Following their presentation,Committee members discussed the proposed with the applicants which led to the following comments: Plan changes to driveway circulation, parking, extended crush pad roof and added basement access ramp were reviewed and are acceptable. The presented sample of Accoya wood siding-finish "Uinta" is acceptable. The metal siding/roofing color sample of Drexel Metals "Charcoal-2022" was presented. The committee is unanimous in requesting a lighter color for the metal cladding as an alternative to this color selection. The areas to be covered in this material are extensive. Page 1 of 2 The lighter color will be less prominent in the landscape as well as more compatible with the established farm building vernacular on the North Fork. Additionally,a lighter color will absorb less solar radiation and will require less energy for cooling in the summer months. VI. Waivers Pursuant to Town Code §240-56 Waivers of Certain Provisions, the Planning Board may waive certain elements of the subdivision review §240-56 Waivers of certain provisions. "The Planning Board shall have the authority to modify or waive, subject to appropriate conditions, any provision of these subdivision regulations, if in its judgment they are not requisite in the interest of the public health, safety and general welfare, except where such authority would be contrary to other ordinances or state law." Main Issues A. The proposal is to essentially split the existing house lot in half. This creates a very non-conforming parcel that is half the size of what is required in the zoning district. This sets a precedent that is inconsistent with the Town's Comprehensive Plan, as well as the Town Zoning Code. The lot being split is already a separate recognized lot under Town Code, having been created by deed before 1983. Essentially the applicant is requesting is to subdivide an existing 2-acre parcel into two very non-conforming parcels with all rights intact. Allowing this resubdivision would result in two non-conforming situations that will likely lead to difficulties for future owners. The first non-conformity will be created by reducing the house lot from a conforming size of 84,505 sq. ft. to only 40,000 sq.ft. This results in a variance request of 50%. This is a very large variance. The second non-conformity will be adding a non-conforming amount of development-rights intact land to a development-rights sold parcel. The Zoning Board of Appeals has held that for a new use other than agricultural production uses to be permitted on such a parcel, the development-rights intact area must meet the minimum lot size in the bulk schedule. Depending on what rights are expected to remain with this non- conforming rights-intact area, another large variance may be required. The barns are proposed to be separated from the house property, and will technically become accessory uses without a principal use. The Planning Board has consistently found in the past that variances of this magnitude for residential lots in Southold Town are inconsistent with the Town's comprehensive plan and zoning. The Board has recommended a denial of variances of this magnitude to the Zoning Board of Appeals in every case in recent history. VII. Waiver of SC Department of Health approval prior to Planning Board approval This resubdivision does not qualify for the Planning Board's policy to waive receiving the SC Department of Health approval prior to Planning Board approval. The amount of land being transferred is relatively small, however this is essentially a subdivision rather than a transfer or land between developed lots due to the difference in the development rights status of each, and the type of development on each half of the property. See discussion above in Section VI. VIII. SEQRA Classification • Unlisted action (requires a variance) IX. Items to consider A. Consider whether or not this application, as proposed, is viable to move forward. a The large variance of 50% for the existing home parcel and the new development area will set a precedent for future requests and could serve to undermine our Town Zoning. There are many similar land arrangements in the two-acre zoning district which could be affected by this decision. o Finding places for farm managers and other farm employees to live is a problem in the Town. Splitting the homestead from the farm buildings will divorce the living space from the farm operation. B. Consider possible options to this proposal that might allow the owners to achieve their goals without large variances being required. C.
