(E.S.T.) , Thursday, January 15, 1976 at the Town Office, Main Road, Southold, New York. There were present: M~ssrs: Robert W. Gillispie, Jr., Chairman; Robert Bergen; Fred Hulse, Jr.; Serge Doyen, Jr. Also present: Sherley Katz, Long Island Traveler- Mattituck Watchman. On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that the minutes of the Southold T'own Board of kppeals dated January 8, 1976 be approved as submitted, subject to minor correction. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Hulse, Doyen. Southold Town Board of Appeals - 2 - January 15, 1976 PUBLIC HEARING: Appeal No. 2093 - 7:45 P.M. (E.S.T.) upon application of Joseph C. Cornell, Cornell Construction Corp., Southold, New York a/c Frank & Edna Guarriello for a variance in accordance with the Zoning Ordinance, Article III, Section 100-30 and Bulk Schedule for permission to construct dwelling with insufficient side yard. Location of property: Lot No. 61, Map of Cleaves Point, Section III, W/S Maple Lane, Greenport, New York. Fee paid $15.00. The Chairman opened the hearing by reading the applica- tion for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers, and notice to the applicant. The Chairman also read proof of notification by certified mail to Dawn Estates, 14 Dawn Drive, Centerreach, N. Y. THE CHAIRMAN: The application is accompanied by a photo- copy of a map showing the subdivision and indicating the pie- shaped lot No. 61 which faces on a canal to the west, in the easterly part of Greenport, with the easterly dimension in two courses on Maple Lane. The Notice of Disapproval from the Building Inspector reads: "Southwest corner of proposed dwelling will have insufficient side yard due to shape of lot". ~HE CHAIRMAN: Is there anyone present who wishes to speak for this application? MR. JOSEPH C. CORNELL: I have already indicated my position in the application and I believe you have stated everything as it shows on the application. The only other thought might be that I don't think the granting of this variance would cause hardship to any other owner. It's the southwesterly corner that is involved. THE CHAIRMAN: How big is the house? MR. CQRNELL: It's 60' x 37', a ranCh style house. THE CHAIRMAN: Is there anyone else present who wishes to speak for this application? (There was no response.) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) Southold Town Board of Appeals - 3 - January 15, 1976 After investigation and inspection the Board finds that the applicant requests permission to construct dwelling with insufficient side yard, Lot No. 61, Map of Cleaves Point, Section III, on the west side of Maple Lane, Greenport, New York. The findings of the Board are that applicant would be restricted from building a normal size house by the unusual shape of this lot. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. Jagel, Bay Shore Road, Greenport, New York for a variance in accordance with the Zenin~ Ordinance, Article III, Section 100-30 and Bulk Schedule for permission to divide lots wi~h insufficient width and area. Location of property: W/S Bay Shore Road, Greenport, Lots 104, 105, 106, Map of Peconic Bay Estates, ~1124. Fee paid $15.00. The Chairman opened the hearing by reading the application for a variance, legal notice of hearing, and affidavits attesting to its publication in the official newspapers, and notice to the applicant. The Chairman also read proof of notification by certified mail to William Smith, Bay Shore Road, Greenport; Posillieo Construction , 615 Old Country Road, Westbury, N. Y.; Fred and Ora Laskowski, 47-52 189th Street, Flushing, N. Y. Southold Town Board of Appeals -4- January 15, 1976 THE CHAIRMAN: Is there anyone present who wishes to speak for this application? MRS. BURKE: I ~ve on Bay Shore Road, Wickham Park, Greenport. A few ~ ago a variance was not granted to a lot on Bay Shore ~ad because the owners Were not the original owners. If Mr. and Mrs° Jagel have been the original owners for nineteen years why should not their appeal be granted? I believe the name of the people who were denied is Laskowski. The main reason they were denied permission to divide a 150 foot lot into two separate parcels was that they were not the original owners. Now, we have the original owners. THE CHAIRMAN: I remember something about it. Are the Jagels here? MR. LOUIS A. JAGEL: I bought in 1958 and built one house with the idea that in the future I would be able to build another house. I bought three lots. The house I built is a summer home located on Lot 9104. At the present time we have two small children and we intend to move out here permanently, and the existing house is too small. We would like to build on the ad- joining lot. THE CHAIRMAN: You bought three lots, 9's 104, 105, 106. Each of these lots is 50 feet wide. You have a total of 150 feet in width. You put the summer house on Lot ~104 and part of #105. MR. JAGEL: At that time I was told I could build on 75 feet of frontage and my plan was to build on the other 75 feet at a future time. I intend to move out here permanently and I need a larger home. That is the story. THE CHAIRMAN: Do