TERMS AND CONDITIONS The Permittee North Fork Proiect, LLC, residing at 5775 Mill Road, Mattituck,New York as part of the consideration for the issuance of the Pen-nit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the penmittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the perm it. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 4,829 square feet, .11, irregular-shaped waterfront parcel located in the M-II zoning district measures 15.81 feet and 98.35 feet along Mill Road, then runs east 53 feet along Town of Southold lands known as "Easement No. 1" over a concrete retaining wall at the apparent high-water mark and into the Mattituck Creek, then the lot line follows the structure and runs over Mattituck Creek 32 feet north (the structure is cantilevered over the water), 15.01 feet and continues north 80 feet connecting the building to exterior decking over water and then returns 46.58 over decking, the creek and wooden bulk-heading to an upland earthen area at Mill Road. The subject parcel is developed with a historic one and one-half story wood-frame building(formerly an 181h Century tidal mill),wooden bulkhead,wood deck with railing and a floating wood dock as shown on the survey prepared by Nathan Taft Corwin III, Land Surveyor and last updated for lot coverage on June 2,2021. The subject property also controls two easement areas (Easement No. 1 and Easement No. 2) owned by the Town of Southold and a separate lot where the waste-water sanitary system is located. Easement No. 1 is an irregular shape and measures 53 feet along the southern lot line of the subject property to and over the Mattituck Creek, then runs 26.96 feet along the creek and over rocks at the apparent high-water mark, then 9.5 feet and 23.75 feet over rocks at the Mattituck Inlet, then continues 6.85 feet and 21.43 feet at Mill Road and returns along a radius 17 feet and 28.32 feet, along Mill Road. This area is used by the applicant for storage, access to the existing structure and also contains a propane tank used by the applicant. -Easement No. 2 is located on the opposite side of Mill Road, facing Easement No. I and is also irregular-shaped and measures 4.69 feet and 24.2 feet along Mill Road, then runs southwest 26.4 feet along a separate lot owned by the applicant, then continues 26.66 feet along a commercially developed lot to the south and continues 17.57 feet along the same lot and returns 20.32 feet back to Mill Road. This area is used for storage by the applicant. The separate lot owned by the applicant,across the street from the subject parcel, is known as SCTM: 1000-106-6-4.1 (this parcel is where the sanitary system servicing the subject property is located). It measures 162.15 feet, then continues 134.32 feet along Mill Road, then crosses the terminus of Mill Road and runs east 53.97 feet to the Mattituck Creek and follows a wood bulk-head 35.26 feet along the creek,then runs 68.27 feet along a commercially developed lot and continues 295.99 feet back to Mill Road. The parcel contains the Easement No. 2 area, a frame garage and a one and two story wood-frame building and the waste-water treatment facility for the subject property. As part of the application, the applicant t Page 3, December 16,2021 #7573,North Fork Project, LLC SCTM No. 1000-106-6-3 proposes to reduce structural lot coverage by 2.7% and restore and renovate the restaurant to include, when complete: 1,455 square feet of one-floor, interior restaurant space with second floor living/storage; 388 square feet open porch and 922 additional square feet of exterior, open air decking. ADDITIONAL- INFORMATION: The subject parcel was developed in the early 19th Century by the Cox family as a tidal, grist mill and was converted to a restaurant/inn in the early 20th Century, popularized during Prohibition and known for its `trap door' from the structure cantilevered over the Mattituck Creek allowing access for deliveries by boat, rumored to have been used by `rum-runners'. The existing Old Mill-structure lies on a non-conforming 4,829 square feet parcel which is partially underwater land with a large portion of the structure cantilevered over the creek. A small area of existing improvements lies within the adjacent 1,365 square feet easement area (No. 1). In order to preserve the deteriorating structure, the applicant proposes to elevate the existing two-story restaurant structure 4.5 feet (to achieve FEMA compliance) and replace and reinforce the existing steel and timber substructure. 388 square feet of the existing one-story structure (main dining hall of the restaurant) will be removed and replaced with a one-story open-air porch along with the removal of the remainder of the one-story structure, which will be replaced with open air decking. Exterior upgrades including siding, windows, doors and roof will be completed as part of the scope of work. Overall, the applicant proposes to maintain existing conditions while reducing lot coverage from 73.7%to 69.1%. The subject property is not listed on the Society for the Preservation of Long Island Antiquities nor is it listed on the Town of Southold Historic Preservation Commission. Mill Road, at an earlier time, crossed the Mattituck Creek at the subject parcel via a swing-bridge that was removed after storm damage in the late 1950's. Easement area No. 1 is formerly the bridge landing for the westside access point. Currently, Mill Road termites in front of the subject parcel and allows access to two property owners south of the site. Additionally,Mill Road has served as a parking area for the subject property. The applicant provided copy of the deed to the property and Easement