. In its place, construct a new one-story addition of 337 sf. and a new screened porch of 267 sf., with new stairs down to grade. Existing covered porches on-landward side of additions are in poor repair and will be rebuilt. Located: 227 Hedge St., Fishers Island. SCTM#10-7-20 The CAC did not make an inspection, however, the plans were reviewed and it was noted that the proposed addition is not in compliance with Ch. 275 of the Town Code. RECOMMENDATIONS-AMENDMENTS TO WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS I A 7 Moved by John Stein, seconded by Maggie Merrill, it was RESOLVED to NOT SUPPORT the application of SAMUEL J. DIMELGIO, JR. to Amend Wetland Permit#9454 for the as-built water side trex-type deck with W spacing in lieu of thru-flow decking open grate deck, existing 5'X 9.2' wood staircase on west side of subject property; existing water side trex-type staircase 7.5' X 10', to ground below; existing front platform 6'X 5' with stairs 5.3'X 4.6' to ground below; approval of landscape plan for planting of 3" caliper trees and other vegetation in designated 50' wide non-disturbance buffer area. Located: 2280 Deep Hole Dr., Mattituck. SCTM#123-4-6 Inspected by: Maggie Merrill The CAC does Not Support the application with the as-built materials on the structures. It is recommended the structure be reconstructed as originally authorized. Vote of Council: Ayes: All Motion Carried John Stein will attend the next Board of Trustees meeting scheduled for Wed., 'January 19, 2022. The next meeting of the Conservation Advisory Council will be held on Wed., February 9, 2022 at 4:30PM in the Conference Room.
