Yy as part of the consideration for the issuance of the Permit does understand and prescribe to the fol- lowing: 1. That the Southold Trustees Permit must be prominently displayed on the premises effected thereby during the period of + i � I2. Box 617 Cutchogue, NY 11935 Re: App. No. 1-11-90-110-7-26 Dear Mr. Fitzgerald: The following action was taken by the Board of Town Trustees during its regular meeting held on February 22, 1990 regarding the above matter:, WHEREAS, James Fitzgerald on behalf of Sy Stahl applied to the Southold Town Trustees for a permit under the provisions of the Wetland ordinance of the Town of Southold, application dated January 17, 1990 and, WHEREAS said application was referred to the Southold Town Conservation Advisory council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on February 22, 1990 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED THAT JAMES FITZGERALD ON BEHALF OF SY STAHL BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: Replace existing bulkhead (1321 ) ; add 151 return at each end. Fill behind new bulkhead. i This permit will expire two years from the date it is signed if work has not commenced by said date. I fully understand that the original permit expired six months ago, but I ask your indulgence in reconsidering the requirement that a new permit must be applied for. On 2/19/97, when the Board acted upon my request for an amendment to the original permit, there were only two months left before its expiration. It was an oversight on my part that an extension was not applied for in conjunction with the amendment, because it should have been obvious to everyone that the work could not be completed before the existing 4/27/97 expira- tion date. The NYSDEC Permit had not been received and we were still in discussions with them over the details of the project as amended at their "request". Even if we had the DEC permit, it is not likely that the work could have been completed in the remaining time at that time of year. The basis for my request is that permits issued by the Trustees are, according to the Terms and Conditions, "valid for a period of 24 mos. which is considered to be the estimated time re- quired to complete the work involved, but should circumstances warrant, request for an exten- sion may be made to the Board at a later date." The point is, I suggest, that the expiration dating is flexible, as it should be, and is conditioned on the reasonable ability of the applicant to cause the completion of the work in the time specified. The fact that both the Board and I overlooked the pending expiration when the amendment was being reviewed does not change any of the physical aspects of the project, and the new dating I seek is the same as it would have been if it had been extended at the time of the amendment. The applicant proposes to reconstruct existing piers, construct approximately 135 linear feet of rock revetment and dredge, with ten years maintenance, material from an area around existing piers to depths ranging from 4 feet to 7 feet below mean low water, removing approximately 350 cubic yards of material. The material would be used as backfill behind proposed revetment with the remainder of the material disposed of at a state-approved off-site upland location where it would be suitably retained so as to prevent its reentry into any waterway. Three future dredging events would be undertaken_during the life.of permit, removing approximately 100 cubic yards per event, which would also be disposed of at a state-approved upland location. The decision whether to issue a permit will be based on an evaluation of the probable impact, including cumulative impacts, of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historical properties, fish and wildlife values, floodplain values, land use, navigation, shoreline erosion and accretion,recreation,water supply and conservation, water quality, energy needs, safety, food and fiber production,mineral needs, consideration of property ownership and, in general, the needs and welfare of the people. The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Based upon a review of the latest published version of the National Register of Historic Places, there are no known sites eligible for, or included in, the Register within the permit area. Presently unknown archeological, scientific, prehistorical, or historical data may be lost by work accomplished under the required permit. Reviews of activities pursuant to Section 404 of the Clean Water Act will include application of the guidelines promulgated by the Administrator, U.S.Environmental Protection Agency,under authority of Section 404 (b) of the Clean Water Act and the applicant will obtain a water quality certificate or waiver from the appropriate state agency in accordance with Section 401 of the Clean Water Act prior to a permit decision. The work would involve construction of approximately 135 linear feet of new bulkhead above the mean high water mark in line with adjacent bulkheads and excavate and dredge, with ten years maintenance, approximately 75 cubic yards of material from an irregularly shaped area waterward of the new bulkhead to a depth of 4 feet below mean low water. Three additional dredging events are anticipated during the ten year life of permit, removing approximately 60 cubic yards of material per event. The material from initial and subsequent dredging events would be used as backfill material behind the proposed bulkhead.
