Due to changes at our property,this letter is-a request to returntto our original
pool/patio plan (PLAN A) submitted to the BOT at the December 21,2020,
meeting.This plan was tabled at that meeting and another plan, (PLAN B),was
approved at the January,2021,BOT meeting. Details follow.
After consulting with Jason Peters of North Fork Pools in late fall of 2019,we
decided to construct a patio/pool adjacent to our home.Joan has suffered from
arthritis of the spine for the last 15 years,and swimming is the best,low impact
exercise therapy she can have.This is our primary reason for building a pool.
Jason Peters recommended we retain Mr.Robert Herrmann of EN-Consultants to
manage the permitting process for our pool/patio plan,as there were significant
challenges with permitting on the-waterfront,and we wanted to expedite it as best
we could.After almost a year of plans and surveys drawn and re-drawn(COVID
definitely made everything more challenging),and a pre Dec. 21,2020, BOT site visit,
Mr.Herrmann submitted our plan (PLAN A attached).
To our dismay,Plan A was tabled at that meeting.There was concern about the
number of trees to be removed,which was five (5).While the removal of only three
(3) trees was necessary for this project,we felt the other two trees would give some
breathing room to the project Even though we offered to replace said trees with
new trees,a particular"older tree"seemed to be a significant enough sticking point
Post meeting,Mr.Herrmann advised us to reduce the number of trees to be cut
down,and to leave the'older tree"intact in our next plan iteration.This would
require a complete change of location for the project. (FYI, DEC had already
approved the location of this project)
After several more weeks of planning,the continued service of Mr. Herrmann,
several more visits to surveyor Nate Corwin,and the hiring of a consulting
landscape architect,we devised another plan. Although not without issues,Plan B
was submitted to the BOT for approval.
PLAN B moved the pool back(north) about 12 feet,which now positioned forward
of the front wall of the house,and changed the orientation so it was parallel to
Luptons Point Rd. It also pushed the project very close to the 1929 contour line,
thereby creating construction concerns for the contractor. This location also placed
the pool in front of the house and no longer in our backyard,where,logically,we
would like to have our patio and picnic table and where we spend all our time.
Furthermore,this location has a significant elevation change,again causing
increased construction costs and design challenges.It was far from an ideal location,
but because of the contour line we found ourselves with little buildable space on the
side of our home.But,PLAN B did address the trustees concern about the
number of trees to be removed and, most importantly,it saved the 'older tree."
Fast forward to June 29,2 02 1,last Tuesday,when our tree service was here to
remove and prune the trees for the pool project. The two trees that we were
permitted to remove were cut down and other tree pruning was taking place.The
trimmer was pruning a large branch from said"older tree,"which hung perilously
close to our roof,when he was set upon by carpenter ants. He informed us of the
severe infestation and damage to the tree and advised tree removal.
We immediately called the BOT office and spoke to Elizabeth about our predicament.
Elizabeth contacted our trustee, Mr. Goldsmith.Fortuitously,Mr.Goldsmith was in
our vicinity and made a site visit shorty thereafter. Seeing the tunneling damage
and tree infestation,Mr.Goldsmith gave us permission to remove the tree. A copy of
his approval is attached to this application.
IMPORTANT SIDE NOTE:
A great deal of time,effort and cost went into PLAN A,our original plan,to insure
we complied with the rules and regulations of the various agencies governing the
project. Taken side by side,we feel PLAN A is far superior to the subsequent plan
(Plan B),which had to be put together quickly to meet BOT hearing deadlines.
Now that the diseased "older tree"has been removed,the impediment to
constructing the pool as per our original plan,PLAN A,no longer exists.
THEREFORE,we are respectfully requesting that we be permitted to return to
our original plan,PLAN A.
In conclusion we are requesting that our original PLAN A be approved for the
construction of our patio/pool for the following reason:
1) Only two (2) trees have been removed for this project,and now the third
diseased "older tree."
2) It conforms to all related regulations and has been approved by DEC.
3) It provides a buffer between the house,pool, contour Iiemaining-�-��, r

4) It does not change the footprint or scope of the project area but rather
provides for better utilization of available space within the project area.
5) The elevation changes are less severe thereby reducing the necessity for
costly retaining walls,railings and disturbance of the natural contour of the
property.
6) The patio is better positioned for access to and from the house.
7) We really want to get this pool done for Joan's physical therapy.

and 4' wide steps), raised up to approximately 24 inches above existing grade with "geogrid"
retaining wall; install pool enclosure fencing, pool equipment, and pool drywell; and remove up to

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form;
submitted to this department, as well as the records available to me, it is my reconimeridatioh'thata-
the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the ,
LWRP provided the following is required to protect ground and surface waters: - T "
1. The application speaks about"significant, existing natural vegetation" and a non turf buffer
between the tidal wetlands and construction. Neither are shown on the survey. It is
requested that the Board require a vegetated, non-turf buffer landward of the tidal wetlands
to mitigate the "up to 5 oak trees"•removed, protect surface•w aters'and-fu6er Policy 6.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting hold on January 20,2021, and
in consideration of application fee in the sum of$250.00 paid by Robert & Joan Strong-and subject to the
Terms and Conditions as stated in the Resolution,the Southold Town Board of Trustees authorizes and permits
