Be it enacted the Town Board of the:

I. A new Chapter 106 of the Code of the Town of Southold is hereby adopted as follows:
A Local Law entitled, "A Local Law Opting out of Adult Use Cannabis Retail
Dispensaries and On-Site Consumption Sites".
§ 106-1 Legislative Intent
It is the intent of this local law to opt out of allowing cannabis retail dispensaries and on-site cannabis
consumption sites in the Town of Southold that would otherwise be allowed under Cannabis Law Article 4.
New York Cannabis Law requires Towns to opt out prior to December 31, 2021 or forever lose the right to do
so. Thus, in order to allow the public to decide for themselves by permissive referendum whether to allow retail
dispensaries and on-site consumption in the Town of Southold it is necessary to opt out at this time.
§ 106-2 Authority.
This local law is adopted pursuant to Cannabis Law § 131 which expressly authorizes the town board to adopt a
local law requesting the Cannabis Control Board to prohibit the establishment of cannabis retail dispensary
licenses and/or on-site consumption licenses within the jurisdiction of the town and is subject to a permissive
referendum,the procedure of which is governed by Municipal Home Rule Law § 24.

§ 106-3 Local Opt-Out.
The Town Board of the Town of Southold hereby opts out of allowing cannabis retail dispensaries and on-site
cannabis consumption sites from being established and operated within the Town's jurisdiction.
II Severability.
If any clause, sentence,paragraph, subdivision, or part of this Local Law or the application thereof to any
person, firm or corporation, or circumstance, shall be adjusted by any court of competent jurisdiction to be
invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the remainder thereof,
but shall be confined in its operation to the clause, sentence,paragraph, subdivision, or part of this Local Law or
in its application to the person, individual, firm or corporation or circumstance; directly involved in the
controversy in which such judgment or order shall be rendered.
III Permissive Referendum/Referendum on Petition
This local law is subject to a referendum on petition in accordance with Cannabis Law_§ 131 and the procedure
outlined in Municipal Home Rule Law § 24.
IV Effective date.
This local law shall take effect immediately upon filing with the Secretary of State.

Subject: opt for local growing and retail sale of marijuana
Thank you for receiving this comment/opinion regarding whether Southold Town should opt in to having retail
marijuana sales in this Town.
Why would anyone oppose this?Of course commercial growing and retail selling of marijuana should be allowed in
Southold Town!
Where such outlets have been allowed elsewhere in the United States, they have become establish,ordinary,
unremarkable commercial operations that create and maintain jobs, spin-off side businesses,generate substantial tax
revenue, and answer a market want while putting a dent in the flourishing local black market marijuana trade.
Many nations,states, and municipalities have made it work, reaped the tax benefits, and not lost the souls of their
communities or their children in the process.There is no reason this business cannot flourish contribute here, as well.
And to be blunt (sorry) about it: 1) If we do not, Riverhead will (has already) and it will reap the benefits of businesses,
jobs, and tax revenue, and 2) if it is a matter of morals, public safety, or whatever, when do we ban all these wine-
makers and beer-brewers?

My name is Frederick Cornman. I am a retired Senior Inspector from the US
Customs Service,stationed at JFK International Airport from 1987 to 2002. In
the course of my career there, I worked in passenger processing,and later in the
cargo branch with many narcotic seizures and arrests.Additionally, I was the
first inspector to hold the position cif Xray coordinator,servicing and using the
new machines for contraband detection. Later, l also instructed other officers in
the proper use of the nuclear detection monitors, both clipped on the uniform,
and also mounted under the then new color Xray machines. I was an instructor
in five overseas teaching assignments in India,the Baltic States, and Central
Asia.These assignments involved sharing our methods for detecting narcotics,
money, and many other illegal items/substances coming into those countries. ,
one of the necessary_but distasteful duties involved monitoring the excretion of
narcotics from the bodies of detainees in a medical setting or hospital. In the
course of this assignment I had the opportunity to speak with many smugglers
and learn their individual drug habits. Based on fifteen years of professional
federal law enforcement activity, I believe the following:
1. Generally,the Supremacy Clause of the US Constitution grants superior
authority to the federal government over all states,as long as they both
address the same issue,and the government law is consonant with the
Constitution.The NYS lav+!re MJ are illegal,and must be repealed.
2. Marijuana (THC) is NOT safer than alcohol,is more addictive,and is used .
first by addicts,who then frequently move to stronger drugs.This is why
the DEA has kept MJ on the.Schedule One List to date .Also, alcohol
(wine) is classed by the'FDA as a FOOD ITEM.Any cook/chef will agree
with that.

great deal of research to be done concerning the effects of marijuana
on the health of humans due to the fact that widespread marijuana
use has only become prevalent in this country within the last three
decades, so the effects of long-term use are just beginning to become
apparent. I should also add that in making these observations, I have
concentrated on the risks of smoking natural marijuana,since it is the most effective method
of ingesting its active cannabinoids.