you intend to sell the first house? MR. JAGEL: I don't intend to sell. THE CHAIR~LAN: You want to divide the property i~ two and use the southerly 75 feet to build a larger home for a permanent dwelling, and you still want to maintain ownership of the first house. MR. JAGEL: That's right. THE CHAIRMAN: Does anyone else wish to speak for this application? MRS. GERTRUDE FULLAN: We have absolutely no objection to their building this dwelling. Southold Town Board of Appeals -5- January 15, 1975 MS. DOROTHY DALY: I am almost opposite this property and I know when they built the first house they built a way over so they would have room enough later on. They keep their property in very good condition. They are very neat people and good neighbors. THE CHAIRMAN: Are the lots across the street larger? ~$S:DFL~ I have 100 feet. Some are 75 feet and some are 100 feet. THE CHAIRMAN: Do you have water down there? MRS. CATHERINE WEBER: Town water. I approve of the applica- tion. The house they intend to build would add to our area rather than taking away from it. There is a house near me that looks like a trailer. If that was approved I don't see any reason why this shouldn't be approved. THE CHAIRMAN: I will have to dig out the file on this other application you mentioned. I know the position of the Board, recently recently, h~s been that where a neighborhood is built up with 75 foot or 100 foot or 60 foot lots, we have to go by the charac- ter of the area. It would be unreasonable to require an individual to have twice as much area as someone else. That almost limits 40,000 sq. ft. mi~'~,~mum to new areas. When decisions are appealed to the Supreme Court, the precedents that guide us are in the law books of the State of New York. (The Chairman read letter dated January 12, 1976 received from Joseph G. Wills and Doris L. Wills stating that they have no objection to the town granting permission for the building of Mr. Jagel's house on this property and hope that the variance will be granted.) Letter in file. MR. HAROLD WEBER, JR.: To tell you the truth, if they built there, it would take care of the poison ivy and the rahs and mice that I see running around. There are a lot of children on the road and there could be a lot of diseases. I think it would be nice if they built there. It would keep the street clean plus, if thsy build on that other lot between them and Mrs. Burke, it would really clean it up. THE CHAIRMAN: Have these lots grown wild? MR. JAGEL: No, my lot is cut down. MR. HAROLD WEBER, SR: We bought a couple of years ago at the corner of Kirwin Blvdo and Bay Shore Road, a~nd we had quite a bit of trouble getting our Title and Deed straightened out. They claimed they found another owner but he was deceased. It took about six months. Finally we went to a "quit claim". I think if I owned a piece of property that size, I would like Southold Town Board -of Appeals 6 January 15, 1975 to do something with it myself. THE CHAIRMAN: Does anyone else wish to speak for this application? (There was no response.) THE CHAIRMAN: Is there anyone present who wishe~ to speak against this application? MR. JOSEPH G. RIEMER, JR.: I am a resident of Bay Shore Road. I think these things should be approached from an objective standpoint. Whether or not the Jagels keep their facilities in good condition is extraneous. What style of house they plan to have is irrelevant. The Pr0Perty~that Mr. Weber, Jr. described is not under Mr. Jagel's control. In terms of the property that is immediately to Mr. Jagel's north, namely three lots that the Board saw fit to deny a few years ago. I regard that as being a precedent and I would say that the Board should follow its wisdom now as then. The Town Boardr in its wisdom, saw fit to upgrade and I see no reason to perpetuate errors. I have 175 feet. What prevents me from coming to you and asking for smaller lots~ I would invite you to go down the street f~rther where lots have a couple of hundred feet. Wisdom doesn't only refer to water, it must refer to sanitary systems took~ The sanitary systems we have are cesspools and the natural flow is to water, and the water is across the street. took the view that~the more lots they could chop the property up i~to, the more money would come an. n the Board of Health. We were beginning 5© get ~, one third acre and one quarter acre. This that time~ was approving mino~ subdivisions. '~ -= made and it was discovered that S0uthold Town cou pport so much density.. the Board of Health came up with 20,00 sq~ ft. per lot in a subdivision of five lots. Later, it was decreed that a lot should be 40,000 sq. ft. In the meantime we are left with what the early planners left here as far as the shape and size of these lots is concerned. Zoning procedures have developed quite a bit over the last twenty years. Southold Town Board of Appeals -7- January 15, 1976 We have found that the ~pper courts will not support an area variance where the lot is not in keeping with the surrounding neighborhood. If you came in here and wanted to do something with your 175 feet, we would probably have to let you. I think this Board should be