That the said Board of Trustees and the Town of Southold are released from any and,all damages, or daims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or'-her own, . expense, defend any and all such suits initiated by third parties, and the said Permittee` assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That if future operations'of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated-without expenses to-the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Domino G Q Telephone(631) 765-1892 Greg Williams 'Q �� Fax(631) 765-6641 COUNT`1,0c� BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD October 22, 2021 Louis Caglianone 16 Orchard Neck Road Center Moriches, NY 11934 RE: DARCY GAZZA 1500 BEEBE DRIVE, CUTCHOGUE SCTM# 1000-103-3-4 Dear Mr. Caglianone: The Board of Town Trustees took the following action during"its regular meeting held on Wednesday, October 20, 2021 regarding the above matter: WHEREAS, Louis Caglianone, on behalf of DARCY GAZZA applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated May 28, 2021, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and; WHEREAS, the LWRP Coordinator issued a.recommendation that the proposed action to replace the permitted structure in place and in kind is Exempt with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the seaward extension of the catwalk/dock into public waters be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program policy 6.3 to the greatest extent possible through the imposition of the following Best Management Practice requirements: the submission of a revised plan and project description; and, WHEREAS, a Public Hearing was held by'the Town Trustees with respect to said application on July 14, 2021, September 15, 2021 and October 20, 2021, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of DARCY GAZZA for removal of the existing fixed pier and the construction of a new 138' long overall fixed pier. The pier will consist of a 4'x8' ramp up from grade to a 4'x11,0' fixed catwalk leading to a 4'x14' ramp down to a 6'x20' fixed T dock. The decking on all components will be thruflow decking; and as depicted on the site plan prepared by Louis Caglianone, dated September 30, 2021 and stamped approved on October 20, 2021: Permit to construct and complete project will expire'two years from the date the permit is signed. NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE: WHEREAS, the Southold Town Board of Trustees are familiar with this project having visited the site on July 7, 2021, and having considered the survey of property by Kenneth M. Woychuk Land Surveying, PLLC dated May 5, 2021, and having considered the plans for this proposed project submitted by Louis Caglianone dated June 28, 2021 at the Trustee's July 12, 2021 work session, and WHEREAS, on July 14, 2021 the Southold Town Board of Trustees declared itself Lead Agency pursuant to S.E.Q.R.A.; and, WHEREAS, on July 14, 2021 the Southold Town Board of Trustees classified the application as an unlisted action pursuant to S.E.Q.R.A.; and, Page 1 of 2 WHEREAS, in reviewing project plans submitted by Louis Caglianone dated June 28, 2021 it has been determined by the Board of Trustees that all potentially significant environmental concerns have been addressed as noted herein: • Navigation: The proposed dock meets standards and does not extend beyond 1/3 across the water body. Depths for the dock terminus are within Town Trustees, New York State Department of Environmental Conservation and United States Army Corps. of Engineers guidelines and there is no recognized Federal/New York State/Town navigation channel in the immediate vicinity of the proposed structure. • Scope: The proposed dock is comparable to docks on neighboring properties in an area where docks historically are used for commercial and recreational purposes. • Scope in relation to the riparian rights of shell fishers: The plan allows a standard fixed catwalk to float design that will not impede access for those seeking shellfish and crustacea in season. • Environmental upkeep: The dock design projects a usual lifespan of 30 years with limited pile replacement so as to minimize disturbance of the bottom. THEREFORE, according to the foregoing, the Southold Town Board of Trustees Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to SEQRA for the aforementioned project. The attached revised plans show the location of the proposed floating dock overlaid on the elevations and average lines of the adjacent and nearby docks.The line of directly adjacent docks is shown as well as the line to the properties just beyond the adjacent properties,called out as nearby docks on the hydrographic survey. The docks on the properties directly adjacent to the subject property are uncommonly short and reside in water as shallow as 1.8'.These docks being so short and in such shallow water does not seem to provide a fair basis for the proposed structure to try to conform to.The properties just beyond the adjacent properties have docks that better conform to the requirements and are more in line with the other docks nearby the subject property. The proposed floating dock is shown rotated slightly to better situate it in the deepest water possible without exceeding the line of the nearby docks. This is not an ideal configuration to the applicant but is proposed this way to try to better conform to the minimum water depth under the float.
