The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standard and therefore is INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. Both Chapter 275 Wetlands and Shorelines and Chapter 280 Zoning of the Southold Town Code requires a 100' setback from a pool and related structures to a bluff system. The intent of the setback is to minimize impacts on the natural protective feature and protect structures from damage and loss due to storms and erosion over time. Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The LWRP Coordinator issued a recommendation dated January 30, 2017.Based upon the information provided 'on the LWRP Consistency Assessment Form submitted as well as the records available, it is the coordinator's recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. SUFFOLK COUNTY SOIL AND WATER CONSERVATION- DISTRICT (SWCD): This application was referred for an evaluation and recommendation. According to a letter from the agency, dated February 1,2017,an inspectiop of the property was conducted on January 4, 2017.The agency technician observed areas of the bluff as highly unstable in areas of water sprinkler installation, and in some areas erosion -was apparent. It was recommended, in order to maintain bluff stability, that excavation and construction equipment not to be stored or left running in proposed construction area, additional rooftop stormwater contribution be installed to divert run off away from bluff face,and re-vegetative planting for bluff stabilization. Landscape debris needs to be removed and bluff should be regularly inspected and immediately repaired especially after storm events. PROPERTY FACTS/DESCRIPTION: The parcel is a non-conforming 26,355 square foot waterfront parcel located in an R-40 Zoning District. The parcel measures 100 feet along the Long Island Sound to the north, measures 100 feet along the southerly property line fronting Soundview Avenue , 268.14 feet on the along the westerly property'line and265.48 feet along the easterly property line The property is improved with a two story frame dwelling, an attached garage and rear porch As shown on a survey prepared by Paul Barylski, LLS dated November 5,2016. - Page 3,February 16,2017 #7026,Lavalle SCTM No. 1000-15-3-7 GRANT the variance as applied for, and shown on the Architectural plans prepared by Charles M.
