SCTM# 1000-13-1-5.2 & 6 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below LWRP Policy 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. b. water-dependent uses which cannot avoid exposure to hazards. c. sites in areas with extensive public investment, public infrastructure, or major public facilities. The proposed action to retain and convert the existing structures in the CEHA is not supported by this policy. The intent of this policy is to protect life, structures, and natural resources from erosion hazards throughout the Town of Southold with ample setbacks to mitigate adverse impacts from storms over time. d. sites where relocation of an existing structure is not practical. The parcel size would allow the structures to be located outside of the CEHA Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. A sanitary system abandonment and connection to another existing sanitary system are also proposed to service the proposed improvements noted above. Permits are needed from the Southold Town Trustees with respect to the bluff and Coastal Erosion Hazard Area.The following narrative supports the Southold Town Trustees application package associated with this project. Project Site Location and Existing Site Conditions The project site, which consists of two (2) single and separate lots known as 460 and 320 North View Drive in the hamlet of Orient, Town of Southold, New York, is located between the north side of North View Drive and the south shore of the Long Island Sound, approximately 220 feet east of South View Drive. The project site is more particularly described on the Suffolk County Tax Map (SCTM) as: • 1000-13-1-5.2 (460 North View Drive) • 1000-13-1-6 (320 North View Drive) The 0.88 acre 460 North View Drive property contains a single-family residence,which the Astley family currently occupy. The 0.65 acre 320 North View Drive property is developed with a single- family residence that is currently unoccupied. 460 North View Drive is owned by Amy & Chris Astley, and 320 North View Drive is owned by Amy Astley. A heavily vegetated stable bluff is situated between the upland improvements to the project site and the Long Island Sound shoreline. The existing conditions of the subject site are shown on the site development plans provided with the Trustees application package. The project has been designed to minimize activity within the Coastal Erosion Hazard Area and shift structural improvements landward, where possible to protect the bluff. During a preapplication meeting with Southold Town Trustees John Bredemeyer III and Michael Domino, Mr. Bredemeyer and Mr. Dominio suggested that a Town Board variance from the Town's Chapter 111 (Coastal Erosion Hazard Area) regulations may not be necessary since the proposed activities would not be considered a major addition triggering the need for variance relief under Chapter 111 since there would be no increase to the footprint of a structure within the CEHA by more than 25%. In fact,the footprint will be substantially decreased by the proposed demolition. As such,the Astleys respectfully submit that there is no need for a CEHA variance from the Town Board for this project and request that the Trustees issue a Coastal Erosion Management in conjunction with their review of the Wetlands Permit application for this project. Mitigation of Potential Environmental Impacts The proposed actions include the following mitigating factors: • Removal of an existing single-family residential use and associated sanitary system and driveway will reduce density, nitrogen loading, water consumption, and overall potential impacts on surrounding natural resources. • Removal of sanitary system approximately 15'from the top of the bluff. • Installation of new and additional drainage structures and adjustments to grades and landscaping to capture stormwater runoff onsite, further preserving the stabilization of the adjacent bluff, which is heavily vegetated. • Significant reduction of structural improvements within the CEHA with a proposed landward shift of structural site improvements onsite. • According to the Geotechnical Evaluation Report prepared by J.R. Holzmacher P.E., LLC (copy included with this application package), the "Proposed replacement of in-situ soil materials with pool material and water represent a net unloading of the slope in the area where the pool is to be installed and therefore, does not represent additional loading incurred by the bluff slope." • A covenanted vegetative buffer area will be created along the top of the bluff, where no formal buffer area currently exists to further protect the bluff. Response to LWRP"Developed Coast Policy" Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section 11 — Policies;Page 2 for evaluation criteria. A substantial portion of the legally existing nonconforming residence and deck will be removed from the CEHA area. Furthermore, the conversion of the existing single-family dwelling to a proposed pool house represents a reduction in overall building mass and an upgrade to the unkept residence and failing decking structures, which is a benefit to the surrounding residences in this coastal community. And, according to the Geotechnical Report prepared by Holzmacher, the proposed construction of the swimming pool onsite will have a net positive impact on stability of the bluff. More details are provided in the construction methodology and engineering plans that are included in this application package. N PV Page 4 Project Narrative-Addendum 460 and 320 North View Drive,Orient Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. See LWRP Section 111—Policies Pages 6 and 7 for evaluation criteria. The project involves the renovation and downsizing of the existing single-family residence via the removal of a majority of the building and the conversion of a small portion of the building to a modest (400 sq. ft.) pool house with an attached deck, all within the footprint of the existing residence. It is also important to note that the project includes a net decrease in coverage in the CEHA, further enhancing visual qualities of and around the subject property. The proposed swimming pool will be partially below grade,which will further minimize potential visual impacts from the adjacent North View Road. And, the entire property will be screened with hearty vegetation along the street front property line and throughout the entirety of the interior of the property. Finally, due to the significant elevation of the property, and the thick bluff vegetation, visual impacts from the adjacent shoreline (Long Island Sound) are not anticipated. Policy 4. Minimize loss of life,structures,and natural resources from flooding and erosion. See LWRP Section 111—Policies Pages 8 through 16 for evaluation criteria. A 10'wide non-disturbance/non-fertilization buffer extending landward from the top of the bluff is being proposed as part of this project to further protect the stable bluff from potential stormwater runoff that may elude the intricate series of drainage structures also being proposed as part of this project. Also, according to the Geotechnical Report prepared by Holzmacher,the proposed installation of the swimming pool will have a net positive impact on the stability of the bluff. Refer to the Construction Methodology and engineering plans that are included with this application. Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section 111—Policies Pages 16 through 21 evaluation criteria. The proposed merger of the lots will eliminate a single-family residential use, thereby reducing the density in this community. The byproducts of the density reduction are decreases in potable water consumption and nitrogen loading from wastewater as well as a reduced potential for impacts to surrounding natural resources.
