Main Rd. &Youngs Ave.) Southold, NY 11971 • �Q Telephone: 631 765-1938 C4UNT`I,� LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Glenn Goldsmith, President Town of Southold Board of Trustees From: Mark Terry, AICP LWRP Coordinator Date: November 9, 2021 Re: LWRP Coastal Consistency Review for JOHN & CARRIE MULLINS SCTM# 1000-17-1-2.2 Michael Kimack'on behalf of JOHN & CARRIE MULLINS requests a Wetland Permit and a Coastal Erosion Permit for the disturbance seaward of the Coastal Erosion Hazard Area Line (CEHA) of an area of 2,124sq.ft. from the CEHA line to the silt fence; the disturbed area is to accommodate construction activities for the proposed dwelling and to provide an area for the placement of in-ground sewage disposal pools (in-ground structures), made necessary to meet the Department of Health's required 150ft. separation from the well; upon completion, the disturbed area will be revegetated and the existing path to beach narrowed from eight (8) feet to four(4)feet in width; construction of a proposed 2,328sq.ft. single-family two-story dwelling; construct an approximately 115 linear foot long retaining wall; install an I/A OWTS septic system; install gutters to leaders to drywells to contain roof runoff; and to install an approximately 1,430sq.ft. pervious driveway and parking area. Located: 905 Stephenson Road, Orient. SCTM# 1000-17-1-2.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP and therefore INCONSISTENT with the LWRP. 1. The location of a large OWTS to support a 5-bedroom single family residence within the CEHA on this sensitive parcel is unsupported by Policies 4 and 6. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Site Description: From the Long Island Sound landward,the cobble/rock beach rises in elevation from the high water mark (approximately elevation 4 to elevation 22 at the existing driveway). A 20'± wide vegetated berm- like area containing Beach Rose(Rosa ruguosa) and Seaside Goldenrod (Solidago sempervirens), is present landward of the high water mark. From that point the beach area lowers in elevation by two to four feet to an area best described as an over-wash. This area receives runoff from upland and major storm over-wash during hurricane and major storm events. This low area, approximately 3500 square feet, is populated with upland and salt tolerant species* as listed below: • Japanese Honeysuckle(Lonicera japonica) • Seaside goldenrod Solidago sempervirens • Eastern Red Cedar(Juniperos virginiana) • Black Cherry(Prunus serotina) • Northern Bayberry(Myrica pensylvanica) • Common Mullein (Verbascum thapsus) • Groundsel-tree (Baccharis halimifolia)* • Common Reed (Phragmites Communis) • Staghorn Sumac(Rhus typhina) • Privet (Ligustrurn spp.) • Poison Ivy(Rhus radicans) • Eastern Prickly Pear(Opuntia humifusa) • Multiflora Rose(Rosa multiflora) • Salt Hay(Spartina patens)* • Beach Rose (Rosa ruguosa) From this area the property rises in elevation and is mostly populated with Black Cherry and escapee Privet, and Northern Bayberry. Rare or Endangered Species: A check of the New York State Geographic Information Gateway reveals that there are no mapped Significant Fish and Wildlife Habitats at the subject Property. The nearest Significant habitat is associated with Orient Harbor (Bay side). New York Sate Tidal Wetlands Maps: Review of NYSDEC Tidal Wetlands Map 724-558 indicates that the only tidal wetlands in this area are those associated with Long Island Sound and designated as Littoral Zone (open water). New York State Freshwater Wetlands Maps: Review of the NYSDEC Fresh Water Wetlands Maps indicates that there are no Freshwater Wetlands within the subject property boundary. Wildlife Observed:An immature Bald Eagle was observed in flight over the subject property.
