Glenn Goldsmith, President Town of Southold Board of Trustees From- Mark Terry, Assistant Town Planning Director, AICP LWRP Coordinator Date: August 4, 2021 Re: LWRP Coastal Consistency Review for VINCENT FISCHETTI SCTM# 1000-86-5-6 Suffolk Environmental Consulting, Inc. on behalf of VINCENT FISCHETTI requests.a Wetland Permit for the as-built 300.Osq.ft raised slate patio on the southeasterly side of the existing dwelling; as-built ±40.0 linear feet at maximum height of 2.0' slate wall located along the seaward side of the raised slate patio; as-built reconfigured/expanded ±740.0sq.ft. slate patio at grade in sand; as-built 33.0sq.ft. slate steps; as-built 6.6'x6.9' spa; as-built northeasterly 428.4sq.ft. slate patio in sand; as- built 102.0'x2.0' (40sq.ft.) northeasterly slate squares walkway in sand; as-built 30.5 linear feet at a maximum height of 0.5' slate wall; as-built two (2) 25.0' long at a maximum height of 4.0' sections of white picket fencing; and for a proposed 660.0sq.ft. garage addition. SCTM# 1000-86-5-6 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with Policy Standards and therefore is INCONSISTENT with the LWRP. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. ' A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 9. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions The structures were constructed without obtaining a Wetlands Permit. In the event the action is approved, require a vegetated non-turf buffer incorporating existing vegetation to protect the water quality of Richmond Creek. The proposed garage is recommended as CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Cc.
