Mark Terry, Assistant Town Planning Director LWRP Coordinator Date: July 8, 2021 Re: Local Waterfront Coastal Consistency Review for FRANK &ANTOINETT NOTARO SCTM# 1000-63-7-30.1 FRANK &ANTOINETT NOTARO request a Wetland Permit to construct a 20'x40'x7' deep in- ground swimming pool with 800sq.ft. of on-grade slate pool surround patio; one 8' diameter catch basin for pool; and install 188 linear feet of 4' high pool enclosure fencing with two self-latching gates. Located: 625 Calves Neck Road, Southold. SCTM# 1000-63-7-30.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP. This action was recommended as inconsistent in 2007 based on insufficient setback, however, the Board issued a Wetlands Permit and found it consistent. The Board of Appeals also granted a variance for the pool in 2008 Based upon these decisions and program changes, the recommendation has changed 1. It is recommended that a non-turf, vegetated buffer is required. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
