ADDITIONAL INFORMATION: Three letters of support for this application have been received to the Zoning Board of Appeals. The applicant wishes to make alterations for a first-floor mud room,adding a first-floor bathroom at the rear of the dwelling and a second-floor rear-dormer addition. The proposed rear dormer will only add 220 square feet of habitable space to the second floor. To minimize the appearance of the dormer, the south facing exterior wall will be 6 ft.3in.high lower than the standard 8-foot wall height. The existing roof ridge line will remain as is without being raised. The new one-story addition will be 69 square feet in area. The existing lot coverage measures 25.2% and the proposed addition will measure 26.8%, a difference of 1.6%. The house was built in the late 1920's. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 1,2021 at which time written and oral evidence were presented. Theproperty is well screened with vegetation and partially fenced in along the side and rear yard where the proposed addition will be located. 2. Town Law&267-b(3)(b)(2). The benefit sought by the applicant or cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance. The dwelling and the lot size are existing and quite small by today's standards. The applicant wishes to make the residence more functional and slightly larger to accommodate their growing family. It is currently a two-bedroom dwelling and the applicant wishes to add a third bedroom. The existing lot and dwelling pre-date existing zoning regulations so variance relief is required. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 11%relief from the code for front yard setback, 50% relief from the code for side yard setback, 28.5% relief for the rear yard setback, and 34% relief from the code for lot coverage. However, because the lot and dwelling pre-date the zoning ordinances the applicant's architect has minimized increases to the pre-existing non-conforming footprint with only a 7.4 ft. x 9.5 ft. one story addition which will only add 69 square feet to the dwelling located in the rear yard where it will not be seen from the street or by adjacent neighbors, and the proposed shed dormer on the rear will add headroom to allow habitable space in the existing half-story and is also characteristic of the style of other homes in the neighborhood. 4. Town Law V67-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created.