Agreement between the Town of Southold and the applicant,which states:"Whereas,Grantor has determined that the Easement Area is no longer used or maintained by the Town of Southold or its residents and serves no public need or benefit...". Multiple images of the structure were supplied illustrating the building's evolution,over 120 years, from a grist mill to a popular,waterside restaurant. Many letters of support were received prior to the public hearing for this application. A farmer and area neighbor spoke about the importance of maintaining this structure for the community's benefit;they also shared personal testimony about their ancestors who worked on the building and maintenance of the structure during the 19ffi Century. The subject parcel is the recipient of ZBA decision #959 issued October 6, 1966 allowing placement of directional signage(now non-existent) at various points leading to the restaurant. During the public hearing the applicant stated that they are currently seeking approval for an upgraded Innovative/Alternative sanitary system with an application pending with Suffolk County Board of Health. The proposed upgraded system will be located across the street from the subject parcel, located on lands owned by the applicant and known as SCTM: 1000-106-6-4.1. This lot is developed with the current sanitary system serving the existing restaurant and it is also improved with a one and two story wood frame `tower' structure, previously used for storage. As part of the public hearing the applicant stated that they are reducing interior restaurant occupancy from an existing 150+ seats to an overall, interior, occupancy of 50, including the bar area. The applicant proposes an Page 4, December 16,2021 #7573,North Fork Project, LLC SCTM No. 1000-I06-6-3 additional 35 exterior seats contained on the porch and decking and will retain a portable `port-a-potty' bathroom for deck patrons to reduce the need for on-site wastewater management. No kitchen cooking facilities are proposed for the restaurant and the exhaust system (currently visible from the water) is proposed to be removed as part of the application,along with the removal of the stone fireplace in the bar area. A modest size,all electric kitchen was discussed to fulfill food preparation needs for restaurant patrons, although this was not included in the plans provided. The applicant indicates they would like to maintain employee housing on the second floor of the structure or use this space as personal housing or storage. No plans were included in the application to illustrate residential use on either the subject site or the `tower' property across Mill Road, also owned by the applicant, where the proposed I/A sanitary system servicing the restaurant is to be located. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 2,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Old Mill stands alone at the end of West Mill Road somewhat remote from any of the nearby residential structures. The Strong's Marina operation lies to the south. The Old Mill is in fact an integral part of the character of the surrounding community that is beloved by the residents of Mattituck and the entire town. The relief sought is essential to allow this structure to continue to strengthen the character of the neighbor for decades to come. All of the proposed improvements will replace or restore existing structures that are similarly non-conforming. Numerous letters in support from neighboring landowners on both sides of the Mattituck Creek and other members of the community confirm that the proposed renovation will be an enhancement to the nearby properties. 2. Town Law &267-b(3)(b)(1). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The benefit sought by the applicant cannot be achieved by any feasible method other than variance relief. This parcel is perhaps the most constrained parcel in the Town of Southold. The benefits sought are not personal to the applicant;they are shared by the community by way of the preservation and restoration of a beloved, historic structure and restaurant. Due to the extent of the pre-existing non-conformities, there is clearly no conceivable way to restore the Old Mill Inn without the request relief. 3. Town Law X267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 71.5% relief from the code relative to reduced minimum front yard setback, 68% relief from the code relative to reduced minimum rear yard setback, 100% relief from the code relative to reduced minimum side yard setback,and 39.1%increase over maximum lot coverage of 30%as allowed in the MII zone per code. However, while the setback relief may be mathematically substantial, it is not practically substantial since it will only allow what has been on the site for 200 years to remain. Absent relief,the structure will continue to deteriorate and will eventually and inevitably be lost. As for excessive lot coverage, the proposed improvements will actually result in a decrease from the existing 73.7%lot coverage to 69.1%. Moreover, if the square footage of the easement area(s) and the owner's additional lot where the subject parcel's sanitary system is located are considered, the net lot coverage would be substantially less. 4. Town La-vi, §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a FEMA compliant, restored and renovated historic tidal mill previously converted to a restaurant to include, when complete: 1,455 square feet of one-floor, interior restaurant space with second floor living/storage; 388 square feet open porch and 922 additional square feet of exterior, open air decking while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
