Located: 450 Maple Avenue, Mattituck. SCTM#: 1000-107-3-4.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with Policy Standards and therefore is INCONSISTENT with the LWRP. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions The work was performed without obtaining a Wetlands Permit. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. Spoke with Darlene Defabio @ (631)444-0295. Discussed removing a dead tree approximately 90 feet from the mean high-water line. Also discussed pruning of several trees of dead limbs and the establishment of a path of wood chips to allow access to creek for kayaks. She commented this this should not be a problem. She commented that the full clearing of a property that is 300 feet from the water is a problem and is not permitted. November 2020—Removal of Dead Tree, Pruning of Trees Removed dead tree approximately 90 feet from mean high-water line. Pruned trees whereby most trees had dead limbs on property, and several were within 100 feet from mean high-water line. Cut up large sections of trees for firewood and chipped all limbs that were cut. Moved pile of wood chips via wheelbarrows to 10 feet from mean high water line to establish path to allow access to creek. February 2021-Placement of Woodchips Moved woodchips via wheelbarrow on wetlands to establish 4-foot-wide access path to creek shoreline. May 1,2021-Receipt of Ticket-Summons B0074 Met with Bay Constable Officer Joseph O'Leary. Received ticket for court appearance. Ticket claims"move dirt, cut and prune trees in wetland area without first obtaining a permit." Please note that NO DIRT WAS MOVED... ONLY WOODCHIPS WERE MOVED. This can be evidenced by the inspection of property. May 20,2021-Applied for Wetland Work Permit Applied for permit along with fee for removal of a tree, pruning of limbs, and establishment of path in wetland area (within 100 feet from mean high water line). As per Diane of the Town of Southold at(631) 765-1892,we should determine from court appearance what is necessary as this is an "after the fact" action. June 16,2021-Court Date Pleaded not guilty to Summons 80074. Per discussion with Mr. Damon Hagan,Assistant Attorney for Town of Southold, an application for an Administrative Permit should be requested for the removal of the dead tree, pruning of limbs, and for the access path made of woodchips as per Section 275-11-10 of the Town Code. As part of this discussion, I reviewed the details and dates in this narrative along with the survey.