As a resident of Southold Hamlet I strongly recommend that Southold Town
Opts out of Adult Use of Cannabis Retail Dispensaries and On-Site
Consumption for the following reasons:
1. We do not have to legalize the sale in Southold Town, for those who feel they
must break the law to obtain cannabis, this in not true. They just need to travel
to a town where it is legal.
2. Our roads are very busy and we frequently have serious accidents due to
DWI, the ease of access to cannabis will only lead to more accidents, deaths
and injuries.
3. The adult use of such products will only lead to more use by minors.
Although it is illegal for minors to obtain, we cannot control the use of alcohol
and tobacco.
4. Presently there are "drug free" zones around our schools intended to protect
our children. However. the present store adjacent to Southold Library will be
allowed to sell such products only a few feet away from a facility used by
residents of all ages, especially school age children.
For these and other reasons, I strongly support the Southold Town Board in
Opting out of the Adult Use of Cannabis Retail Dispensaries and On-Site
Consumption.

As you are well aware,it has come time to decide where Southold Town stands
regarding the Marijuana Regulation&Taxation Act(MRTA). With this crucial
decision upon your community, I feel it is urgent that I underscore the comments
made at your December 14"hearing by staff member and new resident of Mattituck,
HUGS, Inc.Staff Jackie Kanarvogel, respecting the impact of your decision on Southold Town's
Kymberly A Laube youth. I write to you as a mother, an educator, and the current executive director of
Executive Director Human Growth and Understanding Services, Inc. ("HUGS"), an organization
Jackie Aldrich dedicated to supporting the health and well-being of our communities. I believe the
Teen Institute Coordinator
& Sr. Prevention Educator Board understands the ramifications of the choice put before you. With the current

being made that financial benefits must be considered, but I am not writing to
www.hugsinc.org comment on adults who favor the state legalization of marijuana. Our concern is for
the children and teens who undoubtedly will be affected by the lack of well thought-
out regulations.
It is our mission at HUGS to prevent early use of substance, and the greatest challenge for teens
is when they see the adults in their life normalizing substance use, and of course think"well
then,why can't I do it too?" The reason it is dangerous for teens to start using drugs, alcohol, or
nicotine is very clear and scientifically validated. The frontal lobe in our brain(the very thing
that keeps us from making risky choices), the part that helps us pause and reason,the part of the
brain that helps us make healthy decisions keeping us safe is not fully developed until
approximately 25 years of age. Teens are more likely to make risky decisions that could cause
them harm during this highly social period of development. Dangerous choices are frequently
made to impress their peers. If a teen uses any brain-altering substance while their frontal lobe is
still developing they forever alter the chemical makeup of their brain. This can affect
neurocognitive function and creates a marked increased chance of problem use and addiction
later in life. 90%of adults who suffer from addiction began using an addictive substance in their
youth. The statistics are startling and very real. As community leaders and role models we have a
responsibility to our youth. How we act now will have a great impact on their future.
A decision may be made to opt in at some point in the future, but in states like California that
have already legalized recreational use, statistics show an increase in teen use of 23%. If you
look at state by state data comparing legalized states to non-legalized states, legalized states
report a youth marijuana use increase across the board. We urge you to opt-out. It will give
Southold Town the time it needs to prepare for what is to come, assess the policies and
regulations once the state rolls them out, and give us all time to create local policy to help
maintain the integrity of our communities.
Please know that HUGS is ready, willing and able to offer support and expertise as you navigate
your way to a sound cannabis policy for Southold Town.

On March 31, 2021, New York State signed into law legalizing the commercialization of adult use marijuana in New York
State.
This new law, especially for our youth, is very troubling. Currently, cannabis laced cookies, designed like Oreos and
Chips Ahoy, are being marketed as"Stoneo" and "Trips Ahoy." They are being sold in stores on Long Island and on the
internet. This packaging is clearly targeted to children in a dangerous way.
Although the law legalizing marijuana does not allow for opting out of full legalization, it does allow an "OPT OUT"
provision for towns, cities, and villages to ban licensed adult-use cannabis retail dispensaries, and on site consumption
establishments in their jurisdiction.This "opt out" must be completed by December 31, 2021 or the local government
loses their right to "opt out."
Therefore, I respectfully request that you:
Immediately pursue and pass an "OPT-OUT" ordinance that will ban licensed retail sales dispensaries, and
on site consumption establishments in our municipality;
Ban the sale of all THC cookies and candy;
Ban the smoking of marijuana in all town owned properties, parks, beaches, preserves, and golf courses;
And update your social host law to prohibit the consumption-of marijuana for minors under the age of 21.
Opting Out is important to protect our beautiful town and the health and future of our youth. Please make it your
immediate priority to pass an "OPT-OUT' ban before the deadline of December 31, 2021.

