Mark Terry, AICP LWRP Coordinator Date: October 13, 2021 Re: LWRP Coastal Consistency Review of LEFKARA HOLDINGS, LLC, c/o NEOFITOS STEFANIDES SCTM# 1000-30-2-77 Patricia Moore on behalf of LEFKARA HOLDINGS, LLC, c/o NEOFITOS STEFANIDES requests a Wetland Permit to install and perpetually maintain a 30' wide vegetated non-turf buffer area along the landward edge of top of bluff with approximately 438 plants of specified sizes and species; install and maintain a 4'wide path to top of bluff through the non-turf buffer; and to perpetually maintain a non-disturbance buffer from top of bluff seaward. Located: 1070 The Strand, East Marion. SCTM# 1000-30-2-77 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP policies and therefore INCONSISTENT with the LWRP. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 9. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The Board issued a Wetlands Permit in 2021 (9923)that conditions "no activity will take place within 30 feet from the top of bluff". The planting of the proposed area would constitute an activity. Further an undisturbed buffer(to the bluff) is not shown on the plans as described in the description of work. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
