The as built accessory shed was constructed without the benefit of Board action or review. The second-floor extension and associated setbacks are EXEMPT from LWRP Coastal Consistency Review. Name of Owner: John & Margaret Krepp ZBA File # REASONS FOR APPEAL (additional sheets may be used with preparer t si nature): AREA VARIANCE REASONS.- (1) EASONS.(1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The property was previously improved with a house which was demolished and replaced with the existing house constructed in 1990(CO dated January 14, 1991). The new house was constructed with conforming setbacks applicable at the time. (CO for house permit #219654). The parcel did not include the additional acreage obtained from "Latson Hot line change", approved by Planning Board in 2004. The property also contained the existing shed. The existing shed appears on the prior surveys. The shed is less than 100 square feet and complied with setbacks for the pre-Lot line change lot. The proposed second floor addition is stepped back to 17.3 on the east side and 6.7 feet on the west side. When the addition was planned the owner wanted to build a conforming addition without the need for variances. The Latson merger cause the need for the variances. As to the shed: The house needs storage, and the shed predates the house. Because there is no pre-CO for the shed the building department has included this shed in the application. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The existing house is located on the south side of Island View Lane. The waterfront lot is improved with a legal single-family dwelling and existing accessory structure. The applicant purchased a vacant lot from the Latson family (tag Lot #1000-57-2-42.7) which cannot be developed with a dwelling. In 2004 Mr. Latson by his attorney Paul Camini ti asked the Planning Board to authorize the merging of part of the Latson land to John Krepp. The Latson property contains C&R's which prevent development of the parcel. The Planning Board approved the merging of the parcels. The assessors thereafter combined the two lots (tax Lot #1000-57-2-42.7 and 1000-57-2-18) to get one tax bill. The applicants want to renovate their home, but the larger lot (Latson acreage) affects the setbacks. When the lot was merged they did not anticipate that the setbacks would be affected. (2) The amount of relief requested is not substantial because: The proposed second floor addition is on an existing house. The front yard setbacks are 43.5 from an existing right of way used as Island View Lane. There is an additional 16' right of way which was granted to the Village of Greenport for utilities (water line). The existing house is retained. The roof will be raised for the 2nd floor addition. The owners indented the new construction at less than the existing side yard setbacks of the house in an effort to conform to the required setbacks of a non-conforming lot. However, because of the additional acreage of the Latson lot line change, the larger setbacks for a nonconforming lot which is greater than 20,000 sq.ft. apply to the parcel. The existing sanitary system was replaced in 1990 when the house was constructed, and the sanitary system was constructed for a 4-bedroom house. The Trustees approved a wetland permit for the deck prior to construction. The existing house will rewire a wetland permit. A second floor on an existing house is exempt from 275. WHEREAS, a public hearing was held on April 30, 1991 and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. By this application, appellant seeks a variance under Article XXIII, Section 100--239.48 for a proposed open deck addition of a size 20 feet wide by 12 feet deep, plus a step and platform, to be set back approximately 29 feet to the retaining wall, as shown on the sketch submitted for consideration. 2. The premises in question is identified on the Suffolk County Tax Maps as District 1000, Section 57, Block 2, Lot 18, contains a total lot area of approximately 9,900 sq. ft. and road frontage of 60 feet. 3. The dwelling which exists is presently set back approxi- mately 55 feet from the retaining wall structure and approxi- mately 47 feet to the front property line. 4. Article XXIII, Section 100-239.4E of the Zoning Code requires all buildings and structures located on lots upon which f 3 i Page 2 - April 30, 1991 Appl. In considering this application, the Board finds: (a) although the relief requested is substantial in relation to the code requirements, the percentage from the existing average setbacks in the area is minimal; (b) the relief requested is the minimum necessary to afford relief; (c) the relief as requested will not alter the essential character of the neighborhood; (d) the difficulties claimed are uniquely related to the property, since the property is substandard in size and has limited buildable area; (e) the grant of the relief as requested will not in turn be adverse to the safety, health, welfare, comfort, convenience or order of the town; (f) in view of all the above, the interests of justice will be served by granting the relief as requested and further noted below. Accordingly, on motion by Mr. Goehringer, seconded by Mr. Grigonis, it was RESOLVED, to GRANT a variance in the Matter of the Application of CHARLES KREPP under Appl. No. 4019 for permission to construct open deck addition with step areas as applied and SUBJECT TO THE FOLLOWING CONDITIONS: 1.
