LAND PRESERVATION COMMITTEE MEETING
Minutes & Discussion Notes from Meeting held
Tuesday, January 25, 2022 at 7:00 p.m.
This Regular Meeting was held via the Zoom online platform.
The public had access to view and listen to the meeting as it was happening via Zoom. If no access to a computer or
smartphone, there was an option to listen in via telephone.
Comments from the public may not be solicited nor received without an appointment. It is expected that the Committee will
enter into Executive Session* at some point after opening the Regular Meeting for the purpose of discussing applications
regarding proposed acquisitions of real property where publicity would substantially affect the value thereof. The public is not
allowed to attend, view, or listen to Executive Session.

The meeting began at 7:02 p.m. with five LPC members present.
LPC wished LPC Secretary Melanie Doroski a happy retirement and thanked her for her years of service
to the Land Preservation Committee.
Committee Minutes and Administration
Acceptance of LPC meeting minutes from January 11, 2022
MOTION made by Sam McCullough, seconded by Anne Murray, to accept the 1/11/2022 LPC meeting
minutes.
Motion carried: 4/0/1 (LPC member John Simicich could not vote as absent from 1/11/2022 LPC
meeting)
Next Regular LPC Meeting Date
The next regular meeting is scheduled for Tuesday, February 8, 2022 and will be held via the Zoom
online platform.
Inquiries for Uses or Structures on Preserved Property

Request for parking within Town PDR
MOTION made by Sam McCullough, seconded by Anne Murray, that the Land Preservation Committee
has reviewed the recorded Development Rights Easement, the October 19, 2021 letter from Stephen F.
Kiely, Esq., and the information presented by Stephen F. Kiely, Esq. at the October 26, 2021 Land
Preservation Committee meeting. The Committee finds that the proposal, to use and make
improvements within the area subject to the recorded Easement for a parking area, are not in
conformance with the terms of the recorded easement. The Committee directs Land Preservation
Coordinator Melissa Spiro to send the letter dated January 25, 2022, outlining the reasons for this
finding.

Stephen Kiely, Esq., representing the landowner, expressed his disappointment in the timeframe it took
necessity for a
parking area was desired. LPC Chair explained that not only their review was required but legal review
was necessary for this application.

Request for improvements on property subject to Town PDR
MOTION made by Sam McCullough, seconded by Anne Murray, that the Land Preservation Committee
has reviewed the recorded Development Rights Easement, the application dated November 17, 2021,
the site plan (dated 9/1/2021 and 9/8/2021) and the 1/11/2022 presentation to the Committee. The
Committee finds the proposed use and improvements to be in conformance with the terms of the
recorded easement. The Committee directs Land Preservation Coordinator Melissa Spiro to send the
letter dated January 25, 2022, with additional information regarding this finding.

Request for improvements on property subject to Town PDR
Shortly before the meeting started Melissa Prinicipi sent an e-mail including additional pictures and
explanations of the plans for the property. Melissa Principi asked to speak at the meeting and shared her
Zoom screen to present the information contained in the e-mail including: site plan with existing
conditions; site plan with proposed subdivision; proposed subdivision with all structures explained; copy
of approved riding academy site plan; explanation of site modifications, proposed site work pictures,
aerial photo of existing site picture.
Richard Principi Jr. noted that some aspects of the proposed plans being shown were still being
reviewed; he added that the barn may be re-purposed to a residence, this had yet to be determined, and
that he was originally going to do a potato barn style for hay and equipment storage, but that
improvement was now going to be fabric. He was also still reviewing whether to continue with horses or
to just increase the hay acreage to 18 acres.
Mr. Principi noted that the farm roads need to be improved and that he wishes to create all year round
farm roads. He showed a picture of the type of material (recycled stone aggregate and soil) that he
proposed to use to establish the farm roads, shown on the site plan throughout the property.
It was noted by Committee members that this type of road improvement is not typical of farm roads, and
that excavating soil and filling it in with concrete may not be consistent with the easement as this takes
the land out of agriculture. Mr. Principi said that he would address the roads when the property dries up.
Mr. Principi explained that water sheds from adjacent farms and the subject property and that he wished
to make a clay lined pond feature and to install subsurface drainage to help with the drainage on the site.
He will include a sanitary plan on a survey for review. It was suggested that they pursue review by
NRCS/ soil and water conservation district regarding drainage plans.
Mr. Principi asked if he could proceed with clearing and chipping of the hedgerow to neaten up the
property and to gain back about 2 acres of farmland.
The Committee was not prepared to conclude whether the proposed improvements were in conformance
with the easement and will continue review of the information presented at the meeting and will await
additional plans from Mr. Principi, including more specific drainage plans.
