This is an interior-mounted facility and, as such, the equipment is not visible from the outside. The existing AT&T antennas have a total overall elevation of thirty-eight (38) feet above ground,which would not change. The total elevation of the Steeple including the top-mounted cross is sixty-six feet one inch (66' 1") above ground, see Figure 1. AT&T plans to replace the three (3) existing panel antennas with similar antennas, replace three (3)Remote Radio Heads (RRH) and add six (6) new RRHs, leaving a total of nine (9) RRHs in the proposed steeple layout. Also, one (1) Raycap DC6 "Squid" surge suppressor will be added to the Gamma Sector mount. Regarding the ground-based equipment, two (2) GSM cabinets and one (1) RxAIT multicoupler rack will be removed from the equipment room located in the Church basement and additional ancillary equipment will be installed in the basement, see Figure 2. The purpose of the upgrade is to improve AT&T's LTE service from this location. The facility's location is Our Lady of Grace Church and is physically located at Oriental and Ettrick Avenues in the Town of Southold, see Figure 3. The proposed antenna and RRH equipment changes (see Figure 4) are within a Church Steeple and will not be an overload concern, since the equipment is not exposed to the outdoors and thus does not have a windload impact. The only potential structural consideration would be the deadweight of the components which is minimal. The Applicant supplied Radio Frequency (RF) exposure calculations to assure compliance with all FCC standards regarding human exposure to RF energy. The Applicant's equipment will operate in the 700, 850, 1900 and 2100 MHz bands but should not be an interference concern to the Town's public safety communications. The Applicant is required to state they will comply with FCC interference rules and the FCC rules regarding human exposure to radio frequency energy. This was not submitted with the subject application but was timely provided by the Applicant at CityScape's request, see Figure 5. January 23,2020 Telecommunications Site Review Page 2 Interior-Mounted Facility Upgrade Cityscape has determined that this application qualifies for streamlined processing at staff level under Section 6409(a) of the Middle Class Tax Relief and Job Creation Act of 2012 (the"Act") and the FCC rules implementing the Act, to wit: 1) The modification would not increase the height of the supporting structure; 2) The modification would not cause any equipment protrusion outside the Church exterior; 3) All Applicant's existing and proposed ground equipment will be housed in the existing equipment room in the Church basement, and the floor area will not be increased; 4) The project does not entail any excavation in the area surrounding the supporting structure or any utility easements related to the site; and, 5) The project would not defeat the concealment elements of the supporting structure. The contractor photos(sent 7/29/2020)were evaluated against the approved 2/19/2020 Rev 1 Construction Drawings.Further photos of fire-stopping were sent to us on 2/9/2021,and additional photos of the fire- stopping were taken on 5/20/2021 during an inspection with a representative of the Southold Building Department,and these were sent to us as well.Note that in my opinion,while the added fire stopping will improve fire safety,we have analyzed the height and area limitations for Type V-B construction and find that the A-3 (church)and B(telecom)use groups do not need to be separated by a rated enclosure. Based upon our review of the submitted photos,and to the best of our belief and knowledge: • All work has been completed in accordance with our approved Construction Drawings,Building Permit#44706,and the NYS Building Code. • The fire-stopping that was added by the contractor,as requested by the Building Department,seals any and all air gaps in the enclosure assemblies around AT&T's equipment room. This is an interior-mounted facility and, as such, the equipment is not visible from the outside. The existing AT&T antennas have a total overall elevation of thirty-eight (38) feet above ground, which would not change. The total elevation of the Steeple including the top-mounted cross is sixty-six feet one inch (66' 1") above ground, see Figure 1. AT&T plans to replace the three (3) existing panel antennas with similar antennas, replace three (3) Remote Radio Heads (RRH) and add six (6) new RRHs, leaving a total of nine (9) RRHs in the proposed steeple layout. Also, one (1) Raycap DC6 "Squid" surge suppressor will be added to the Gamma Sector mount. Regarding the ground-based equipment, two (2) GSM cabinets and one (1) RxAIT multicoupler rack will be removed from the equipment room located in the Church basement and additional ancillary equipment will be installed in the basement, see Figure 2. The purpose of the upgrade is to improve AT&T's LTE service from this location. The facility's location is Our Lady of Grace Church and is physically located at Oriental and Ettrick Avenues in the Town of Southold, see Figure 3. The proposed antenna and RRH equipment changes (see Figure 4) are within a Church Steeple and will not be an overload concern, since the equipment is not exposed to the outdoors and thus does not have