Located: 2260 Great Peconic Bay Boulevard, Laurel. SCTM# 1000-145-4-4 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. The proposed action is listed within an NYSDEC Critical Environmental Area with high-quality intertidal wetlands located to the north. The use of CCA wood preservatives in construction projects is unsupported by Policies 5 and 6 of the LWRP. CCA is water-soluble and can leach arsenic, chromium, and copper into the waterbody. Another risk is that lower trophic animals that encounter the CCA-treated wood (snails, shellfish) have been shown to bioaccumulate the chemicals. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
