TODEBUSH SCTM# 1000-103-13-9 Suffolk Environmental Consulting, Inc. on behalf of ROGER D. TODEBUSH requests a Wetland Permit to construct a two-story, single family dwelling (1,180sq.ft. footprint)with attached 192.Osq.ft. seaward screened in porch; construct an outdoor shower; install a 240.0sq.ft. at grade seaward patio; install an IA/OWTS septic system; and install a pervious gravel driveway. Located: 1130 West Creek Avenue, Cutchogue. SCTM# 1000-103-13-9 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP policies and therefore INCONSISTENT with the LWRP. 6.1 Protect and restore ecological quality throughout the Town of Southold. B. Protect and restore ecological quality by adhering to the following measures. 1. Maintain values associated with natural ecological communities. Each natural ecological community has associated values which contribute to the ecological quality of the Town of Southold. These values should be assessed on a case-by-case basis. The trimming of vegetation to 3' height that functions as important habitat (including cover) adjacent to the tidal marsh is unsupported and would result in the functional loss of ecological components. Fringe habitat serve vital function and values to wetland systems. The proposed action would make the buffer less effective. A Wetlands Permit(9830A) issued to a parcel to the south (SCTM#1000-27- 4-9.6) required that the applicant not disturb the Eastern Red Cedar, Northern Bayberry, Marsh Elder and Groundsel Bush. The decision persevered the function of a wetland buffer. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits` including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except mirror exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C,the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area which includes all of Southold own . 3.