Honorable Southold Town Supervisor and Town Board:
Southold Town is planning to hold a public hearing on December 14"', 2021 to solicit input for
potentially prohibiting the sale of retail marijuana with subsequent voting in a special meeting
prior to December 31, 2021, on whether to opt out of allowing on-site consumption and/or retail
dispensaries from locating and operating within the boundaries and authority of the Town of
Southold, New York.
It is our request that the Town of Southold vote to pass a local law opting out of adult-use
cannabis retail dispensaries and/or on-site consumption businesses, such as marijuana and/or
smoke lounges from operating in the Town of Southold authority. We are adamantly opposed
against "on-premises" sale and consumption of marijuana at any public facilities within the
authority of the Town of Southold.
My wife and I view marijuana as a "Gateway" drug with its use likely to precede use of other
licit and illicit substances and the development of addiction to other substances. For instance, a
study using data from the National Epidemiological Study of Alcohol Use and Related
Disorders found that adults who reported marijuana use during the first wave of the survey were
more likely than adults who did not use marijuana to develop an alcohol use disorder within
three years; people who used marijuana and already had an alcohol use disorder at the outset
were at greater risk of their alcohol use disorder worsening and its use also linked to other
substance use disorders including nicotine addiction.
It is our opinion that establishing marijuana as a "third legal drug" along with tobacco and
alcohol, will increase drug abuse.
Marijuana use is positively correlated with alcohol use and cigarette use, as well as illegal drugs
like cocaine and methamphetamine. This does not mean that everyone who uses marijuana will
transition to using heroin or other drugs, but it does mean that people who use marijuana also
consume more, not less, legal, and illegal drugs than do people who do not use marijuana. People
who are addicted to marijuana are three times more likely to be addicted to heroin. The
legalization of marijuana increases availability of the drug and acceptability of its use which is
bad for public health and safety.
This is not to say of its other health affects such as smoking marijuana clearly damaging the
human lung with regular use leading to chronic bronchitis and potentially causing an immune-
compromised person being more susceptible to lung infections. Due to the risks it poses to lung
health, the American Lung Association strongly cautions the public against smoking marijuana,
and that no one should have the potential for exposure to secondhand marijuana smoke. To this,
it is unclear how the Town will protect our youth, residents and visitors/tourists from retail and
consumption locations.
A better drug policy is one that actively discourages marijuana use as well as other recreational
drug use, especially for youth. The aggressive commercialization of marijuana that is now
rampant, still growing and now threatening our Town population is particularly damaging to the

public health because it markets marijuana and an array of increasingly potent products in ever
more attractive ways that encourage marijuana use and frequent high-dose THC (cannabinoid
molecule in marijuana).
In closing, we are at a crossroads. Legalizing marijuana will have lasting negative effects on
future generations. Currently legal drugs (alcohol, and tobacco) are two of the leading causes of
preventable illness and death in the country. Establishing marijuana as a third legal drug will
increase the national drug abuse problem, including expanding the opioid epidemic.
We should not be doing anything to encourage the sale and consumption of this type of drug
related material and we do not accept the notion that legitimatizing its sale and consumption will
have any positive aspects on life in the Town of Southold.
Therefore, we request that the Town Board vote prior to December 31, 2021, for a local law
opting out of adult-use cannabis retail dispensaries and/or on-site consumption businesses such
as marijuana and/or smoke lounges from operating in the Town of Southold authority,
including any public facilities within the authority of the Town of Southold.