guided by what the courts tell us. I believe that if we denied this application we could be taken to court, and we could lose. We have to base our decisions on the character of the area. MR. RIEMER: There is more than sufficient room to expand that house. THE CHAIRMAN: You can't tell people what to do with their house or what color to paint it. MR. WEBER, JR.: They just got finished building a brand new house on the same street, a corner house. THE CHAIRMAN: That has nothing to do with this. It's single and separate ownership. Just because we have a Zoning Ordinance, a person would not be denied use of his property. MRS. CATHERINE RIEMER: Bekind us Posillico has a large acreage. They have to keep it to acre zoning, Why can't they break it down into smaller lots? THE CHAIRMAN: ~t depends on what you start with. A property in single and separate ownership surrounded by other properties frequently can't be enlarged. Because a zoning ordinance is changed doesn't mean that you can't use the property or divide it. MS. ALICE O'BRIEN: I am "against" based on the fact that it would set a precedent. (Ms. O'Brien read the following statement:) "I am against granting this variance based on the fact that it wOuld set a prescience for satisfying all property owners who request subdivision of lots. I am Treasurer of the W. P. Property Owners Association which brings me in contact with all members. Through conversation I have learned of others who intend seeking variances to split property into parcels~smaller than the required footage. What would be permitted for one should be permitted for all. This of course would change the character of the area which has attracted new residents to purchase homes at a high price or to build new attractive homes. It is doubtful that they would have chosen the area to make such investments if the area had the appearance of sections in Queens. Over-development could lead to just that. Southold Town Board of Appeals -8- January 15, 1976 This is not personal opposition to this present request since opposition was made a few years ago to the same type variance which would have allowed the adjoining property lots 101-2-3 to be split into two 75 foot lots. This request was denied." Ms. O'Brien also read the following letter addressed to the Wickham Park Association. "In reference to the request for variances from Mr. Louis Jagel, Bay Shore Road, Greenport, New York, on lot Nos. 104-105-106 be advised that we are opposed to the granting of such variance in the belief that such a grant would lead to depreciation and reduction of value in our home." S/S Ms. Annette Golden Bay Shore Road, Greenport THE CHAIRMAN: A hearing like this is not necessarily a popularity contest. We are not guided by the numbers of people who are "for" or "against". We are in a quasi-judicial position and we have to maintain an independent view. Even though the majority are in favor, we might have to go against an appeal. In this case, the majority seem to be in favor and all seem to like the Jagels. However, that has nothing to do with it. MR. RIEMER: I gather that you find this application difficult to dehy because of court decisions. THE CHAIRMAN: One of our jobs is to keep the Town from getting into law suits. We go by the law. However, I appreciate your point of view. MRS.RIEMER: Why have an application in the first place? THE CHAIRMAN: Anyone has the right to apply. MR. RIEMER: Why, if the outcome is predetermined, have a hearing~ THE CHAIRMAN: This Board can, or not, regar~ this differently than we regarded the other case. No two cases are alike. No one knew b~forehand what this Board'S~decision might be. We might or might ~.~not be supported in Court. Generaily the tenor of decisions go along with applicant's requeSts where it can be reasonably shown, as is shown in the photo-copy of the tax map, that the character of the neighborhood is far less than 40,000 sq. ft. I agree that some hearings are unnecessary but this is not the case with this hearing. WEBER: What happens if Mr. Jagel owns a piece of property and is denied the right to build a house on it... what does he do with it? MR. ROBERT BERGEN: He already has a house on that lot. THE CHAIRMAN: It doesn't matter if it's a summer house or a year round house. Because someone chopped up lots in 50 foot sections is irrelevant. What we are concerned with are existing lots in the area at this time. MR. JAGEL: At the time I bought the property it was my understanding that the original owners were the Schroeder family, and at that time records show that you had to build on no less than 75 foot frontage. THE CHAIRMAN: That might have been a local or Deed covenant of this subdivision'. It has nothing to do with US. MR. JAGEL: It was our purpose to, in the future, build another house on it. THE CHAIRMAN: The first lot size was 100' x 125' THE CHAIRMAN: Is there anyone else who wishes to speak? (There was.no response.) Y. be GRANTED permission to divide lots with in- sufficient width and area, located on the west side of Bay Shore Road, Greenport, Lots 104, 105, 106, Map of Peconic Bay Estates, 91124, as applied for, subject to the following conditions: 1. That the property be converted into two lots, each 75 feet in width and 125 feet in depth. That the new house shall be built on a separate lot from that on which the summer house is located and that no more than one house shall be located on either one of the new 75 foot lots. