Maltese&Madeline Joyce Covello, residing at 825 Bailey Avenue, Greenport,New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated August 25, 2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTIQN: The subject property is a 6, 699 sq. ft. parcel located in an R-40 Zoning District. The parcel has a 50 feet road frontage on Bailey Avenue, then runs east for 140 feet to a shared Right of Way,the rear property line fronts the Right of Way for 50 feet,then returns west for 140 feet back to Bailey Avenue. The property is improved with a one and one half story frame dwelling-and an accessory garage in the rear yard as shown on survey prepared by John G. Ehlers,L.S.,.last revised February 23,2021. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124; and the Building Inspector's July 6,2021,Notice of Disapproval based on an application for a permit to demolish an existing accessory garage and construct a new accessory garage; at 1) more than the code permitted maximum lot coverage of 20%; located at: 825 Bailey Avenue, Greenport,NY. SCTM No. 1000-34-4-13. RELIEF REQUESTED: The applicant requests a variance to demolish an existing accessory garage and construct a new 14 feet by 25 feet accessory garage, resulting in a lot coverage of 25%where a maximum of 20% is allowed. ADDITIONAL INFORMATION: Testimony was given by the owner of the property that the existing garage was very small and not able to ft in both one car and assorted lawn maintenance equipment. He also explained the reason that the parcel has two listed street addresses. One address is known by the Post Office, while the other is known by the Fire Department. The applicant's representative listed several prior comparable variances granted in the area, which were also listed on the application addendum as follows: Page 2, DecemL__-_5,2021 #7569, Maltese SCTM No. 1000-34-4-13 Appeal#3885, Swimming Pool at 614 Bailey Avenue at 25% Iot coverage. Appeal#4867, Deck addition at 531 Sterling Place at 25.9% lot coverage. Appeal#7127, 780 Chaplin Place, Swimming Pool located in other than the rear yard. Appeal#5142, 620 Knapp Place, Accessory Garage granted rear yard setback relief. According to the applicant's testimony, electrical service shall be installed, but no plumbing is currently contemplated in the proposed garage. The subject property and proposed improvements are outside of the New York State Department of Conservation Tidal Wetlands Jurisdiction. FINDINGS OF FACT/. REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 2,2021, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law-§267-b(3)(b)(I). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed accessory garage is located in the required rear yard and meets all the setback constraints for an accessory building. Accessory garages are common in the Town of Southold and will not produce any change in the character of the neighborhood. 2. Town Law.§267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The existing lot coverage on the site is currently at 22.5 % which is over the 20%maximum allowable. Therefore, any new construction would require an area variance for lot coverage. 3. Town Law&267-bL3J(W(3). The variance granted herein is mathematically substantial, representing 25% relief from the code. However, the current lot coverage is 22.5%, and the applicant is only proposing to add 170 sq. ft. more to the size of the new garage than the square footage of the existing garage,proposed to be demolished. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. 'Town.Law §2'67-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. I'm sorry I didn't get to this before I left for the holidays. The reason for my inquiry was based on the fact that the application consists only of the replacement of an existing garage with a new,larger garage in the same location,on a property that does not contain wetlands. Rather,the project is located just inside Chapter 275 jurisdiction due to what the DEC characterizes as a"formerly connected tidal wetland" that is located on the opposite side of the neighboring house on the adjacent property. There is thus no opportunity for a wetland buffer on the property,and there was no public/neighbor interest in the project raised at the recent ZBA hearing. The ZBA approved the project. Having said all that,I don't see that the project actually falls into one of the qualifying categories under 275-5(B),so maybe I'm barking up the wrong tree. Maybe just double check with Glenn and let me know.