Dear Supervisor Russell and Members of the Board:
At your December 14th public hearing, I voiced my hope that the Board willspt-out-:of;:
_retail and medical dispensary cannabis outlets in Southold Town to allow the state to get
its act together and the town to have-the information necessary to move forward when
the time inevitably comes that these outlets will become part of the fabric of our
everyday lives. I continue to urge that time and care be taken via the opt-out option.
I'd like to address something that has not been discussed and is a separate issue from
the legalization of cannabis in New York State, and is of great concern for all of us -the
precious commodity of clean, fresh water. Here on the North Fork, we have fruit and
vegetable farmers, and many who grow wine grapes, hops, flowers and sod. It can be
argued that wine grapes, hops and flowers aren't particularly necessary commodities,
and as a so-called agricultural crop I submit that sod is a deplorable waste of both land
and water, but worse yet, because of legalization,we are now confronted with a
burgeoning "crop" of cannabis growers. The amount of water required to grow cannabis
will beat sod farm consumption easily. With salt water intrusion, road runoff, nitrogen
loading from fertilizers used commercially and domestically, and the population
explosion as people have "discovered"the North Fork we have reason for alarm at this
latest drain on our resources.
In 2018, a report by Peconic Green Growth delivered alarming news; according to PGG's
Executive Director, Glynnis Berry: "In just six years, the Orient and East Marion five-
foot groundwater contours have disappeared from a 2016 map documenting
groundwater elevation, the deep section of the Cutchogue aquifer is not showing, and
the deeper contours west of Mattituck Creek have pulled back from both the coast and
the east."Additionally, Ms. Berry stated that according to a 2011 study by national
environmental consultants CDM Smith, entitled Long-Term Potable Supply in Southold,
New York: Managing a Limited Freshwater Aquifer in a Largely Agricultural Region, if
seasonal demand for water is not curbed, by 2030 the aquifer will be 40 feet shallower

Is the Board consciously considering how our water supply is and will be affected by
these pot farms springing up in the township?Are there code changes that can be made
to address the proliferation of this crop and its drain to our water supply? Will you
address this with each other and then with the public?Will you do that soon?Time is
short and our water supply is getting even shorter.

over the limit.

Thank you for receiving this comment/opinion regarding whether Southold Town should opt in to having retail
marijuana sales in this Town.
Why would anyone oppose this? Of course commercial growing and retail selling of marijuana should be allowed in
Southold Town!
Where such outlets have been allowed elsewhere in the United States, they have become establish, ordinary,
unremarkable commercial operations that create and maintain jobs, spin-off side businesses, generate substantial tax
revenue, and answer a market want while putting a dent in the flourishing local black market marijuana trade.
Many nations,states, and municipalities have made it work, reaped the tax benefits, and not lost the souls of their
communities or their children in the process.There is no reason this business cannot flourish contribute here, as well.
And to be blunt(sorry) about it: 1) If we do not, Riverhead will (has already) and it will reap the benefits of businesses,
jobs, and tax revenue, and 2) if it is a matter of morals, public safety, or whatever, when do we ban all these wine-
makers and beer-brewers?

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. A new Chapter 106 of the Code of the Town of Southold is hereby adopted as follows:
A Local Law entitled, "A Local Law Opting out of Adult Use Cannabis Retail
Dispensaries and On-Site Consumption Sites".
106-1 Legislative Intent
It is the intent of this local law to opt out of allowing cannabis retail dispensaries and on-
site cannabis consumption sites in the Town of Southold that would otherwise be allowed
under Cannabis Law Article 4.
New York Cannabis Law requires Towns to opt out prior to December 31, 2021 or forever
lose the right to do so. Thus, in order to allow the public to decide for themselves by
permissive referendum whether to allow retail dispensaries and on-site consumption in the
Town of Southold it is necessary to opt out at this time.

This local law is adopted pursuant to Cannabis Law § 131 which expressly authorizes the
town board to adopt a local law requesting the Cannabis Control Board to prohibit the
establishment of cannabis retail dispensary licenses and/or on-site consumption licenses

procedure of which is governed by Municipal Home Rule Law 24.

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. A new Chapter 106 of the Code'of the Town of Southold is hereby adopted as follows:
A Local Law entitled, "A Local Law Opting out of Adult Use Cannabis Retail
Dispensaries and On-Site Consumption Sites".
106-1 Legislative Intent
It is the intent of this local law to opt out of allowing cannabis retail dispensaries and on-
site cannabis consumption sites in the Town of Southold that would otherwise be allowed
under Cannabis Law Article 4.
New York Cannabis Law requires Towns to opt out prior to December 31, 2021 or forever
lose the right to do so. Thus, in order to allow the public to decide for themselves by
permissive referendum whether to allow retail dispensaries and on-site consumption in the
Town of Southold it is necessary to opt out at this time.
106-2 Authority.
This local law is adopted pursuant to Cannabis Law 4 131 which expressly authorizes the
town board to adopt a'local law requesting the Cannabis Control Board to prohibit the
establishment of cannabis retail dispensary licenses and/or on-site consumption licenses
within the iurisdiction of the town and is subject to a permissive referendum, the
procedure of which is governed by Municipal Home Rule Law § 24.
4 106-3 Local Opt-Out.
The Town Board of the Town of Southold hereby opts out of allowing cannabis retail
dispensaries and on-site cannabis consumption sites from being established and operated
within the Town's jurisdiction.
