SCTM No. 1000-137-4-34. ' The proposed side yard setbacks are EXEMPT from LWRP review pursuant to § 268-3. Definitions. MINOR ACTIONS item"F". The proposal to increase the permissible lot coverage over 20 percent is recommended as INCONSISTENT with the LWRP. Policy 1. "Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. " The expansion of an existing structure over the permitted 20% lot coverage is inconsistent with the above policy as it does not support a pattern of development consistent with the Southold Town Code. Policy 4.1 "Minimize losses of human life and structures from flooding and erosion hazards. " The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended. specifically, " A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. The residential structure does not functionally require a location on the coast and is not water dependent. The proposed deck extension encroaches further seaward toward the bank. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Specifically, the most northerly portion of the first floor deck would be increased by 236 square feet, thus reducing the existing northerly side yard setback by 3.5 feet, from 10.5 to 7 feet(where 16 feet is required); reducing the existing total side yard setback by 3.5 feet, from 19.5 feet to 16 feet(where 25 feet is required); and increasing existing lot coverage by 247 square feet, from 23.1 to 25.1 percent of buildable land. However, granting of the relief required to implement these renovations will not cause a detriment to the neighboring properties nor produce an undesirable change to the character of the surrounding neighborhood. -Like the subject property, many of the properties along the developed shoreline of East Creek in the Fleets Neck neighborhood are characterized by similarly sized dwellings and narrow lot widths,-and thus many have similar nonconforming side yard setbacks and/or lot coverage, including some established'through the benefit of variance relief. And the side yard setbacks and lot coverage proposed herein are designed both to be consistent with these other properties and to vary minimally from the existing conditions on the subject property. For example, at least four properties in the surrounding neighborhood have benefited from side yard setback relief, including properties located two to the north in 2000 (Case No. 4843) and three to the north in 2019 (Case No. 7266). In 2017, a property located approximately a quarter-mile to the west on Stillwater Avenue was granted relief to allow a minimum side yard setback"of 6.8 feet-for a deck addition and lot coverage of 29.7 percent,(Case No. 7072). (Comparatively, the applicant's deck addition results in a slightly greater side yard setback of 7 feet and lesser lot coverage of 25.1 percent). And the setbacks proposed by the applicant will also cause little change to the existing site conditions. The existing southerly side yard setback of 9 feet, for instance, will remain unchanged, as the second floor deck will be replaced within the same footprint, and the most southerly portion of the first floor deck would be replaced within the same footprint; and the existing northerly side yard setback of 10.5 feet is being reduced by the expanded first floor deck by only 3.5 feet to 7 feet. Therefore, the total side yard setback is also reduced by only 3.5 feet, and lot coverage is increased by only 2 7 square feet. Sworn to before me this 13th ' Robe . Herrmann day of April 2021 ota Public 1 Nage In addition to the neighborhood character remaining unaffected, the southerly neighbor should be unaffected by the project; and there is little potential impact from the slightly increased encroachment on the northerly neighbor, whose own habitable space is located only 10.9 feet from the shared property line. (Comparatively, the applicant's habitable space will remain located 13 feet from the same property line). In both cases, the position of the upper story deck will remain unchanged, and the lower deck will continue to be well screened from view by the substantial buffer vegetation located between the applicants' and neighbors' houses. 2) The benefit sought by the applicant cannot be achieved without variance relief, in part due to the property's unusually narrow lot width of 50 feet and the fact that the existing dwelling is already characterized by nonconforming side yard setbacks and lot coverage: Therefore, even maintenance of these existing setbacks, such as through in-place replacement of the second floor deck alone, would require variance relief. And the proposed first floor deck expansion that necessitates the additionally requested relief is proposed for the purposes of a) accommodating a new 8' x 14' swim spa to be constructed within the footprint of the deck on the waterside of the house (in place of an existing accessory hot tub to be removed); and b) providing a 6' wide, partially covered section of deck along the north-side of the house to allow direct access to the deck and spa from a proposed egress on the north side-of the house. Thus, without the additional deck area and extension of the deck along the north side of the house, these reasonable renovation goals could not be achieved. 3) The variances requested for the minimum and total side yard setbacks of 7 and 16 feet are mathematically substantial, as they represent requests for 30 percent and 36 percent of relief, respectively. And the variance requested for 25.1 percent lot coverage is borderline mathematically substantial at 25.5 percent relief. But arguably none of the . relief is substantial in fact due to the proposed conditions varying only minimally from the existing, including a 3-foot decrease in both minimum and total side yard setbacks and an increase in lot coverage of 247 square feet or 2.0 percent of buildable land. 4) The proposed project will not have an adverse impact on the physical or environmental conditions on the site or surrounding neighborhood for the following reasons L a. Only a 12' wide section of first floor deck will encroach 7 feet closer to East Creek than seaward limit of the existing deck and will be situated no closer to wetlands than the existing hot tub to be removed. Lot coverage will increase by only 247 square feet, and drainage is proposed to capture and recharge potential runoff associated with the project. For example, the reconstructed second floor deck will equipped with a drain and downspout to be tied into the existing drainage system; and backwash from the proposed swim spas will also be piped to the existing drainage system. c. A project limiting fence will be installed to contain site disturbance and potential surface runoff during construction. 5) It may be argued that the difficulty creating the need for the full scope of requested variance relief is self-created because the property was purchased by the applicant after the zoning limitations- creating the need for variance relief were adopted, and it is therefore presumed that the applicant had actual or constructive knowledge of these limitations at the time of purchase. However, because it is unreasonable to expect that wood deck structures would never need to be replaced over time, and because even the proposed replacement of the existing decks within their legally existing footprints would necessitate variance relief, the need for relief for a substantial portion of the proposed work is not self-created. REASONS/FINDINGS: Single-family dwelling with second-level deck as exists is nonconforming with a 51.6+- ft. setback from bulkhead at its closest point. The deck is shown to be in line with neighboring dwelling structures, and the deck construction is not out of character with the neighborhood. Concerns raised by southerly 'adjoining owner have been fully considered. Generally speaking, it is prefered to have a raised, open deck structure rather than . alternatively physically disturbing land area for placement of a level patio (patios at grade level do not require setback variances, ref: 100-12 Patio definition. An open-deck will not, in the board's opinion, contribute .to erosion n, (also ref: Town Trustee considerations) if constructed 'as conveyed during the hearing/application process.