a windload impact. The only potential structural consideration would be the deadweight of the components which is minimal. The Applicant supplied Radio Frequency (RF) exposure calculations to assure compliance with all FCC standards regarding human exposure to RF energy. The Applicant's equipment will operate in the 700, 850, 1900 and 2100 MHz bands but should not be an interference concern to the Town's public safety communications. The Applicant is required to state they will comply with FCC interference rules and the FCC rules regarding human exposure to radio frequency energy. This was not submitted with the subject application but was timely provided by the Applicant at CityScape's request, see Figure 5. Section 6409 of the Federal Middle Class Tax Relief and Job Creation Act("Section 6409")was adopted in 2012. Under Section 6409,your city retains discretionary zoning review over the construction of new towers,but simple collocations and/or equipment upgrades at existing telecommunications facilities must be approved. The new law provides that: "a State or local government may not deny,and shall approve,any eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station." (Emphasis added.) The federal law defines an"eligible facilities request"as"(A)collocation of new transmission equipment; (B) removal of transmission equipment; or(C)replacement of transmission equipment." (Emphasis added.) Also,the Federal Communications Commission issued a Wireless Infrastructure Report and Order on October 17,2014 ("FCC Order")which established regulations that clarify and streamline the municipal approval process for eligible facilities requests under Section 6409.A copy of the FCC Order is enclosed herewith. The FCC Order clarifies that municipal review of an eligible facilities request is limited to determining whether the request falls within Section 6409: "a State or local government may require the applicant to provide documentation or information only to the extent reasonably related to determining whether the request meets the requirements of this section[Section 6409]. A i State or local government may not require an applicant to submit any other documentation,including but not limited to documentation intended to illustrate the need for such wireless facilities or to justify the business decision to modify such wireless facilities."47 C.F.R. 1.40001(c)(1)(Emphasis added). The FCC Order also specifies that the term"base station"includes any structure that"supports or houses" communications equipment. Since this structure already supports communications equipment,it is considered a"base station"under Section 6409 AT&T's Application is an Eligible Facilities Request under Section 6409 AT&T's application qualifies as an eligible facilities request under Section 6409 because the proposed installation involves"a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station." The existing Church currently has AT&T inside the steeple. As shown on the plans prepared by Salient Architects LLC dated November 18,2019 AT&T's proposed installation consist principally of the following elements: AT&T will be swapping three(3)existing panel antennas and swapping three(3)existing RRH units and adding six(6) new RRH units on existing mounts within AT&T's leased area inside the existing Church Steeple.AT&T will be swapping related equipment inside of its leased premises.AT&T is not increasing the size of the leased premises. Accordingly,AT&T's installation involves the collocation of new transmission equipment that will not increase the height of the base station. As a result,the installation"does not substantially change the physical dimensions of such tower or base station." Therefore,these proposed equipment upgrades constitute an"eligible facilities request" under Section 6409,and must be approved Timeline for Review and Approval We would like to highlight an important timing requirement for processing this application. The FCC Order determined that a municipality must act on an eligible facilities request within sixty(60)days of receiving the application. 47 C.F.R. 1.40001(c)(2)(Emphasis added). (Note,the sixty(60)-day period is also known as the"Shot Clock"). Thus,the city must approve this application within sixty(60)days of its receipt. The FCC Order provides that upon a municipality's failure to act prior to expiration of the Shot Clock,the"request shall be deemed granted"and AT&T will be legally entitled to proceed with construction. 47 C.F.R. 1.40001(c)(4)(Emphasis added). Note that the FCC Order does allow the Shot Clock to be tolled if an application is incomplete. However,in order to do so,a municipality must provide written notice that the application is incomplete within thirty(30)days of the submittal. 47 C.F.R. 1.40001(c)(3)(i). The notice must"clearly and specifically"describe the missing documents or information,47 C.F.R. 1.40001(c)(3)(i),and,as previously mentioned,such documentation must be necessary to the determination of whether the application qualifies as an eligible facilities request. If the municipality requests additional information after the first thirty(30)days have passed,we will still provide any"reasonably related" information allowed under the FCC Order,but the Shot Clock will not be tolled.
