Jeffrey Patanjo on behalf of SADIK HALIT LEGACY TRUST requests a Wetland Permit for the
as-built bluff stairs consisting of the following: 4'x4' at-grade top landing to an 8,2'x9.5' upper
platform to 18'x4' steps down to an 8'x3.8' middle platform to 16'x4' steps down to a 19.4'x10'
lower platform to 14.5'x4' steps down to beach; all decking on structure is of untreated lumber.
Located: 2200 Sound Drive, Greenport. SCTM# 1000-33-1-16
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the LWRP Policy 6.3 and 9 therefore
INCONSISTENT with the LWRP.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town
Board of Trustees laws and regulations for all Andros Patent and other lands
under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions
L The as built beach access stair structure was
constructed without obtaining a Wetlands Permit.
ii. The 19.4 x 10' or 194 square foot deck seaward of
the top of bluff is not permissible pursuant to §
275-11. Construction and operation standards.
Platforms associated with stairs may not be larger
than 100 square feet.
iii. The lot was created in the Map of Section Four
Eastern Shores at Greenport filed March 7, 1966
which established a common private beach access
at the end of Sound Drive for the benefits of the lot
owners. The beach access is west of the subject
parcel and therefore access to the beach is
currently,available.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.
