Box 1047 Southold, NY 11971 RE: SAND LENNOX, LLC 1450 SALT MARSH LANE, PECONIC SCTM# 1000-68-3-1 Dear Mr. Kimack: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, April 13, 2022 regarding the above matter: WHEREAS, Michael Kimack on behalf of SAND LENNOX, LLC applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated December 9, 2021, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 4.1 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: house relocated as far landward as possible; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 16, 2022, March 16, 2022 and April 13, 2022, at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, 2 WHEREAS, the Board has determined that the project as proposed will not affect the health, Safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of SAND LENNOX, LLC to demolish and remove existing dwelling/porch (554 sq.ft.); existing septic system to be abandoned and backfilled with clean coarse sand; existing well to be abandoned. Construct a proposed two (2) story four (4) bedroom dwelling with covered decks (2421.5 sq. ft.) and gravel driveway; construct on grade stone patio seaward of new dwelling (1607 sq. ft. out of shadow of second floor deck); construct front walkway (217 sq. ft.); install gutters to leaders to drywells; install a proposed 4 bedroom I/A OWTS system in accordance with Health Dept. standards; install a new well. Provide a fifty (50) foot non-disturbance buffer landward of the crest of bluff planted in accordance with the landscape plan made a part of this application; remove 21 trees of varying calipers; with the condition that the 156.25 sq. ft. wood patio be removed, and that there be a one to one replacement of trees cut seaward of the house; and as depicted on the revised site plan prepared by Victor Ruiz Architecture, received on April 20, 2022, and stamped approved on April 20, 2022; and the revised landscape plan of Janis Leonti Landscape Design, last dated April 18, 2022 and stamped approved on April 20, 2022. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)
