covered screened porch in the front of the residence and a roof over the wood deck in the rear of the residence.

BASIS OF APPLICATION: Request for Variance from Article III, Sections 280-15 and the Building Inspector's
February 24, 2020 Notice of Disapproval based on an application to legalize as built additions to an existing single-
family dwelling; at 1) existing accessory garage located in other than the code required rear yard; located at 870
Bay Home Road, Southold,NY. SCTM No. 1000-56-5-2.
RELIEF REQUESTED: The applicant requests a variance for a permit to legalize an existing two car garage after
the "as built" addition to the house places the garage in the side yard. The proposed construction is not permitted
pursuant to Article III, Section 280-15, which states, "accessory buildings and structures or other accessory uses
shall be located in the required rear yard".

ADDITIONAL INFORMATION: The existing residence pre-dates zoning. The existing deck was constructed in
1984, replacing a previously existing wooden deck. The original 9-foot x 8-foot deck was built in 1946, and
replaced. with no building permit and was constructed with no footings between 1965 and 1968.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on September 3,2020 at which time written
and oral evidence were presented. Based upon all testimony;-documentation,personal inspection of the property
and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. The existing deck was constructed in 1984, replacing a
previously existing wooden deck. The original deck was replaced with no building permit and was constructed
with no footings. The applicant would like to rebuild the deck in kind and in place with proper footings.Although
the house and garage are existing, the location of attached "as built" deck and its reconstruction in place and in-
kind places the existing garage partially in the side yard,
2. Town Law,4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue,_-other than an-area variance. The previous decks were built without permits, The-deck
will be rebuilt in kind and in place, but its,existence places the garage in the side yard, not the rear yard,"thus the-
need for a variance.

applicant must comply with Chapter 236 of the Town's Storm Water Management Code.
