That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. The intent of the setback is to,minimize impacts on the natural protective feature and protect structures from damage and loss due to storms and erosion over time. `SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: The application was forwarded to the District for commentary. Their reply,dated June 3,2021 indicates a site inspection was performed on May 27,2021 observing that the department previously evaluated the site in January 2017 (prior to the redevelopment of the residence)and offered the following commentary: The proximity of the proposed pool at 44.4 feet from the top of the bluff may cause issues in the future. The current condition of the bluff suggests it is already experiencing runoff issues. Proper measure should be done to significantly improve the bluffs current condition and further reduce potential issues from affecting the structural integrity of the bluff. The use of heavy machinery near the top of the bluff is not encouraged because it can result in further degradation of the bluffs stability and can be dangerous. Eliminating any potential stormwater,greywater,irrigation water,pool water,and/or other runoff from being discharged on or near the bluff is also highly recommended. There are several other factors that can be done to help stabilize the bluff and reduce further erosion from occurring. The District encourages planting native-bluff plant species along the top, face, and toe of the bluff. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town,Law &267 b(3)(b)(L)., Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Orient-by-the-Sea, beachfront community, consists of homes developed in the last quarter of the 201h century. Many homes,including those located directly on the water have private pools,several of which are closer than what the applicant proposes. The immediate westerly and easterly properties to the subject premises have pools located closer to the bluff than the proposed pool(435 Sound View Road and 735 Sound View Road). When redeveloping the site,the applicant was previously granted relief by the ZBA to locate the newly constructed residence at 67.5 feet from the top of the bluff(revised to 83.1 feet from the top of the bluff as the result of a De Minimus request),where the code requires improvements to be a minimum of 100 feet from the top of the bluff. 2. Town'Law&267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other'than an area variance. As the result of the location of a 10-feet wide right of way running along the western lot line and the existing sanitary system by the eastern lot line,placement of the pool is not possible in a side yard location,which would alternatively require variance relief. Furthermore,the pool cannot be placed in a conforming front yard location as that portion of the property is encumbered by drywells required for storm water management. A pool in a front yard location would be out of character of this neighborhood and would negatively impact the community. 3.,T00vn,1Uw;6267-b(3)(b)t3).,The variance granted herein is mathematically substantial,representing 32%relief from the code. However, the applicant was previously granted relief for additions and alterations and redevelopment of a previously existing house at 67.5 feet from the top of the bluff. A dimensional structure, such as a two-story residence would have greater impact on the environment,the stability of the bluff and an adverse impact on adjacent and neighboring site lines and view than a pool located at grade. 4. Town Law 4267-ti(3)(b)(4). No evidence has been submitted to suggest that a variance in this`residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.The applicant must comply with Chapter 236 of the Town's Storm Water Management Code.