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Hulse, Doyen. PUBLIC HEARING: Appeal No. 2092 - 8:10 P.M. (E.S.T.) upon application of Epes W. and Gloria M. Sargent, 750 Bayview Road, Southold, New York for a variance in accordance with the Zoning Ordinance, Article III, Section 100-30 and Bulk Schedule for permission to divide property with in- sufficient width and area. Location of property: Bayview & Baywater Roads, Southold, bounded on the north by Bayview Road; east by St. Patrick's Cemetery; south by Town of Southold; west by P. Sarkus. Fee paid $15.00. The Chairman opened the hearing by ~beading the application for a variance, legal no~tice of hearing, affidavits attesting to its pubiication in the official newspapers, and no~ice to the applicant. The Chairman also read statement from the Town Clerk that notification by certified mail had been made to Peter Sarkus, Town of Southold, and St. ~trick's Cemetery c/o Rectory. THE CHAIRMAN: Is there anyone present to speak for this application? MR. EPES W. SARGENT: I am here to speak for it. THE CHAIRMAN: Is this property on high ground? MR. SARGENT: There is no swamp. Soutkold Town Board of Appeals -11- January 15, 1976 THE CHAIRMAN: The application is accompanied by a copy of a survey. The property has an area of approximately 1.77 acres for the whole thing. Is 1.77 a surveyor's figure? MR. EPES: Yes. We would be retaining a little over a half an acre and would be selling a little over an acre. There is a bend in the line. MR. SERGE DOYEN: It appears that one will be 30,000 sq. ft. and the other will be over 40,000 sq. ft. - THE CHAIRMAN: Actually, this is 1.8 acres on the photo- stat. Does anyone wish to speak against this application? (There was no response.) After investigation and inspection the Board finds that applicant requests permission to divide property with in- sufficient width and area located at Bayview & Baywater Roads, Southold. The findings of the Board are that this lot has an extremely irregular shape and the proposed division will create a lot slightly more than 40,000 sq. ft. in area, and the remaining lot will be slightly under 40,000 sq. ft. in area. The total size of the property is approximately 1.8 acres. The Board finds that this division of the lot is in sympathy with the character of the area as shown on the photostat of the County map in file. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. On motion by Mr. Hulse, seconded by Mr. Doyen, it was RESOLVED, Epes W. and Gloria M. Sargent, 750 Bayview Road, s0Uthotd, New York be GRANTED permission to divide property with insufficient width and area at Bayview & Baywater Roads, Southold, as applied for, subject to the following condition: That applicant furnish the Board with a survey indicating the exact division of this property. Location of property: Wabasso Street and Hiawatha's Path, Southold, bounded on the north by Hiawatha,s Path; east by Hiawatha's Path; south by now or formerly J. J. Beck and E. Antonison; west by Wabasso Street. Fee paid $15.0.0. The Chairman opened the hearing by reading the application for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers, and notice to the applicant. The Chairman also read statement by the Town Clerk of notification by certified mail to Mr. and Mrs. Willard Schilling, and to Mr. and Mrs. Arthur Antonison. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? (There was no response.) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? Mr. and Mrs. Arthur Antonlson, Mr. Willard Schilling and Mr. Joseph Beck indicated an interest in what Mr. Accardo planned to do with his property but did not state that they were definitely against the proposed division. Mrs. ~ntonison said that Mr. Beck's property abuts Mr. Accardo's property; her brother's property (Mr. Schilling) also ab~ts; and they, the Antonisons, are to the ~HE CHAIRMAN: A sketch accompanies the application which indicates that applicant has a lot wh~ich is larger than some of the surrounding lots. I believe we will have to allow him to divide it because of the character of the area. You can see that there are a lot of small lots in the area. (There was a further discussion with those present who felt that they would like to know how Mr. Accardo planned to divide his property.) THE CHAIRMAN: Are there any other questions? (There was no response.) Southold Town Board of Appeals -13- January 15, 1976 On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that the Southold Town Board of Appeals postpone decision on Appeal No. 2095, Angelo & Joan Accardo, 54 March Court, Selden, New York until 7:30 P.M., Thursday, February 5, 1976. The secretary is directed to write to Mr. Accardo informing him that the Board requires additional information. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Hulse, Doyen.
