SCTM No. 1000- 57-2-26. The proposed action has been reviewed to Chapter 268,Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standard and therefore is INCONSISTENT with the LWRP. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. Policy 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The proposed reconstruction is not supported by these policies due to: I. The increase in structure over the permitted 20 percent lot coverage on a nonconforming parcel within the FEMA Flood Zone AE EL 6' is unsupported. Structure within these areas suffer damage and loss over time from storm events; including hurricanes and should be minimized. Approval of the proposal is not consistent with Policy 1 and 4.2 in that it would set precedent in the area to expand structure in special flood hazard areas. Homes located in special flood hazard areas have a 26 percent chance of suffering flood damage during a normal 30-year loan according to FEMA. 2. The reconstructed structure is proposed 22.1 feet from a jurisdictional wetland. Chapter 275 Wetlands and Shoreline requires a 100' setback to protect the natural feature. There is ability to relocate the structures landward. 3. The proposal for 4 bedrooms and 5.5 baths should be assessed to the current sanitary system on- site. What is the timing of install of the I/A OWTS? In the event the action is approved, SLOSH(Sea,Lake, and Overland Surges from Hurricanes NOAA National Storm Surge Hazard Maps)mapping indicates that the entire parcel would be affected by a Category 1 Hurricane and build out should be designed accordingly. Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
