THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2022-87 WAS
ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
JANUARY 4, 2022:
WHEREAS,there has been presented to the Town Board of the Town of Southold, Suffolk
County,New York, on the 14"' day of December, 2021, a Local Law entitled "A Local Law in
relation to Amendments to Chapter 233, Solid Waste, to revise § 233-4 Fees; issuance and
duration of permits and licenses, and
WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid
Local Law at which time all interested persons were given an opportunity to be heard, now
therefor be it
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
Law entitled, "A Local Law in relation to Amendments to Chapter 233, Solid Waste, to
revise § 233-4 Fees; issuance and duration of permits and licenses" reads as follows:
LOCAL LAW NO. 1 of 2022
A Local Law entitled, "A Local Law in relation to Amendments to Chapter 233, Solid
Waste, to revise 233-4 Fees; issuance and duration of permits and licenses".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
1. Purpose.
The purpose of this local law is to clarify permitting requirements.
II. Chapter 233 of the Code of the Town of Southold is hereby amended as follows:
Chapter 233 Solid Waste
§ 233-4 Fees; issuance and duration of permits and licenses.
A.(1)(a) A resident disposal permit shall be issued by the Town Clerk or a person
designated by hef the Town Clerk to all persons who are qualified residents of
the Town of Southold. Persons applying for a resident disposal permit shall be
requested to s;a, an applieation in affidavit form an submit for inspection the
following as proof of residence:
[1] A valid tax receipt stub for the current year for any taxable real property
within the Town of Southold assessed in the name of the applicant.
[2] A valid motor vehicle registration in the name of the applicant and to an
address located within the Town of Southold or to an address
corresponding to the address of a validated tax receipt stub for the current

tax year for any taxable real property within the Town of Southold affixed
to the appheation.
[3] Such other proof of residence as is satisfactory to the Town Clerk.
(b) The Town Clerk or a person designated by the Town Clerk shall inspect such
applicatiun proof of residence to detennine that the applicant is a qualified
resident of the Town. Upon approval of the apemen proof, a resident disposal
permit shall be issued and inscribed with the vehicle license registration number.
Such permit shall not be transferred to any other vehicle.
(c) Resident disposal permits for motor vehicles shall be poi ffl fiend„ ^ffi:ed to LAW

mirror while at the Transfer Station.
(2)(a) A lessee disposal permit shall be issued by the Town Clerk or a person designated
by he}the Town Clerk to all persons who lease or rent property within the Town
of Southold but do not qualify as residents as defined in § 233-4A(1) hereof.
Persons applying for a lessee landfill permit shall present an appheation in
affidavit form, a fully executed lease/rental agreement signed by the lessee and
the owner of the property, setting forth:
[1] The location of the leased or rented property.
[2] The persons occupying the same.
[3] The term of such tenancy.
[41 Copy of current rental permit issued from the Southold Town
Building Department or the Village of Greenport Building
Department
(b) Upon a determination by the Town Clerk or person designated by le+- the Town
Clerk that the applicant is entitled to a lessee disposal permit and upon the
payment of the permit fee, such permit shall be issued and inscribed with the
vehicle license registration number and shall be affixed to the vehicle in the same
manner as provided in § 233-4A(1)(c) hereof.
(3)(a) A guest disposal permit shall be issued by the Town Clerk or a person designated
by the Town Clerk to all persons who are qualified residents of the Town of
Southold, as defined in § 233-4A(1) hereof for use by guests temporarily residing
in the dwelling of such resident. A resident applying for a guest landfill disposal
permit shall present an applieation ; affidavit form, ed by the plie nt

[1] The location of the property to be occupied by the guests.
[2] The names and permanent addresses of the guests.
[3] The length of time of the guest occupancy.
(b) Upon a determination by the Town Clerk or person designated by he-r- the Town
Clerk that the applicant is entitled to a guest disposal permit and upon the
payment of the permit fee, such permit shall be issued and inscribed with the
vehicle license registration number and shall be affixed to the vehicle in the same
manner as provided in § 233-4A(1)(c) hereof.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by
any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this
law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.

IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as
provided by law

4 Suffolk Times . I have an invoice from the
5 Suffolk Times . I have the legal notice that
6 it was posted. I am going to read from this
7 notice . Notice is hereby given and
8 presented to the Town Board of the Town of
9 Southold, Suffolk County, New York on the
10 14th of December, 2021 , Local Law entitled,
11 "A Local Law entitled 215 Sewage and Sewage
12 Disposal . A notice is hereby further given
13 that the Town Board of the Town of Southold
14 will hold a Public Hearing on the aforesaid
15 Local Law at the Southold Town Hall, 53095
16 Main Road, Southold, New York on the 4th day
17 of January 2022 at 4 : 30 P .M. , at which time
18 all interested persons will be given an

21 Sewage Disposal, remove Part I, Scavenger
22 Waste from the code . The purpose of this
23 Local Law is to remove the sections of the
24 code that are not in use and are not
25 expected to be utilized in the future . This

1 will be accomplished by amending Chapter 215
2 Part I of the code and leave in the
3 remaining sections of the Chapter 15 intact .

Be it enacted the Town Board of the:

I. Purpose.

Waste, to revise 233-4 Fees; issuance and duration of permits and licenses".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The purpose of this local law is to clarify permitting requirements.
H. Chapter 233 of the Code of the Town of Southold is hereby amended as follows:
Chapter 233 Solid Waste
§ 233-4 Fees; issuance and duration of permits and licenses.
A.(1)(a) A resident disposal permit shall be issued by the Town Clerk or a person
designated by hff the Town Clerk to all persons who are qualified residents of
the Town of Southold. Persons applying for a resident disposal permit shall be
requested to sign an applieation in affidavit fefm and submit for inspection the
following as proof of residence:
[1] A valid tax receipt stub for the current year for any taxable real property
within the Town of Southold assessed in the name of the applicant.
[2] A valid motor vehicle registration in the name of the applicant and to an
address located within the Town of Southold or to an address
corresponding to the address of a validated tax receipt stub for the current
tax year for any taxable real property within the Town of Southold aid
to the plio t;�
[3] Such other proof of residence as is satisfactory to the Town Clerk.
(b) The Town Clerk or a person designated by the Town Clerk shall inspect such
applieatien proof of residence to determine that the applicant is a qualified
resident of the Town. Upon approval of the applies goof, a resident disposal
permit shall be issued and inscribed with the vehicle license registration number.
Such permit shall not be transferred to any other vehicle.
(c) Resident disposal permits for motor vehicles shall be pefmanefA y affixed te-t1—

(2)(a) A lessee disposal permit shall be issued by the Town Clerk or a person designated
by her the Town Clerk to all persons who lease or rent property within the Town
of Southold but do not qualify as residents as defined in § 233-4A(1) hereof.
Persons applying for a lessee landfill permit shall present an applieation in
.,f'F;aayit f Fm, a fully executed lease/rental agreement signed by the lessee and
the owner of the property, setting forth:
[1] The location of the leased or rented property.
[2] The persons occupying the same.
[3] The term of such tenancy.

(b) Upon a determination by the Town Clerk or person designated by her-the Town
Clerk that the applicant is entitled to a lessee disposal permit and upon the
payment of the permit fee, such permit shall be issued and inscribed with the
vehicle license registration number and shall be affixed to the vehicle in the same
manner as provided in § 233-4A(1)(c) hereof.
(3)(a) A guest disposal permit shall be issued by the Town Clerk or a person designated
by the Town Clerk to all persons who are qualified residents of the Town of
Southold, as defined in § 233-4A(1) hereof, for use by guests temporarily residing
in the dwelling of such resident. A resident applying for a guest landfill disposal
permit shall present an applieation in ^oda itme signed by':he "YY'heart

[1] The location of the property to be occupied by the guests.
[2] The names and permanent addresses of the guests.
[3] The length of time of the guest occupancy.
(b) Upon a determination by the Town Clerk or person designated by her the Town
Clerk that the applicant is entitled to a guest disposal permit and upon the
payment of the permit fee, such permit shall be issued and inscribed with the
vehicle license registration number and shall be affixed to the vehicle in the same
manner as provided in § 233-4A(1)(c) hereof.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by
any court of competent jurisdiction to be invalid,the judgment shall not affect the validity of this
law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as
provided by law
