BASIS OF APPLICATION: Request for Variances .from Article XXIII, Section 280-124; and the Building Inspector's September 13, 2021 Notice of Disapproval based on an application fora permit to construct a one story addition connecting an existing single family dwelling to an existing detached garage;at 1)located less than the code minimum required side yard setback of 15 feet on two sides; 2). located less than the. code minimum required combined side yard setback of 35 feet located at: 1055 Point Pleasant Road;Mattituck,NY. RELIEF REQUESTED: The applicant requests variances for alterations and additions to an existing single family residence consisting of the construction of a new 4.8 feet by 8.9 feet enclosed laundry room connecting the dwelling to the accessory garage,thereby increasing the non-conformity of the side-yard setbacks for the existing house,where Page 2, January 20,2022 #7583, Polidora SCTM No. 1000-114-1-1 the new single side yard setback will be 1.6 feet where a minimum of 15 feet is required (already existing for the accessory garage)while maintaining air existing single side yard setback of 11.2 feet, where 15 feet is required, and increasing the non-conformity of the combined side yard setback,which will be12.8 feet after construction, where a combined side yard setback of 35 feet is required. All is shown on survey prepared by Angelo Joseph Cecere, L.S. last revised August 31, 2021. ADDITIONAL INFORMATION: No members of the public or immediate neighbors spoke in favor of or against this application. Improvements on the subject property are covered by Town of Southold Building Department PRE-EXISTING Certificate of Occupancy,#Z-26485 issued May 28, 1999 for a one-family dwelling with enclosed front porch, open rear porch, and accessory two car garage, built prior to April 9, 1957. The subject parcel is accessed via an unpaved public road and is located in a creekfront enclave of several homes developed around 1919. As.part of the proposed alteration and•additions, but not requiring Board relief,the applicant states that they will: • Demolish the existing single-story entrance and construct a new single-story entrance with basement under (same footprint). • Construct a new 4 feet by 10.5 feet covered entry porch. • Construct an enclosed outdoor shower, open to the sky. Demolish the existing 8.8 feet by 24.4,feet covered porch at rear and construct a new 18.67 feet by 38.8 feet single story addition with basement under(installing 4 feet by feet egress window). • Construct a new stone patio between the new addition and the existing garage. 0 Remove the existing cesspool. • Install a new, Suffolk County Board of Health approved, Innovative Advanced (UA OWTS) system with new waterproof retaining wall. Architectural drawings were submitted, labeled SKETCH F, dated March 24, 2021; Existing First Floor, South and East Elevation,and North and West Elevation,dated September 21,2021 and prepared by Nigel Robert Williamson, Registered Architect. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held.a public hearing on this application on January 6, 2022.at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-6(3)(6)(11. Grant of the variances will not produce an undesirable change,in the character of the neighborhood or a detriment to nearby properties: The Home Pike neighborhood consists of several creekfront residences built prior to zoning, most of which have been enlarged, expanded and substantially renovated. The enclave is accessed via an unimproved dirt road that formerly created a loop and is not commonly used by non- residents as it looks more like a private driveway than a public road; few people would understand its placement other than for the benefit of resident's use. As a result of the limited access, few pedestrians or motorists would be able to discern the relief sought in this application. The proposed improvement is undiscernible to most. The existing house is 11.2 feet from the western property line and the existing accessory garage is 1.6 feet from the eastern property line and have existed in their current locations prior to 1957 when zoning was enacted in the Town of Southold. The relief sought is not based on the expansion of either structure closer to the lot line, but rather by the proposed-4-,S--feet by 8.9-feet-addition-connectin.g the_two-buildings._ Page 3,January 20,2022 #7583, Polidora SCTM No. 1000-114-1-1 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The structures were built prior to zoning and cannot be easily moved. In order to achieve the required 15 feet side-yard setback and combined side-yard setback of 35 feet, the pre-existing structures would have to be `cut back'. This would create a substantial and unique hardship for the applicant, add unnecessary expense, and would structurally compromise the building. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing.89.3% relief from the code regarding the eastern side-yard setback; 25.3% relief from the code regarding the western side- yard setback;and 63.4%relief from the code regarding the combined side-yard setbacks.However,both the residence and the accessory garage were built prior.to zoning and the applicant does not propose expansion of the structure towards.either lot-line, but rather proposes to connect the existing house and existing garage into one structure. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical orenvironmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of-purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and additions toan existing single-family residence consisting of the construction of a new.4.8 feet by 8.9 feet enclosed laundry room connecting the dwelling to the accessory.garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Planamento,seconded by Member Dantes,and duly carried, to . . An undesirable change will not be produced in the CHARACTER of the neighbor or a detriment to nearby properties if granted, because: The existing house 11.2' from the west property line and the existing garage 1.6'from the east property line have been in existence since prior to 1957 and have framed part of the character of the community. The request for a variance is not based on the property addition other than the fact that the proposed 4.8' x 8.9'addition between the existing house and existing garage change the structure from a principal structure with an accessory garage to a principal structure. The benefit sought by the application CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: To achieve the required 15' side yard setback one side and a combined 35' setback to the side yard. The existing dwelling would have to be either cut back 3.8' to conform with the 15' setback or 8.8' to conform to the 20' setback to the existing garage could have to be either cut back 13.4' to confirm with the 15' setback or 18.4 to confirm to the 20' setback. Either option would produce a situation hardship for my clients to remove the west side of the dwelling or the east side of the garage. The amount of relief for the proposed connection is 1.9' or 40% based on a 35' total side yard setback. 3. The amount of relief requested is not substantial because: The amount of relief based on a new principal structure would be enormous. 11.2' to 15' =25% or 1.6' to 20' = 92% relief or 11.2' to 20' =44% or 1.6' to 15' = 89.4% relief. However, the structures are existing since prior to 1957 on a pie shaped site where the East to West dimension and the face of the structure to the front yard is tight. To conform to the present day zoning the existing garage would have to be removed and part of the existing dwelling 3.8' at minimum would have to be removed. All based on the connection of the existing dwelling to the existing garage.The amount of relief in the proposed request of the existing dwelling to the existing detached garage is minimal.
